SUBJECT: PROPOSED AMENDMENT NO. 3 TO THE HAYDON HAMLET
DEVELOPMENT PLAN - G. DALLAS
PART LOT 14, CONCESSION 8, TWP. OF DARLINGTON
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-177-83 be received; and
2. That the proposed Amendment No. 3 to the Haydon
Hamlet Development Plan be forwarded to Council
for approval at such time as the Council of the
Regional Municipality of Durham has considered
the amendment to the Haydon Development Plan ;
and
3. That a copy of this Report and the attachments
thereto, be forwarded to the Region of Durham
for their information and consideration.

BACKGROUND:
On August 17, 1983, the Planning Department received a
request from Mr. Graham Dallas to amend the Haydon Hamlet
Development Plan to permit the severance of a 1 hectare
(2.5 acre) parcel fronting onto Nelson Street, into two
0.5 hectare (1 .25 acre) lots. The Hamlet Development Plan
presently indicates two separate designations for the
subject parcel - the southern half is designated to permit
residential infilling of one lot, while the most northerly
portion is included as part of the proposed Neighbourhood
Park. As well , the Plan indicates that the central portion
_ of the parcel may be melded with adjacent existing
residential lots, included in the park block, or proposed
residential lots at the owner's discretion.
In accordance with departmental procedures, the subject
application was circulated to various departments and
agencies for comment. The following is a list of the
comments received:

"We have reviewed this amendment to the Haydon Hamlet
Development Plan and find that Nelson Street has a right-of-
way width of 66 feet and is maintained for a distance of
approximately 156 feet across the frontage of the subject
property. Therefore, we have no objections to this
amendment provided that frontage requirements onto
maintained roads conforms to Zoning By-laws for the purpose
of obtaining building permits.

We have reviewed the surface drainage problems of the area
and subsequently request that the applicant prepare a site
drainage plan for the subject property. The plan must be
prepared in accordance with the Town' s Design Criteria and
ultimately approved by the Public Works Department."

Town of Newcastle Fire Department
"The Fire Department has no objection to the proposed
residential infilling of two lots. Access for Fire Depart-
ment equipment shall be provided to each building by means
of a street, private roadway or yard, connected to a public
thoroughfare. Static water supply for fire protection would
be from a tributary of the Bowmanville Creek, running
through the centre of the Hamlet. At present fire
emergency service responds from Station ##1 , Bowmanville,
again indicating a need for a fire station in the northern
section of the Town."
Town of Newcastle Community Services Department
"Please be advised that I have no difficulty with the
proposed Amendment No. 3 to the Haydon Hamlet Development
Plan and the consequent reduction in size of the designated
park. I would point out that there is considerable play
area at the Haydon Hall grounds.
The Community Services Department conducted a playground at
the Haydon Hall ground a few years ago and the attendance
was very poor, with only a few children showing up. Some of
the residents felt the poor attendance was due to the
children having to cross the main road."
Region of Durham Planning Department
We have briefly reviewed this matter and wish to provide
the following comments:
1 . Generally, we have no difficulty with the proposal as
contained in your letter subject to Health Unit
approval .
2. You may wish to determine the desirability of
removing a portion of the neighbourhood park
designation as part of your review of this matter.
3. As you are aware, three amendments have been
approved, or proposed, to the Development Plan for
this Hamlet. This would seem to indicate some demand
for a small amount of additional growth in the
Hamlet. You may wish to review in a more comprehen-
sive matter, the growth possibilities of the Hamlet,
within the context of the policies in the Durham

Regional Official Plan, as part of your review of the
subject proposed amendment.
4. Should a more comprehensive study be undertaken as
suggested in 3 above, we would appreciate reviewing
any proposed amendment to the Development Plan in
accordance with past procedures.
As you are aware, formal comments through Regional Council
are required in accordance with the provisions of the Durham
Regional Official Plan prior to your Council adopting the
subject amendment."
Region of Durham Health Unit
"In view of the size of the subject parcel , there are no
objections to this proposal ."
Central Lake Ontario Conservation Authority
"No objection."
COMMENTS:
Staff note that the most significant effect of redesignating
the subject parcel to "Residential Infilling - Two Lots"
would be to reduce the area of the neighbourhood park
designated in the Hamlet Development Plan. Currently, an
area of approximately 6,000 square metres is designated for
a neighbourhood park; the proposed amendment would reduce
the area to approximately 3,900 square metres. However, the
Community Services Department has indicated that they have
no difficulty with reducing the size of the park because of
a large play area available at the Haydon Hall grounds.
The Hamlet Development Plan identifies surface drainage as a
problem in parts of Haydon, and indicates that, prior to
development occurring, the applicant must demonstrate to the

satisfaction of the Town and the Durham Regional Health
Unit, the methods whereby sanitary sewage and storm run-off
will be dealt with in order to improve existing drainage if
necessary, and prevent possible contamination of wells.
The Durham Regional Health Unit has indicated no objections
to the amendment based on the size of the proposed lots.
The Public Works has requested that the applicant prepare a
site drainage plan for the subject property and that this
drainage plan be ultimately approved by the Department.
Staff note that, should the amendment be approved by
Council , the applicant would be able to apply for the
severance of the two lots. The preparation of a site
drainage plan approved by the Public Works Department, could
therefore be listed as one of the Town 's conditions of
approval at the time the severances are applied for.
The applicant has indicated that the proposed new lots would
each be 0.5 hectares (5,000 square metres) in area. Staff
note that the subject parcel is zoned "R3-Residential " by
By-law 2111 (as amended) of the former Township of
Darlington. The minimum lot area for lots in the R3 Zone is
1 ,486.4 square metres. As well , the Hamlet Development Plan
suggests that new lots have a minimum area of 0.5 hectares.
Therefore, the new lots would appear to comply with respect
to area requirements.
The minimum frontage for lots in the R3 Zone is 24.5 metres.
A frontage of 49 metres is required to provide sufficient
frontage for two lots. However, the subject parcel only has
47.5 metres of frontage on to the maintained road. There-
fore, the granting of a minor variance with respect to the

frontage of one of the lots could also be listed as one of
the Town 's conditions of approval of severances.
The Regional Planning Department has suggested that, because
three amendments have either been approved, or proposed to
the Haydon Hamlet Development Plan, that the Town review in
a more comprehensive manner, the growth possibilities of the
Hamlet. Staff note however, that the Development Plan
indicates that the Hamlet is bordered on east and west by
areas unsuitable for development. As well , the Development
Plan also suggests that development in Haydon be limited to
only minor infilling, inasmuch as there is limited data on
both soil conditions and water supply. Therefore, staff do
not feel that a more comprehensive review of the growth
potential of Haydon, either necessary or appropriate at this
time.
Based on the comments received through the circulation of
the proposed amendment, staff have no major concerns with
redesignating the subject parcel for "Residential Infilling
- Two Lots". It is therefore recommended that Amendment No.
* 3 to the Haydon Hamlet Development Plan as attached to this
Report , be forwarded to Council for approval at such time as
the amendment to the Hamlet Plan has been considered by
Regional Council .
