SUBJECT: AMENDMENT NO. 102 TO DURHAM REGIONAL OFFICIAL
PLAN - PRIVATE FITNESS CENTRE, EXOTIC CAT
SANCTUARY - W. KLOSE
PART LOT 25, CONCESSION 5, TWP. OF CLARKE
FILE: 83-4/D
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-168-83 be received; and
2. That -the following resolution be forwarded to
the Ministry of Municipal Affairs and Housing :
"WHEREAS the Council of the Regional
Municipality of Durham has approved Amendment
No. 102 to the Durham Regional Official Plan to
permit a private recreational facility and a
private zoo in Part Lot 25, Concession 5,
former Township of Clarke, now in the Town of j
Newcastle, and has forwarded Amendment No. 102
to the Minister of Municipal Affairs and
Housing for approval ; and
WHEREAS the Council of the Town of Newcastle
wishes to amend its position on Amendment No.
102 to the Durham Regional Official Plan ; and
BE IT NOW THEREFORE RESOLVED THAT the Council
of the Town of Newcastle has no objection to
Amendment No. 102 to the Durham Regional
Official Plan."

BACKGROUND AND COMMENT:
On June 6th, 1983, the General Purpose and Administration
Committee considered Staff Report PD-86-83. This report
recommended that Council advise the Region of Durham that
the Town of Newcastle has no objections to Official Plan
Amendement application 83-4/D, submitted by Mr. W. Klose to
permit the operation of an Exotic Cat Sanctuary on 4 hectare
site in Part Lot 25, Concession 5, former Township of
Clarke. Committee resolved (Resolution #GPA-499-83) to
adopt the recommendation.
Subsequently, at its meeting of June 13th, 1983, Council
resolved (Resolution #C-42.0-83) to table the item to a
future meeting.
On June 27th, 1983, Council passed a resolution (#C-507-83)
advising the Region of Durham that it was not in support of
Official Plan Amendment application 83-4/D.
The Planning Committee of Regional Council considered a
Commissioner's Report on the amendment application on
October 4, 1983. The Report noted that the applicant also
wished to operate a Recreational Centre on the site, in
addition to the Exotic Cat Sanctuary. The report also noted
that presently there are no specific legislative controls in
Ontario with respect to the operation of private zoos, and

that it would appear that the only means of control of
private zoos is through Site Plan Agreements. The report
recommended approval of the Official Plan Amendment
application.
On October 12th, 1983, Regional Council resolved to adopt
the amendment and forward it to the Ministry of Municipal
Affairs and Housing for approval .

The applicant has now approached the Planning Department
regarding the approval of a rezoning and site plan for the
private Recreational Centre and Exotic Cat Sanctuary.
In view of Regional Council 's approval of -the Official Plan
Amendment, it is recommended that Council adopt a resolution
advising the Ministry of Municipal Affairs and Housing that
the Town of Newcastle has no objection to Amendment No. 102
to the Durham Regional Official Plan. Such a resolution
will expedite approval of the amendment by the Minister of
Municipal Affairs and Housing. However, should Council wish
to pursue its earlier objections, then an appropriate
resolution should be approved to direct staff to file a
request for referral to the Ontario Municipal Board.
