SUBJECT: APPLICATION FOR REZONING - K. CONNELL
PART LOT 8, CONCESSION 1 , TOWN OF BOWMANVILLE

RECOMMENDATION:
It is respectfully recommended that Council approved the
following resolutions :
1 . That Report PD-154-83 be received; and
* 2. That the attached by-law amending By-law 1587,
as amended, be approved.

BACKGROUND:
At the meeting held on September 26, 1983, Council approved
an amendment for rezoning (DEV 83-17) whereby the zone
designation was changed to "R1 " as shown on Map 4 within
Restricted Area By-law 1587. Following the approval
(Council ) of By-law 83-126, it has been brought to staff's
attention by Mr. M. Brown, O.L.S. (Agent) on behalf of Mr.
Connell that in consideration of the minimum front yard
setback within the "R1 " zone of twenty-five (25) feet and
road widening of 3.048 metres (10 feet) to be dedicated to
the Town, the "physical siting" of the dwelling unit - which
has been relocated from another lot in town, would encounter
some "engineering difficulties" when the attempt at placing
the dwelling on a foundation occurs. Mr. Brown has
indicated that the home has to be "dropped" onto the
foundation and accordingly the truck transporting the
dwelling unit has to be properly positioned to do so. In
consideration of the topography of the site and size of
truck required, a thirty-five (35) foot setback from the
existing road allowance would be difficult if not
impractical . Accordingly, staff would have no objection to
the approval of the By-law amendment as attached whereby the
property is to develop in compliance with the "R" zone
designation within By-law 1587.
