MEETING OF SEPTEMBER 19, 1983 REPORT NO. : PD-136-83 SUBJECT: APPLICATION FOR REZONING - K. CONNELL PART OF LOT 8, CONCESSION 1 , FORMER TOWN OF BOWMANVILLE FILE NO. : DEV 83-17 RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following : 1 . That Report PD-136-83 be received; and 2. That Application for Rezoning DEV 83-17 be approved; and * 3. That the attached By-law amending By-law 1587 as amended, be forwarded to Council for approval . BACKGROUND: i The subject application for rezoning requests an amendment to Zoning By-law 1587, as amended, of the former Town of I Bowmanville to rezone a 3876.0 square metre (.96 acres) parcel of land fronting on Mearns Avenue within the Town of Bowmanville. The applicant is requesting a rezoning of the cup subject parcel of land in order to allow the creation of residential building lots. . . .2/ REPORT NO. : PD-136-83 Page 2 The subject lands are designated "Residential " and "Major Open Space/Environmentally Sensitive" by the Region of Durham Official Plan. The use of lands under this land use designation are predominately for residential purposes. In that regard, the creation of residential lots would conform with the policies of the Region of Durham Official Plan. The subject site is presently zoned "A - Agriculture" and "0 - Open Space" by Zoning By-law 1587, as amended, of the former Town of Bowmanville. Under these zoning classifi - cations, single family detached dwellings existing at the date of the passing of the Bowmanville Zoning By-law, would be permitted on parcels of lands having a minimum lot frontage of 122.0 metres (400.0 feet) and a lot area of 10.0 hectares (25.0 acres). In that regard, the applicant is unable to comply with the present by-law requirements and therefore has requested the Town to consider a rezoning of the subject lands in order to permit limited residential development. In accordance with departmental procedures, the subject application was circulated to various departments and agencies for comment. The following is a list of the comments received: Durham Regional Planning/Works Department "The site is designated "Residential" and "Major Open Space" with an indication of hazard lands and environmentally sensitive areas in the Durham Regional Official Plan. The proposal to permit a dwelling on the residentally - designated portion of the site would conform. The boundaries between the land use designations shall be defined in the zoning by-law. With respect to the . ..3/ REPORT NO. : PD-136-83 Page 3 environmentally senstive area and hazard land, we suggest that the proposed development be reviewed in the context of Sections 1 .2.1 , 1 .2.4, and 1 .3.9 of the Durham Plan. Full municipal services are available to the subject land through the abutting 6.75 mm diameter trunk sanitary sewer and 300 mm diameter watermain on Mearns Avenue. However, the abutting trunk sewer in the vicinity of the subject land is extremely deep and the exact method of sewer connection will be determined in concert with the applicant 's consulting engineer." Central Lake Ontario Conservation Authority "The above site is subject to Ontario Regulation 161/80 and is partially within the Regional Storm Floodplain. The Authority staff request that all land within the floodplain be zoned Greenbelt to prevent any structures or fill from being placed in the flood susceptible portion." Town of Newcastle Public Works Department "- the 3.048 metre road widening is dedicated to the Town * (as shown on the attached Plan) - the owner provides illumination which is centrally located for the future building lots (one pole and luminaire) - the applicant must provide a lot grading plan that conforms to Town Standards. Town of Newcastle Fire Department "The Fire Department has no objection to the proposed application for rezoning. Maximum distance from a fire hydrant to a building face shall not exceed three hundred (300) feet where municipal . . .4/ REPORT NO. : PD-136-83 Page 4 water supply is available. Emergency fire response from Station 1 , Bowmanville is within an acceptable distance." Town of Newcastle Building Department "No comment." COMMENTS: Staff have reviewed the request submitted by Mr. Connell and note that since the proposal would conform with the policies of the Regional Official Plan and the fact that municipal services are available to the subject lands, staff would have no objection to the approval of the subject application for rezoning. With regard to the comments received through the circulation process, staff note that the Newcastle Public Works Department indicated conditions of approval for this rezoning, such as the dedication of a 3.048 metre road widening along the frontage of the subject lands and the installation of a street light for future building lots. With respect to this request, severance approvals are also required and staff will be requiring these items as conditions of approval . We note that at the present time, Mr. Connell has received approval from the Land Division Committee (application LD 221/83) to create one residential building lot, subject to the Town of Newcastle approving this application for rezoning. With respect to the concerns of the Central Lake Ontario Conservation Authority regarding the location of the floodplain on the subject lands, staff are proposing to rezone only those lands west of the floodplain line as indicated by the Central Lake Ontario Conservation Authority . . .5/ REPORT NO. : PD-136-83 Page 5 to an "Rl - Residential " zoning classification. The lands to the east of the floodplain line are to remain under the present "A - Agriculture" zoning classification, and will later be zoned to an Environmental Protection area, in accordance with the Conservation Authority's policies, as part of the Town 's Comprehensive By-law. In that regard, since there were no major objections to the proposed rezoning of the subject lands, it would be appropriate to forward the attached By-law amendment to Council for their consideration and approval .
