REPORT NO. : PD-126-83 SUBJECT: SUMMARY OF LAND DIVISION COMMITTEE APPLICATIONS FOR THE MONTH OF JULY, 1983 RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-126-83 be received for information. BACKGROUND AND COMMENTS: For the information of the General Purpose and Administra- tion Committee, staff have prepared the attached list of applications to the Land Division Committee for the month of July, 1983. This list includes the file number, applicant's name, site location, type of severance requested, Official Plan conformity, By-law conformity, staff's comments on the applications and the Land Division Committee's decision. In addition, further to a request from the Committee, an attachment explaining a conflict between staff's recommend- ation and the Land Division Committee has been included for application LD234/83. Director of Planning EP*TTE*jip ' August 30, 1983 ATTACHMENT NO.1 TO REPORT PD-126-83 1 ) Land Division Committee Application LD 234/83 Part of Lot 33, Concession 2 former Township of Darlington The subject application requested permission to separate a 0.7 hectare parcel of land from the total acreage of 1 .2 hectare. In reviewing this application, staff noted that the area was designated as "Residential" by both the Durham Region Official Plan and the Courtice Urban Area Official Plan. Under this landuse designation residential development may proceed on the basis of infilling provided that full municipal services are available. It is our understanding that municipal services were not available to this area. In that regard, staff considered the request not to be in conformity with the Regional Official Plan and the Courtice Urban Area Official Plan and therefore, had recommended denial of the application. However, we had advised the Land Division Committee that should a conflict arise regarding our interpretation of the Official Plans and the Regional staff's interpretation of the Plans, then the Regional staff's interpretation of the Official Plans shall prevail . In the minutes of the meeting, the Land Division Committee noted that the property was zoned "R2 Residential" in By-law 2111 , and that the proposal conformed to this zoning classification. In addition, the Commmittee noted that the subject lands were designated "Residential " by the Official Plans and therefore it was the Committee's opinion that the proposal would constitute infilling of a minor nature. Staff note that Regional Planning staff concurred with the . ..2/ ATTACHMENT NO.1 TO REPORT PD-126-83 Page 2 / decision provided that the applicant enter into an agreement with the Region of Durham for the provision of municipal services to the subject lands at such time as municipal water and sewer become available. This condition was in accordance with a draft Official Plan Amendment Application 83-26/D which would allow residential infilling prior to the availability of full municipal services. Due to the fact that the Town has requested an Official Plan Amendment to permit this type of severance, staff did not consider an appeal to be appropriate for the subject application. u -s 1983 MONITORING OF LAND DIVISION COMMITTEE DECISIONS FILE N0.
