REPORT NO. : PD-118-83 i SUBJECT: DRAFT PLAN OF SUBDIVISION 18T-76011 PENWEST DEVELOPMENT LIMITED PT. LOT 9, CONCESSION 1 REQUEST FOR AMENDMENT TO CONDITIONS OF DRAFT APPROVAL; STORM WATER MANAGEMENT RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-118-83 be received; and 2. That the requested revisions to Draft Plan 18T-76011 be approved ; and 3. That the Ministry of Housing be advised that Council of the Town of Newcastle requests the Minister of Housing to revise draft approved Plan of Subdivision 18T-76011 as approved on January 29, 1981 and amended subsequent thereto on October 16, 1981 through the deletion of Sections 20 a 4 ii ) and 20 b 2 iv). The Council of the Town of Newcastle further requests that all conditions of draft plan approval applicable to 18T-76011 remain applicable to the plan as amended; and . . .2/ u-a(A� REPORT NO. : PD-118-83 Page 2 4. Furthermore, that a copy of said report be for- warded to the Ministry of Housing for their information, records and action thereon. BACKGROUND: On January 29, 1981, the Minister of Municipal Affairs and Housing gave draft plan approval to the subject plan of subdivision comprising some 236 single family lots. The preamble within Condition 20, as approved on January 29, 1981, stated "that the subdivision agreement between the Owner and the Municipality contain the following provisions, with wording acceptable to the Ministry of Natural Resources in the Central Lake Ontario Conservation Authority, herein the Owner agrees". In consideration of the above preamble , Condition 20 b, states that the Owner agrees that prior to final approval of the plan to have prepared a detailed report , drawings and site plans acceptable to the C.L.O.C.A. , the Ministry of Natural Resources and the Town of Newcastle which will show the means whereby storm drainage will be accommodated, a means whereby increases in the volume and run-off will be minimized and the means whereby the existing water quality in the Soper Creek will be maintained. (copy of conditions attached). On October 16, 1981, the Minister approved an amendment to the draft plan whereby Condition 20 was amended by deleting same and replacing it with a new section. (copy attached). The reference with respect to "storm drainage approval " as noted within Section 20 b ii ) of the original conditions of approval was significantly altered within the amended Section 20 (October 16, 1981) whereby the required approval I . . .3/ i i REPORT NO. : PO-118-83 Page 3 of "engineering drawings of the proposed storm water management plan for the site which minimized potential increases in the volume and rate of run-off and maintains existing water quality in the Soper Creek" lies with the Central Lake Ontario Conservation Authority. Staff have, through previous correspondence with the Central Lake Ontario Conservation Authority, staff indicated the Town 's position, whereby it was advised that the provision of detention ponds as part of a storm water management scheme should not create a maintenance or safety problem for the Town. It is staff's opinion that if the Central Lake Ontario Conservation Authority is adamant about provisions for storm water retention, they should also be prepared to become involved in future perpetual maintenance. This, however, does not seem possible, therefore staff must object to the concept of ponds and retention areas due to the potential costs for long term maintenance. In consideration of the above, staff feel the Town has no alternative but to approach the Minister about the possibility of having the draft conditions pertaining to storm water management deleted or revised. Furthermore, it is staff's opinion that Condition 15 - "that the Owner agrees, in writing, to satisfy all the requirements, financial and otherwise, of the Town of Newcastle concerning the provision of roads, installation of services and drainage" would satisfactorily protect the Town 's interest and require the Owner's to design the storm drainage system to the satisfaction of the Town of Newcastle. Staff would recommend that the Developer be required to proceed in accordance with Town standards, as they relate to storm drainage and road construction and in accordance with i existing Town policy.
