SUBJECT: APPLICATION FOR REZONING LIBERTY PENTECOSTAL
CHURCH - OUR FILE: 83-14

RECOMMENDATION:
It is respectfully recommended that the General Purpose
and Administration Committee recommend to Council the
following:
1. That Report PD-106-83 be received; and
* 2. That application for rezoning DEV 83-14 in
respect of part of Lot 14, Concession 1, formerly
Town of Bowmanville, being part 5 on Plan 10R-1617;
located on the north-east corner of Highway Number 2
and Durham Regional Road Number 57 (Martin Road)
be approved, and that the attached By-law to amend.
Restrict (zoning) area By-law 1587, as amended, be
forwarded to Council for approval .
BACKGROUND AND COMMENT:

In June of 1983, the Town received an application for re-
zoning submitted on behalf of the Liberty Pentecostal Church

to amend the Zoning By-law for the Town of Bowmanville to
permit the construction of a Church.
In accordance with Departmental procedures, the subject
proposal was circulated to a number of departments and

agencies in order to obtain their input. The following is
a summary of the comments received.
MINISTRY OF TRANSPORTATION AND COMMUNICATIONS
"This Ministry would have no objections to the proposal as
the site is w*i-thI n the 8owmanville Connecting Link. This
office would have no jurisdiction in this instance. "
REGIONAL MUNICIPALITY OF DURHAM - PLANNING DEPARTMENT
"Further to your request for comments, we note that the
following provisions of Section 6.2.6 of the Durham Regional
Official Plan would be applicable to the subject proposal :
"Notwithstanding any other provisions in this plan to the
contrary, the Council of the respective area municipality
may recognize in the restricted area zoning by-law,. . . . .
places of worship in any area, having first been satisfied
that the proposed facility is compatible with its surround-
ings. In determining land use compatibility, the Council
of the respective area municipality shall have due regard
for the provisions of this plan as they apply to the land
use designation for the area in which the facility is
to be located. In particular, facilities which would unduly
restrict or conflict with the predominant permitted land
use shall not be encouraged."
In addition, there is an indication of Environmentally
Sensitive Areas in the vicinity of the site as shown on
Map A5 of the Durham Regional Official Plan. We would
suggest that the Central Lake Ontario Concervation Authority
be consulted as to the extent and exact location of such
environmentally sensitive areas.
We will also provide you with further comments on the pro-
posed entrance onto Regional Road No. 57 when our invest-
igation is completed. "
REGIONAL MUNICIPALITY OF DURHAM - HEALTH UNIT
"Please be advised that there is no objections to this proposal
but we require the following information:
1. A complete septic application.
2. Three copies of plans of the floor plan.
3. Finishing schedule.
4. Equipment layout schedule.

CENTRAL LAKE ONTARIO CONSERVATION AUTHORITY
At the time this report was prepared, the written comments
of this department had not been received . . . . . . . however,
confirmation by telephone with the Conservation staff
indicated that they had no objections to the rezoning as
proposed subject to proper "site plan management" within the
design stages.
TOWN OF NEWCASTLE - BUILDING DEPARTMENT
"No objections to the rezoning as proposed."
TOWN OF NEWCASTLE - WORKS DEPARTMENT
"We have received this application for rezoning and have no
objection to this proposal . "
TOWN OF NEWCASTLE - FIRE DEPARTMENT
"I would bring to your attention the Fire Department's concern
in regard to a piped water system for fire protection.
Durham Regional Police also are proposing a new building within
this area.
The Fire Department has no objection to the proposed ap-
plication for rezoning. Consideration should be given to
future development without water supply for fire protection,
to extend the water main from Waverley Road to the north
side of Highway No. 2. "
COMMENTS:
The majority of the comments received did not raise any
major objections to the rezoning, rather, comments of a
site plan nature which will be dealt with through a development
agreement to be prepared by staff.

In consideration. of the concept plan, as submitted by the
applicant, the zoning standards as contained within the
attached by-law would provide for an adequate building
envelope in which the structure could be both properly sited
and "architecturally pleasing" to the surrounding area. It
is noted that the vested interest of the Region of Durham
Planning Department and Central Lake Ontario Conservation
Authority with respect the "environmentally sensitive area"
in the vicinity (to the north-east) .would be adhered to
through the by-law provisions whereby the building envelope
is situated on the westerly side of the lot, yet set back
sufficiently from Martin Road and Highway No. 2 (i .e. site
lines from each thoroughfare) .
Given the consideration that the "site plan matters" as
perceived by the various departments and agencies can be
implemented through site plan control procedures, staff
would have no objections to the approval of the requested
by-law amendment to permit a church on the subject site.
