FRANK REALTY PART LOT 10, CONCESSION 1 , 196 KING ST. EAST, BOWMANVILLE - OUR FILE: DEV 83-7 RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following : 1 . That Report PD-104-83 be received; and 2. That application for rezoning DEV 83-7, in respect of Lot 8, Block 1 , Hannings Plan of the former Town of Bowmanville, being Part of Lot 10, Concession 1 , on the north-west corner of Lambert Street and King Street, be approved, * and that the attached Zoning By-law to amend Restricted Area (Zoning) By-law 1587, as amended, be forwarded to Council for approval at such time as a site plan agreement has been properly executed between the Town of Newcastle and the owner of said lands. i Report No: PD-104-83 .. ./2 BACKGROUND: In April of 1983, the Town received an application for rezoning submitted on behalf of W. Frank Real Estate Limited to amend Zoning By-law 1587, as amended. The proposed rezoning would permit the use of the existing 1 -112 storey brick dwelling unit, known municipally as 196 King Street East, for a real estate office. The site is presently designated "Main Central Area" within the Official Plan for the Bowmanville Urban Area, and the Regional Municipality of Durham. A full intregrated array of shopping, personal and business services, offices , residential , social , cultural and recreational activities are permitted within such a designation. Accordingly, the proposal would conform with the plans. Circulation : In accordance with Departmental procedures , the subject proposal was circulated to a number of Departments and agencies to obtain their input. The majority of the comments received did not identify any major objections to the application, but did highlight concerns related to -the site plan, which will be dealt with through the site plan approval process. The site plan application is presently under review by Town staff. Town of Newcastle Works Department e have reviewed the above application for rezoning and we have no objection to this application provided that the applicant enter into a site plan agreement with the Town." Town of Newcastle Building Department '77-Fe—application is approved, Tt is possible the change of occupancy will require a building permit, depending of course on what work is proposed in the building. Also, compliance with the Sign By-law should be mentioned to the owner." i Report No: PD-104-83 . . ./2 Town of Newcastle - Fire Department "The Fire Department has no objection to the proposed application. Response time and travel distance for emergency fire service is acceptable. Water supply for fire protection, fire hydrant is located within 300 feet of building to be protected." Regional Municipality of Durham - Planning Department "Further to your request for comments, we note that the site is located within the Bowmanville Main Central Area as designated in the Durham Regional Official Plan and as detailed in the Bowmanville Official Plan. It is also shown as a Commercial Predominant Use Area in the latter plan. The proposed real estate office conforms. With respect to Regional services, the site is presently serviced by municipal water supply and sanitary sewer facilities and the proposal would appear to have no significant impact on such existing facilities." COMMENTS: The additional parking requirements generated as a result of the change in occupancy will be provided on the lands immediately to -the north of the subject dwelling, yet maintained on the same property. The applicant has proposed on the site plan, as submitted, to construct a 1 .8 metre high board fence along the westerly and northerly lot lines, thereby buffering/screening the parking area from the neighbouring properties. Staff would note that the number of spaces proposed would exceed the by-law requirements, however, minor revisions to the lay-out of the parking area may be required through -the site plan process. i I aCc.� Report No: PD-104-83 . . ./4 Given the consideration that the "site plan matters" as perceived by the various Departments and agencies can be implemented through site plan control procedures, staff have no objections to the approval of the requested by-law amendment to permit the use of the structure for a real estate office, subject to the proper execution of said site plan agreement.
