GEORGE LASKARIS - SOUTH-WEB CORNER KING STREET AND TEMPERANCE STREETS, BOWMANVILLE RECOMMENDATION: It is respectfully recommended that: 1 . This Report be received for information; and 2. That Mr. Laskaris ' request for removal of a parking meter on Temperance Street south of King be approved , conditional upon the following: a) compliance with the provisions of the Town's access by-law; b) satisfying the Director of Public Works with respect to surface drainage; c) satisfying the requirements of By-law 1587 with respect to parking lot surfacing, or alternatively receiving approval of the Committee of Adjustment for a variance; and d) satisfying the requirements of the Building Code with respect to the proposed apartment. Report No. PD-210-82 . . ./2 BACKGROUND: On December 13th, 1982, Mr. George Laskaris apeared before the General Purpose and Administration Committee to request the removal of a parking meter located on Temperance Street, south of King. Mr. Laskaris contended that the location of this meter and the associated parking stall prevented the use of a parcel of his land for access and parking purposes. This request arose from Mr. Laskaris ' enquiries with respect to the availability of a building permit to permit the development of an apartment on the second floor of the Ben Marks store. Mr. Laskaris presently has four other apartment units in this vicinity and provides sufficient off-street parking for each of these units. However, the proposed unit would not have the necessary off-street parking as required by By-law 1587, as amended, necessitating his endeavours to provide additional space and the removal of the parking meter and parking stall on Temperance Street. On June 26th, 1980, the then Public Works Committee considered a similar request from Mr. Laskaris, at which time the request was denied based upon the recommendation of the former Director of Public Works. A copy of the Director's Report to Public Works Committee (WD-90-80) is * attached for the Committee's information. COMMENTS: Staff have reviewed the subject request and note that removal of the subject parking meter and associated stall would alleviate Mr. Laskaris ' problem with respect to on-site parking. It would, however, result in the Report No. PD-210-82 . ../3 introduction of a second access to Temperance Street and this may or may not be desirable, depending upon the site lines for this area and the setback of the two points from King Street, neither of which we are able to ascertain without a detailed site plan and further field investigation. Assuming, therefore, that Mr. Laskaris is able to satisfy the requirements of the Town's access policy and assuming, of course, that Mr. Laskaris can meet the requirements of the Ontario Building Code with respect to the construction of the proposed apartment, a building permit could be made available subject to compliance with all of the other applicable provisions of By-law 1587, as amended. We would note, however, that said By-law requires all parking lots to have a paved surface, and we would also note that drainage of this area may be a concern and that Mr. Laskaris should be required to satisfy the Public Works Department with respect to storm water run-off from this area. Given the limited amount of time to review this proposal and the lack of detailed information provided by the applicant, we are unable to ascertain whether or not Mr. Laskaris will be able to comply with all of the Town 's requirements. However, assuming he is able to meet the various requirements, staff would have no objection to removal of the parking meter and parking stall in question, inasmuch as this would facilitate the provision of the required off-street parking spaces. ITEM: WD-90-80. DATE: June 19, 1980. SUBJECT: Request for Removal of Parking Meter. BACKGROUND: The Town has received a request from Mr. Laskaris, the owner of the building between St. John's Anglican Church and the passageway giving access to the rear of the stores fronting King Street, to remove one _ parking meter on the east side of Temperance Street. Mr. Laskaris has said that the building is presently vacant, but he wishes to rent it to a taxi company; a condition of rental of the building is that the Owner provides parking for the taxi cabs. REPORT: Mr. Laskaris made the suggestion that two off-street parking stalls could be provided along the south side of his building but, in order to gain access to this area, one parking meter and stall would have to be removed from Temperance Street. From an on-site inspection it was determined that only one off-street stall could be accommodated in the area suggested and, even with this provision, the abovementioned meter and stall would require removal. The metered parking stall could be moved more northerly towards the passageway, but this would be in contravention of By-Law 79-1 which states: "A vehicle cannot be parked within one (1) metre of a drive- way" (Section 5:A) . RECOMMENDATION: THAT the request for the removal of a parking meter from the east side of Temperance Street be denied and that the application, Mr. Laskaris, be so notified. Dear Mr. Ferguson: I have already contacted you about removing a parking meter from the front of the premises located at 17 Temperance Street South in Bowmanville because we have room for two cars to park and this parking meter blocks this space. The store used to be rented by a taxi company some time ago. Now I have made an agreement with the DeLuxe Taxi Service for them to rent the store but with the agreement that the parking meter be removed. Thank you, GEORGE LASKARIS.
