DAVIS BLOCK 10, PLAN M-746: APPLICATION TO AMEND THE SOLINA HAMLET DEVELOPMENT PLAN RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. That Report PD-208-82 be received; and * 2. That the attached amendment to By-law 2111, as amended, be approved in accordance with Resolution # GPA-1082-82; and * 3. That the attached amendment to the Solina Hamlet Development Plan be approved in accordance with Resolution # GPA-1082-82. BACKGROUND: On July 19, 1982, R. Davis submitted a rezoning application to change the zoning on Block 10, Plan M-746, from "D - Development" to "Special Provision Residential " to allow the development of the block as two separate residential building lots. An application to sever Block 10 was approved by the Region of Durham Land \r� Division Committee on August 30, subject to rezoning, and subject }� to the approval of an amendment to the Hamlet Development Plan. I Report No: PD-208-82 . . .12 Mr. Davis also submitted a request for an amendment to the Solina Hamlet Development Plan to increase the maximum number of lots permissible in the north-west quadrant of the Hamlet from fourteen (14) to sixteen (16) . The standard circulation of the proposed rezoning and the related amendment produced no major objections. On September 27, 1982, the General Purpose and Administration Committee considered Staff Report PD-154-82. The Report recommended that an appropriate by-law to rezone the subject parcel of land and the related amendment to the Solina Hamlet Development Plan be forwarded to Council for approval ' at such time as Regional Council has considered the amendment to the Hamlet Plan. The Committee endorsed the -Report's recommendations with Resolution # GPA-1082-82. COMMENTS: On November 22, the Town of Newcastle was advised that the Planning Committee of Regional Council considered the amendment to the Solina Hamlet Development Plan on November 10, and had no comment. Therefore, Staff is now recommending that the attached by-law and amendment to the Solina Hamlet Development Plan be now forwarded to Council for approval in accordance with the prior resolution. BY-LAW NUMBER 82-181 1 7 i being a By-law to amend By-law Number 2111 , as amended, of the former Township of Darlington, now in the Town of Newcastle. I WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area By-law Number 2111 , as amended, of the former Township of Darlington. NOW, THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 4 1 . Map 12 of Schedule "A" to By-law 2111 , as amended, is hereby further amended by changing to "SPECIAL PROVISION BY-LAW 82-181" the zone designation of lands indicated as "ZONE CHANGE TO SPECIAL PROVISION BY-LAW 82- 181" on the attached Schedule "X" hereto. I 2. Section 13 of By-law 2111 , as amended, is hereby further amended by adding thereto subsection (oo) as follows: "(oo) Block 10, Plan M-746 (Solina) Notwithstanding any provisions of this By-law to the contrary, j Block 10, Plan M-746, which is designated "SPE_CIAL PROVISION BY-LAW 82-181" on the attached Schedule "A" hereto shall be used only in accordance with the following provisions: (1 ) Permitted Uses a) one single detached dwelling per lot (2) Zone Provisions The zone provisions of the Residential R2 Zone, as set out in Section 12 shall apply, except that the minimum lot frontage shall be 20 metres." 3. This By-law shall come into effect on the date hereof, subject to the provisions of Section 39(11 ) of the Planning Act. I SZ I Chi ) AMENDMENT NO. 1 TO THE HAMLET DEVELOPMENT PLAN FOR THE '_____H`AMT__ET_0F__'SlJMX_ 1 . Purpose of the Amendment The purpose of Amendment No. I to the Hamlet Development Plan for the Hamlet of Solina is to increase from fourteen (14) to sixteen (16) the maximum number of residential units permitted in Residential Expansion Area "B" ; and to delete Residential Expansion Area "A" , and replace same with the Community Facility designation; and further, to delete the Community Facility designation adjacent to Residential Expansion Area "C" within the south-west quadrant, replacing that with the appropriate designation to permit residential infilling. 2. Basis of Amendment This amendment is based upon the decision of Council of the Town of Newcastle to permit the development of one additional residential unit within Residential Expansion Area "B" pursuant to Section 1 .7 of the approved Solina Hamlet Development Plan and to implement the decision of Council of the Town of Newcastle with respect to the development of Community Facilities within the Hamlet of Solina. 3.
