That Report PD-201-82 be received; and 2. That By-law 9-82 of the City of Oshawa be received and filed. BACKGROUND AND COMMENTS: By-law 9-82 of the City of Oshawa was forwarded to the Planning and Development Department on November 10, 1982. The subject By-law rezones two parcels of land on the east and west sides of Wilson Road South, north of Wentworth Street East within the City of Oshawa. The proposed By-law amendment would change the zoning of these lands to "M-1X subject to Special Condition 111 " in order to permit an industrial building containing industrial uses; industrially oriented offices ; a restaurant; a banquet hall ; and limited parking; for the parcel of land on the east side of Wilson Road South. The parcel of land on the west side of Wilson Report No: PD-201 -82 . ../2 Road may only be used as a parking lot, for the exclusive use of the industrial building. The subject lands are located in an area which would not have an effect on the Town of Newcastle, and therefore, no further action on this By-law amendment is required. NOV \q CLERK DEPARTMENT 140TICE OF APPLICATION TO THE ONTARIO MUNICIPAL BOARD BY THE CORPORATION OF THE CITY OF OSHAWA FOR APPROVAL OF A BY-LAW TO REGULATE LAND USE PASSED PURSUANT TO SECTION 39 OF THE PLANNING ACT TAKE NOTICE that the Council of The Corporation of the City of Oshawa intends to apply to The Ontario Municipal Board pursuant to the provisions of Section 39 of The Planning Act for approval of By-law Number 9-82 passed on the 25th day of October 1982. A copy of the by-law is furnished herewith. A note giving an explanation of the purpose and effect of the by-law and stating the lands affected thereby is also furnished herewith. ANY PERSON INTERESTED MAY within twenty-one (21) days after the date of this notice, send by registered mail or deliver to the Clerk of the City of Oshawa notice of objection to approval of the said by-law or part thereof giving details of all or the portion of the by-law to which you object and detailed reasons therefor, and shall indicate that if a hearing is held the objector or an agent will attend at the hearing to support the objection. ANY PERSON wishing to support the application for approval of the by-law may within twenty-one (21) days after the date of this notice send by registered mail or deliver to the Clerk of the City of Oshawa notice of his support of approval of the said by-law together with a request for notice of any hearing that may be held giving the name and address to which such notice should be given. THE ONTARIO MUNICIPAL BOARD may approve of the said by-law but before doing so it may appoint a time and place when any objection to the by-law will be considered. Notice of any hearing that may be held will be given only to persons who have filed an objection or notice of support and who have left with or delivered to the Clerk undersigned, the address to which notice of hearing is to be sent and similarly, to any person who has filed a request for a change in the provisions of the by-law. OF THE CORPORATION OF THE CITY OF OSHAWA being a by-law to further amend By-law Number 3415 of the City of Oshawa. BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law of The Corporation of the City of Oshawa by the Council thereof as follows : 1 . By-law Number 3415 be and the same is hereby further amended by amending Schedule "A" thereof by adding Special Condition 111 as set out in Schedule "B" to this by-law. 2. Sheet Number 14 of Appendix "A" to By-law Number 3415, as amended, is hereby further amended by changing the land use designation for two parcels of land located on the east and west sides of Wilson Road South, the first parcel located at the northeast corner of Wilson Road South and Wentworth Street East and. having a frontage on Wentworth Street East of approximately 39 .17 metres and having a depth of approximately 108. 77 metres on Wilson Road South hereinafter called "Site B" and a second parcel of land located on the west side of Wilson Road South commencing approximately 56. 39 metres north of the northwest corner of Wilson Road South and Wentworth Street East and having a frontage of approximately 27. 61 metres on the west side of Wilson Road South and having a depth of approximately 91 . 11 metres, hereinafter called Site "A" . Both Site "A" and Site "B" are shown on the revised Sheet Number 14 attached hereto as Schedule "A" shown hatched and marked M-1X with the figures "111" encircled. The designation for Site "A" is changed in part from M-1X to M-IX subject to Special Condition 111 and in part from M-1X subject to Special Condition 43- to M-1X subject to Special Condition 111 . Site "B" is changed from M-1X subject to Special Condition "98" to M-1X subject to Special Condition 111. Sheet Number 14 shall be amended as shown on the revised Sheet Number 14 attached hereto as Schedule "A" , to effect the changes in designation. 3 . Schedules "A" , "B" and "C" attached hereto form part of this by-law, and Schedule "C" shall form Appendix "A" to Special Condition 111 . 2- 4. No part of this by-law shall come into force without the approval of the Ontario Municipal Board but subject thereto this by-law shall take effect from the date of its passing. Both Site "A" and Site "B" are shown on the Revised Sheet Number 14 attached hereto as Schedule "A" shown hatched and marked M-1X with the figures "111" encircled and shall be subject to the special regulations hereinafter contained and where there is any -conflict between the regulations hereinafter set out and any other provisions of By-law No. 3415 or By-law Number 55-73, these special regulations shall apply, but in the event that this Special Condition is silent on any matter, the provisions applicable to an M-1X use district and the provisions of By-law Number 55-73 shall apply: 1 .1 Defined Area: The two areas subject to this Special Condition are shown on Sheet 14 of Appendix "A" to By-law 3415, outlined with a heavy line and hatched with the figures "111" encircled and are also shown _on Appendix "A" to this Special Condition. PAGE TWO OF SCHEDULE "B- 1 .2 Permitted Uses : Site A The lands comprising "Site A" as shown on Appendix "A" to this Special Condition shall not be used for any use or purpose except the following : (a) parking lot with a minimum of twenty-three (23 ) parking spaces to provide parking for the permitted uses on the lands shown as "Site B" on Appendix "A" . Site B The lands comprising "Site B" as shown on Appendix- "A" to this Special Condition shall not be used for any use or purpose except one or more of the following uses: (a) all uses permitted in M-1X Industrial Use Districts (b) industrially oriented offices (c) restaurant (d ) banquet hall 1 .3 Permitted Buildings: Site A No buildings shall be permitted on the lands shown as "Site A" on Appendix Site B One building containing no more than 2300 .0 square metres of total floor area, of which no more than 910 .0 square metres of total floor area are to be used for industrially oriented offices, no more than 93 .0 square metres of total floor area are to be used for a restaurant and no more than 186 . 0 square metres of total floor area are to be used for a banquet hall . PAGE THREE OF SCHEDULE "B" 1 .4 Off Street Parking and Loading : (a) Number of Parking Spaces Notwithstanding the provisions of By-law No. 55-73 the required number of parking spaces for the permitted uses on the lands shown as "Site B" on Appendix "A" shall be a minimum of seventy-nine (79) of which a minimum of fifty-six ( 56 ) parking spaces shall be located on Site "B" on Appendix "A" and a minimum of twenty-three ( 23 ) parking spaces shall be located on the lands shown as " Site A" on Appendix "A" . (b) Location of Parking Spaces Notwithstanding the prohibitive provisions regarding . parking in front yards and side yards abutting flanking streets as stated in Section 39 c(3) of By-law 3415 as amended (of the lands shown as "Site B" on Appendix "A" ) a maximum of thirty-three (33 ) parking spaces shall be permitted in the exterior side yard abutting Wilson Road South (of the lands shown as Site "B" on Appendix "A" ) and a maximum of nine (9 ) parking spaces shall be permitted in the front yard of the site abutting Wentworth Street East (of the lands shown as Site "B" on Appendix "A" ) . 1 . 5 Appendix "A" attached to this by-law as Schedule "C" shall form part of this Special Condition.
