MEETING OF DECEMBER 13, 1982

SUBJECT: BY-LAW NUMBER 65-82:
THE CORPORATION OF THE TOWNSHIP OF SCUGOG
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-199-82 be received; and
2. That By-law 65-82 of the Township of Scugog be
received and filed.
BACKGROUND AND COMMENTS:
By-law 65-82 of the Township of Scugog was forwarded to the
Planning and Development Department on November 15, 1982.
The subject By-law rezones a parcel of land located on the
north side of Durham Regional Road 21, being within Part of
Lot 1 , Concession 5, Township of Scugog. The proposed
By-law amendment rezones the subject parcel from (RU) Rural
to (M4) Extractive Industrial in order to permit the use of
these lands for agriculture; aggregate stockpiling;
conservation, forestry and reforestation; outside storage; a
sand and gravel pit; a portable processing plant; and, a ,�
public use, subject to the provisions of Restricted Area

(Zoning) By-law 75-80. ��

The lands affected by this amendment are recognized within
the Region of Durham Official Plan as being a permitted
gravel pit. Inasmuch as the use is permitted and the fact
that the location of this gravel pit is in an area which
would not affect the interests of the Town, we recommend
that no further action be taken on this By-law. However,
the last date for filing objections was December 2, 1982.

EXPLANATORY NOTE
purpose of By-law . k
The- purpose of the attached By-law is to amend Restricted Area By-law
No.. 75--80fi the comprehensive zoning By-law, of the Corporation of the
Township of .Scugog. This..amendment serves to rezone a parcel of land
within the Extractive. Industrial (M4) Zone.
_ -)cation of Lands-Affected.
The lands affected by this - By-law are located in easterly half of Lot 1,
Concession 5, Lard One, adjacent the northerly - limit of Regional Road.
No. 21. The property under consideration is conceptually delineated
on the Zoh.e Map fori.ing part of By-law No. 7�-80 attached as an Appendix
to this Explanatory Note for ease of . reference only. Reference should
J�e rude to Schedule "A" the Zane .Map .farming part, of the amending By-
law for accurate dimensions of the lands in question.
Effect of Amendment
The effect of this amendment to By-law No.75-8€I in rezoning the subject
lands within the Extractive Industrial (M4) Zane is to allow for the
future development and use of the lands . for those purposes set forth
under Section. 4.26 . 1 of By--lair Igo. 75-80, namely, agriculture;
aggregate stockpiling; ccr:ser�ration, forestry and reforestation; outside
storage; a sand and graver pit;. a portable processing plant; and, a
public use, subject to the previsions of Section 4. 26, the Extractive
Industrial (M4) Zone of. By-law No. 75-80..

RESTRICTED AREA By-LAW NUMBER 65-82
BEING A BY PASSES PURSUANT TO THE PRO-,
VISIONS OF SECTION 313 OF THE PLANNING ACT,,
R. S.O. 1980, c. 379 AS AMENDED, TO AMEND
BY-LAW NC. 75-80 WITH RESPECT TO LANDS AT
PART OF LOT 1 , CONCESSION S, WARD I (VAN
CAMP) .
VHEREAS the Council of the Corporation of the .Township
of Scugog has received a request to amend By-Law No, 75-80, the
comprehensive zoning by-law, "so as to allow for the development
and use of those . lands forming part of Lot 1 , Concession 5, Ware
Cane, located north ,of. Regional. Road No. 21 and having an area of
approximately 40 acres , for extractive 7nd.u.strial. purposes ;
AND WHEREAS. the Council of the Corporation of the
Township of Scugog has TeViewed the request , acid considers it _
reasonable to amend By-Law Pie, 75-80 insofar as is necessary
to rezone the said lands within the Extractive Industrial (M4)
Zone;
AND WHEREAS the matters hereinafter set forth in this
By-Lair are in conformity with the Official Plan of the Regional.
Municipalit-y of Durham as amended- by Official Plan Amendment
No. 68,
NOW THEREFORE THE COUNC L F THE CCiRPORA12.710N OF THE TOWNSHIP
OF SCUGOG Enacts As Follows-
1 . That Schedule "Al", a Zone Map forming part of Restricted --
Area By-Law No . 75-80, as amended, ' is hereby further amended
by -rezoning hose lands forming part of Lot 1 , Concession S.
Ward I , north of Regional Road No . 21 , as delineated on the
Zone Map attached hereto as Schedule "bill and forming part
of this By-Law, from the Rural. (RU) Zone to the Extractive
Industrial (M4) Zone.
2. That this By-Law shall came into full farce and effect on
the date of gassing hereof by the Council of the Corporation
of the Township of Scugog, subject -o the approval of the
Ontario Municipal Bayard.
Read a First, Second and Third time and finally passed this
13th day of 'October,. 1982.

BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law
of The Corporation of the City of Oshawa by the Council thereof as i
follows:

1. Sheet Number 3 of Appendix "A" to By-law Number 3415, as
amended, is hereby further amended by changing the land use

designations for two parcels of land situated on the east and west
sides of Attersley Drive, south of the intersection with !

Cobblehill Drive, the first parcel of land located on the east
side of Attersley Drive having zpproximately 43 metres of frontage
on Attersley Drive, from R-3 subject to Special Condition 73 to
R-2 and the second parcel of 1<.nd located on the west side of
Attgrsley Drive having approximately 82 metres of frontage on
Cobblehill Drive, from R-3 subject to Special Condition 72 to R-2A
as Shown on the revised Sheet Number 3 attached hereto as Schedule
"A" so that Sheet Number 3 shal . be amended as shown on the

revised Sheet Number 3 attached hereto as Schedule "A".
2. Schedule "A" attached forms part of this by-law.
3. No part of this by-law shall come into force without the
app oval of the Ontario Municipal Board but subject thereto this
by-i,law shall take effect from the date of its passing.
