REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF NOVEMBER 15, 1982

SUBJECT: ISSUANCE OF CERTIFICATE OF COMPLETION -
MARNIE INDUSTRIAL PARK SUBDIVISION AGREEMENT
- BY-LAW 79-25
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PO-194-82 be received; and
2. That Council authorize the Director of Public
Works to issue a ,Certificate of Completion to
Solina Investments Limited, as successor in
title to Marnie Industrial Park Limited, in
accordance with the Subdivision Agreement drawn
up between Marnie Industrial Park Limited and
the Town of Newcastle, and authorized by By-law
79-25; and j
3. That at such time as a Certificate of
Acceptance is required, a further staff Report
will be submitted for Council 's consideration.

BACKGROUND AND COMMENTS:
On April 2nd, 1979, a Subdivision Agreement was executed
between the Town of Newcastle and Marnie Industrial Park
Limited, respecting the development of an industrial
subdivision in the Courtice Industrial Park. Since the
execution of the Agreement, a number of lots in the
subdivision have been purchased by individual owners. On
June 29th, 1982, the land retained by Marnie Industrial Park
Limited, which constitutes the majority of the lands covered
by the Agreement, was purchased by Solina Investments
Limited.
At its meeting of October 25, 1982, the General Purpose and
Administration Committee considered Report No. PD-176-82.
This Report stated that, under the terms of the Subdivision
Agreement, Marnie Industrial Park Limited, or its successor
in title, is responsible for the construction and
installation of the works required by the Agreement and a
Certificate of Acceptance will be issued once all the works
have been completed to the satisfaction of the Town. The
Report also indicated that, in a letter to the Town dated
August 26th , 1982, the solicitors for Solina investments
Limited stated that much of the work on their land required
by the Agreement has been completed, and requested that a
Certificate to that effect be issued. The Report , which
recommended that Council authorize the Director of Public
Works to issue a Certificate of Acceptance to Solina
Investments Limited, was endorsed by the Committee
(Resolution No. GPA-1184-82) and was subsequently approved
by Council at its meeting of November 1st , 1982 (Resolution
No. C-892-82).

It has been brought to staff's attention that, under the
terms of this Subdivision Agreement, the Town will issue a
Certificate of Completion, not a Certificate of Acceptance
as previously indicated by Staff Report PD-176-82, to the
Developer once the works covered by the Agreement have been
completed to the satisfaction of the Town. The Certificate
of Acceptance, by which the ownership of the works covered
by the Certificate of Completion will revert to the
Municipality, cannot be issued by the Director of Public
Works until a Certificate of Completion has been issued.
It is therefore recommended that Council authorize the
Director of Public Works to issue a Certificate of
Completion to Solina Investments Limited. In addition,
Council is advised that at such time as a Certificate of
Acceptance is required, a further Staff Report will be
submitted for Council 's consideration.
