SUBJECT: BY-LAW NUMBER 66-82:
THE CORPORATION OF THE TOWNSHIP OF SCUGOG
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-190-82 be received; and
2. That By-law Number 66-82 of the Township of
Scugog be received and filed.
BACKGROUND AND COMMENTS:
By-law 66-82 of the Township of Scugog was forwarded to the
Planning and Development Department on October 20, 1982.
The subject By-law is an amendment to Zoning By-law Number
75-80 of the Township of Scugog in order to rezone a parcel
of land located in Lot 11 , Concession 1 , within the Township
of Scugog (former Township of Reach) from "RU-Rural " to
"M4-Extractive Industrial ". The use of lands under the
"M4-Extractive Industrial " will include agriculture;
aggregate stockpiling; conservation; forestry and
reforestration; outside storage; a sand and gravel pit ; a
portable processing plant ; and, a public use.

The subject lands are located in an area of Scugog which
would not have an effect on the Town of Newcastle.
Therefore, no further action on this By-law would be
required. However, the last date for filing objections was
October 29, 1982.

TAKE NOTICE that the Council of the- Corporation of the Township of Scum
intends to Oply to The Ontario Municipal Board pursuant to the provisions
of Section 39 of The Planning Act for approvial of By.-Law # 66-82 passed
on the 13th day of October , 1982. A copy of the by-law is furnished
herewith and a ,note giving an explanation of the .purpose and effect of the
by-law and stating the lands- affected thereby is alto furnished herewith.
ANY PERSON R.EST'ED MAY, within twmty-one (21) days after the date of
this notice, send by registered mail or deliver to the cl.erT, of the Town-
ship of Scugog notice of objection t6 approval of the said by-law or part
hereof giving details of all or the portion of the bylaw to which you
object and detailed reasons therefor, and shall indicate that if a hear-
ing is -weld the objector or an agent will attend at the hesr g to support
the objection.
-PE RSON'wishing to support the application for approval of the by-law
y: within twenty one (21) days after the. date of this notice send by
registered mail or deliver to the clergy .of the Township of Scugog notice
of his support of approval of the said by-law together with a request
for, notice of any. heari-ng that may be hold giving also the name and
address to Ai.clb such notice should be given.
THE l ICIPAL BOARD may approve of the said by-law 'out before
doing so it may appoint a time and place when any objection to the by-
law .will be considered. Notice of any hearing that may be held will be
given only to persons who have filed an objection or notice of support
and who have left with or delivered to. the clergy undersigned, the address
to which notice of hearing is to be sent and, similarly, to any person
who has filed a request for a change in the provisions of the by-law.

EXPLANATORY NOTE
Purpose of .By-law
The purpose of the attached By--law is to amend Restricted Area
By--lair No. 75--8.0, the comprehensive zoning Bar--law, of the
Corporation of the Town'.ship of Scugog. This amendment serves to
rezone a parcel of land within the Extractive Industrial (M4)
Zone.
Location' of Lands Affected
The lands affected by this By-lase are located in northerly portion
of Lot ll,. COncession Onre, Ward one, adjacent the southerly limit
of the Township Road between Concessions 1 and 2. The property
under consideration is conceptually delineated on the Zone Map -
forming part of By-flaw No. 75-80 . attached as an Appendix to this -
Explanatory Note for ease of reference only. Reference should
be made .to Schedule "ASl the Zone Map forming part of the amending
By--law for accurate dimensions of the lands in question.
Effect of Amendment
The effect of this amendment to By-lacy No. 75--80 .in rezoning the
subject lands within the Extractive Industrial (11�14) Zone is to
allow for the future development and use of the lands for those
purposes set forth under Section 4 .26.1 of By-law No. 75-80, -
namely, agriculture; aggregate stockpiling; conservation, forestry
and reforestation; outside storage; a sand and gravel pit; a portable
processing plant;. and, a public use, subject to the provisions of
Section 4.26, the Extractive Industrial (M4) Zone of By-law No. 75---80.

R. S.C. 1980, C. 579, AS AMENDED, TO AMEND
RESTRICTED AREA BY-LAS NO . 75-80 WITH R.E-

WHEREAS the Council of
the Corporation € f. the Township
of Scugog has received a request to amend Restricted Area By-
Law No. 75-80; the comprehensive zoning 'By-Law, insofar as is
necessary to rezone a parcel of land, located in the northerly
portion of Lot 11 , Concession.. 1, hard I , and having an' area of
approximately 25 . 5 hectares, so as to allow for the continued
- development and expansion of an existing sand and gravel pit;
AND WHEREAS the .CoUpCil
of the Corporation of the
Township of Scugog has reviewed the request and considers it
reasonable to amend. By- Law No. 75-80 by rezoning the said lands
within the Extractive Industrial CM4) Zone whereunder the uses
permitted include that of a sand and grave pit together with
various other uses norma?ly considered incidental and subordinate
thereto;
AND WHEREAS the matters hereinafter set forth are in
_ conformity with the provisions of the Officlal Plan of the
Regional Municipality of Durham as amended by Official Plan
Amendment No. 67;
NOW. THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF SCUGOG Enacts As Follows:
1 . That Schedule "All' the Zone Map attached to and forming
part of Restricted Area By-Law No. 75-80, as amended, is
hereby further amended by rezoning those lands forming
the More northerly portion of Lot 121 , Con.cessio'n I , Ward 1 ,
as delineated on the Zone Map attached hereto as Schedule
"All and forning part . of this By-Law from the Rural LRU; Zone
to the Extractive Tndustrial: (M4) Zone .
2, That this By-Law shall come into force and effect on the
date of passing hereof by the Council of the Corporation of
the Township of Scugog, subject to the approval of the
Ontario Municipal Board:
Read. a First, Second and Third time and finally passed. this
13th day of October,. 1982 .
