SUBJECT: BY-LAW NUMBER 63-82:
THE CORPORATION OF THE TOWNSHIP OF SCUGOG
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-189-82 be received; and
2. That By-law Number 63-82 of the Township of
Scugog be received and filed.
BACKGROUND AND COMMENTS:
By-law 63-82 of the Township of Scugog was forwarded to the
Planning and Development Department on October 18, 1982.
The subject By-law is an amendment to Zoning By-law Number
75-80 of the Township of Scugog in order to change the
zoning of a parcel of land located in Part of Lot 11 ,
Concession 5 within the Township of Scugog, from "M2-11
General Industrial Exception Eleven" to "Cl -6 Hamlet
Commercial Exception Six". This By-law amendment will
permit the use of the said lands for the purpose of a farm
implement dealership and a snowmobile sales and service
establishment. ,

The lands affected by this amendment are located within an
area of Scugog which would not have an effect on the Town of
Newcastle. Therefore, no further action on this By-law
would be required. However, the last date for filing
objections was November 4, 1982.

RESTRICTED AREA BY-LAW NUMBER 63-82
BEING A BY-LAW PASSED PURSUANT TO THE PRO-
VISIONS OF SECTION 39 OF THE PLANNING ACT
R. S.O. 1980, c. 379, AS AMENDED WITH RESPECT
TO LANDS AT PART OF- LOT 11, CONCESSION 5 ,
WARD FOUR (TREWIN)
WHEREAS the Council of the Corporation of the Township
of Scugog has received request to amend By-Law 75-80, the
Comprehensive Zoning By-Law, insofar as it applies to the zoning
of a parcel of land forming part of Plah No. 695 in the Hamlet
of Blackstock, located to the south of Crestview Drive and east
of the Old Scugog Road, so as to allow for the development of
the subject lands in accordance with the provisions of the
Development Plan for the Hamlet of Blackstock as adopted by the
Council of the Corporation of the Township of Scugog on November
27, 1978;
AND WHEREAS the said Development Plan designates the
subject lands as "Commercial" whereunder the uses permitted are
convenience commercial uses and farm implement dealerships in .
accordance with the provisions of Section 10. 4. 1. 1 of the Official
Plan of the Regional Municipality of Durham;
AND WHEREAS the Council of the Corporation of the
Township of Scugog has reviewed the request and considers it
reasonable to further amend Restricted Area By-Law No. 75-80, by
rezoning the lands under consideration within a specific Hamlet
Commercial (Cl) Zone whereunder in addition to the uses permitted
within the said zone the existing use, being that of a farm
implement dealership, shall also be permitted;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF SCUGOG Enacts As Follows :
1 . That Schedule 11A811 , a Zone Map forming part of -By-Law No .
75-80, as otherwise amended, is hereby further amended by
rezoning those lands forming part of Lot 11, Concession 5 ,
Ward Four, more specifically referred to as part of Pl�.n
695 in the Hamlet of Blackstock, as delineated on the Zone
Map attached hereto as Schedule "A". and forming part of this
By-Law, from the General Industrial Exception Eleven (M2-11)
Zone t.o the Hamlet Commercial Exception Six (CI-6) Zone .
2 . That Section 4. 17 . 7, Special Zone Categories Hamlet
Commercial (Cl) Zone, of Restridted Area By-Law No. 75-80,
as otherwise amended, is hereby further amended by adding
thereto a new section which shall read as follows :

4°4. 17 . 7 . 6 HAMLET COMMERCIAL EXCEPTION SIX (Cl-6) ZONE.
Notwithstanding the son--residential uses permuted within
the Hamlet Commercial (Cl) Zone as set 'forth under Section
4. 17 . 1 hereof to the contrary, within the Hamlet Commercial i
Exception Six (Cl-6) Zone, as delineated on the Zone Map
attached hereto as Schedule IIA844 and forming part of this
By-Law, the non-residential uses permitted shall include
those set forth under Section 4 . 17. 1: hereof and, in addition, ;,
shall include that of a farm implement and supply sales and
service establishment inclusive of a snowmobile sales and
service establishment together with such other accessory
uses, buildings and structures as are normally considered
incidental and subordinate thereto inclusive of the outside
storage and display of goods - and materials. The provisions
of Sections 4 . 24. 2, 4 . 24 . 3, 4. 24. 4 and 4. 24. 5 hereinafter _
set forth in this By-Law shall apply to regulate the
development and use of those Lands zosned within the Hamlet
Commercial Exception Six CC1-6) Zone when used for the
purposes of a farm implement and supply. sales and service
establishment inclusive of a - snowmobile sales and service -
establishment . In the case of the lands being used for
the purposes of a use permitted within .the �Iassslet Commercial
(Cl) Zone, the provisions of that Zone shall apply and be
complied with. . "
3. That Section 4 . 2 . 11 , entitled the General Industrial
Exception Eleven (142-11) Zone, of Restricted Area By-Law No .
75-80, be and the same is hereby deleted in its entirety.
4. That this By-Law shall come into force and effect on the
date of passing hereof by the Council of the corporation of
the Township of Scugog, subject to the approval of the
Ontario Municipal Board. -
