SUBJECT: REZONING APPLICATION Z-A-1 -15-11
BURKETON HILLS DEVELOPMENTS LIMITED
PART LOT 18 & 19, CONCESSION 10,
FORMER TOWNSHIP OF DARLINGTON
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PO-178-82 be received; and
* 2. That the draft By-law amendment attached to
this Report be forwarded to Council for
approval .
BACKGROUND:
The draft By-law attached to this Report relates to the
draft approved estate-type subdivision located adjacent to
the Hamlet of Burketon. As is normally the case, one of the
conditions applied to a draft approved plan of subdivision
relates to zoning.

In this case, condition 10 of the draft approval stipulates
that prior to signing of the final plan by the Minister, we
are to be advised that the proposed subdivision conforms
with the Restricted Area By-law in effect for the
Municipality.
COMMENTS:
Because the subdivision application procedure itself

requires circulation of draft plans, comments received
during our standard circulation of this rezoning application
generally relate to matters which were presented in Report
PD-162-82 which was presented at the Committee Meeting of
October 12th, and which deals with the subdivision agreement
in respect of this development proposal . As such, they have
not been repeated here, but are available in the Planning
Department should more detailed information be required.
Based on the foregoing, and the fact that a development
agreement has now been approved for execution , staff are
recommending that the draft By-law attached hereto, which
implements condition 10 of the draft approval related to
subdivision 18T-75362, be forwarded for Council 's approval .

BY-LAW NUMBER 82- 163
being a By-law to amend By-law Number 2111 , as amended, of the former
Township of Darlington, now in the Town of Newcastle.
I
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend Restricted Area By-law Number 2111, as amended,
of the former Township of Darlington.
NOW, TIHEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1 . Section 13 of By-law 2111 , as amended, is hereby further amended
by adding thereto the following subsection (rr):

"(rr) Part of Lots 18 & 19, Concessio 10

I Notwithstanding any provisions this By-law to the
contrary, that portion of Lots 8 & 19, Concession 10,
designated "SPECIAL PROVISION B ;-LAW 82-163" on the attached
Schedule "A" hereto, shall be u ei only in accordance with the
following provisions:
(a) Permitted Uses
i
(i) one single-family detached dwelling per lot, and
building and structures accessory thereto.
(b) Zone Provisions
i
(i ) Lot Area (minimum) 0.8 hectare
(ii) Lot Frontage (minimum) l 45.0 metres
where lot lines are not parallel , the lot frontage
shall be the distange between the side lot lines
measured on a line 30 metres back from the front
lot line and parallel to it.
(iii) Front Yard (minimum�'+l' 15.0 metres
(iv) Interior Side Yard (minimum) 6.0 metres
(v) Exterior Side Yard (minimum) 15.0 metres
(vi) Rear Yard (minimum) 15.0 metres
(vii) Gross Floor Area (minimum) 165.0 sq. metres
(viii) Building Height 10.0 metres
2. Schedule "A" to By-law Number 2111 as amended, is hereby
further amended by changing to "SPECIAL PROVISION BY-LAW 82- 163"

the zone designation of the lands designated "SPECIAL PROVISION
BY-LAW 82-163" on the attached Schedule "X" hereto.
3. This By-law shall come into effect on the date hereof, subject
to the provisions of Section 39(11) of the Planning Act.
