That Report PD-175-82 be received; and * 2. That the attached By-law and amendment to the Haydon Hamlet Development Plan be forwarded to Council for approval at such time as the Council of the Regional Municipality of Durham has considered the attached amendment to the Haydon Hamlet Plan; and 3. That a copy of this Report, and the attachments thereto, be forwarded to the Region of Durham for their information and consideration. i I Z NJ {� rowN of Report No: PD-175-82 n . . ./2 BACKGROUND: ONTARIO On August 13, 1982, Nancy anc Paul Gordon submitted an application for rezoning to the Planning Department in order to amend the zoning of Part cf Lot 14, Concession 8, of the former Township of Darlington. The requested By-law amendment would allow the applicants to create one residential lot. The subject lands are located within the Hamlet of Haydon , as designated by the Region of Durham Official Plan. Residential uses are permitted within Hamlet areas . With regards to the Haydon Development Plan, the subject area is designated as an "Area Subject to Development Restrictions". Generally, only agricultural and farm related uses, conservation , reforestation , public or private open space and recreational uses are permitted. Therefore, in order to proceed with the development of a residential lot , an amendment to the Development Plan would be required. In accordance with Departmental procedures, the subject application was circulated tc. various Departments and Agencies for comments. The following is a list of comments received: i Durham Regional Planning Department "We note that the proposed ope (1 ) acre residential building lot at the northerly portion of the property is designated "Area Subject to Development Restrictions" 11, -ihe Hamlet of Haydon Development Plan. Permanent structures or buildings are not permitted within this designation,. Accordingly, an amendment to the Development Flan will be a pre-requisite for the proposed development. We would sugges'c that the Central Lake Ontario Conservation Authority be consulted -to determine the exact extent of the site that can be used for residential purposes." Slopes are more moderate toward Maple Street, and although we cannot support the submitted application we would have no objection to the creation of a lot with depths cf 250 and 200 feet on the north and south sides , respectively. This would provide for a buffer adjacent to the floocline and would ensure that the steeper slopes associated witr the Bowmanville Creek Valley are not subjected to residentially associated activities. On the attached copy, we have indicated in red hatching the area where we would not object to the creation of a residential building lot." Ministry of Natural Resources "On re-examining this matter, we realize that the subject lot extends below the Regional Storm limits of the nearby tributary to Bowmanville Creek.. We believe that a residential zoning for the flood susceptible lands would be inappropriate. . Furthermore, t is a policy of this Ministry to oppose the development of flood prone lands. Therefore, we recommend that only those lands lying above the limits of the Regional Storm should be zoned "Residential ". The lands within the floodplain should retain the "Greenbelt" zoning, so that development will be restricted. The Regional Storm limits have been mapped under an engineering study carried out for the Central Lake Ontario Conservation Authority. Since the flood susceptible portion of* this property is very small , we do not believe that our recommendation need have an appreciable effect on 'the Gordons plans to use the property for a residential use." The Town of Newcastle Public Works Department no comment" The Town of Newcastle Fire Department "no objection" I THE TOWN OF Report No: PD-175-82 , /4 COMMENTS: Staff have reviewed the comments received and as there were no major concerns we have no objection to the approval . In accordance with comments received from Central Lake Ontario Conservation Authority and Ministry of Natural Resources the zoning designation will no-, extend further than the fill and construction limits as designated by the Central Lake Ontario Conservation Authority. All lands beyond the fill and construction limit will remain as "Greenbelt". In order that the proposed residential lot be recognized in the Haydon Development Plan, staff have prepared an amendment to the Development Plan. This amendment should be forwarded to Council for approval together with the amendment to the Restricted Area (Zoning) By-law, at such time as the amendment to the Hamlet Plan has been considered by Regional Council . Purpose of Amendment The purpose of Amendment No, 1 to the Hamlet Development Plan for tre 1;c.rrlet of Haydon is to delete the designatior of "Area Subject 'Clo Development Restricticnis" and by replacing said designation to perm-t residential development. 2. Basis of Amendment This amendment is based upon the decision of Council of the Town of Newcast;e to permit the development of one residential unit pursuant to Section 3.2 of the approved Haydon W— let Development Plan. 3. WHEREAS the Council of the Corporation o-� the Town of Newcastle deems f it advisable to amend Restricted Area By-law Number 2111, as amended, of the former Township of Darlington. NOW, THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1 . Map 9 of Schedule "A" to By-law 2111 , as amended, is hereby further amended by changing to "SPECIAL PROVISION BY-LAW 82- the II zone designation of lands indicated as "ZONE CHANGE TO SPECIAL PROVISION BY-LAW 82-_"" on the attached Schedule "X" hereto, and by changing to "Greenbelt (G) Zone" the zone designation of the lands indicated as "Zone Change to "Greenbelt (G) Zone" on the attached Schedule "X" hereto. 2.
