SUBJECT: ,- BY-LAW NUMBER 56-82:
THE CORPORATION OF THE TOWNSHIP OF SCUGOG
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-174-82 be received; and
2. That By-law Number 56-82 of the Township of
Scugog be received and filed.
BACKGROUND:
By-law 56-82 of the Township of Scugog was forwarded to the
Planning and Development Department on October 4, 1982. The
subject By-law is an amendment to Zoning By-law Number 75-80
of the Township of Scugog in order to permit the development
of 88 single family dwellings in conjunction with a Marina
development. In addition, the subject By-law establishes
zone provisions for the purpose of regulating the location
of said dwellings.

The lands affected by this amendment are located in Part of
Lots 19 and 20, Concession 8 within the Township of scugog.
In that regard, the proposed development would not affect
the interests of the Town of Newcastle and therefore no
further action on this By-law amendment is required.
However, the last date for filing objections is October 25,
1982.

ZONING BY-LAW NUMBER 56-82
BEING A BY-LAW TO AMEND ZONING BY-LAW NO .
75-80, AS AMENDED. (PART LOTS 19 & 20,
CONC. 8, WARD I - SHAW SUBDIVISION)
WHEREAS the Council of the Corporation of the Township
of Scugog has received a request to amend By-Law No . 75-80 the
comprehensive zoning By-Law, to allow for the development of a
P lan of subdivision within part of Lots 19 and 20, Concession
8, ward One,
AND WHEREAS the Council of the Corporation of the Town-
ship of Scugog has further been advised by the Minister of
Municipal Affairs and Housing that the said plan of subdivision
has received draft plan approval and of the conditions of such
approval which must be complied with prior to registration of
the pl-an in accordance with the provisions. of The Planning Act ;
AND WHEREAS the Counci'l of the Corporation of the
Township of Seugolu has given due consideration to the draft ,pl-an
of subdivision and considers it reasonable to proceed with the
enactment of an amen-dioent to the comprehensive zoning By-Law to
satisfy Condition No . 7 of the Minister' s conditions of draft
plan approval and thereby provide for the development of the
said lands for the purposes of 88 lots for single-family detached
dwellings and a block of land to be developed for public park-
land;
AND WHEREAS the matters herein set forth in this By-Law
are considered to be in conformity with the provisions of the
Official Plan of the Regional Municipality of -Durham as amended;
- AND WHEREAS there has been no amendment to the Official
Plan of the Regional Municipality of Durham with which the
-matters herein set forth are incontravention;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF SCUGOG Enacts As Follows:
1 . THAT Schedule "Al", the 'one Map of Ward One, forming
part of Restricted Area By-Law '.No . 75-80, be and the same,
is hereby amended by rezoning those lands forming part of
Lots 19 and 20, Concession 8, Ward One., adjacent the more
easterly limit of Regional Road No . 2 and as delineated on
the Zone Mar, attached hereto as Schedule "A" and forming
part of this By-Law., from the Rural (RUI Zone and the
Environmental P-rotection (Ex) Zone to the Urban Residential,
Type T]hree Excepti.&yj Four (R3-4) Zone.

2 . THAT Schedule "All', the Zone Map of Warci one, forming
part of Restricted Area By-Law No . 75-8'0, b-e and the same,
- is hereby amended by.,rezoning those lands forming part of
Lot 20, Concession 8, Ward One, adjacent the more easterly
limit of Regional Road No. ' 2 and- as -delineated on the Zone
Map attached hereto as Schedule "All and forming part of
this By-Law, from the- Rural (RU) Zone to the Recreational
Exception One C-RE-1) Zone.
3 THAT Section 4. 3, the Recreational (RE) Zone, of
Restricted Area By-Law No. 75-80, be and the same, is
hereby amended by adding thereto a new subsection which
shall read as foilows :
114. 3.4 SPECIAL ZONE
CATEGORIES RECREATIONAL CRE) ZONE
4 . 3. 4. 1 RECREATIONAL EXCEPTION ONE (RE-1) ZONE
Notwithstanding the provisions of Recreational (RE) Zone
.to the I contrary, within the Recreational Exception one
CRE-1) Zone, as delineated on the Zone Map attached hereto
-as Schedule "Al" and forming part of this By-Law, the
following provisions shall apply to regulate the develop-
ment use of the said lands, namely:
a. Permitted Uses
No person shall within the Recreational Exception One
. (RE-.1) Zone use any land or erect , alter or use any
building or structure except as specified hereunder,
namely:
i. conservation,_ forestry, reforestation or other
similar use as provides for the preservation of the
natural environment;
ii. a public park;
iii . a public use or municipal utility in accordance
with the vrovisiozis of Section 5 . 17 hereinafter
set forth in this By-Law; and,
iv. uses, buildings and structures accessory to any of
the foregoing permitted uses in accordance with the
provisions of Section 5. 1 hereinafter set forth in
this By-Law;
b, Regulatory Provisions
(a) Minimum Yard Dimensions
1. Front Yard 10 metres
ii. Side Yard 10 metres
iii . Rear Yard 10 metres ..

(b) Special Yard Provisions
Notwithstanding any other provision of' this By-Law to
the contrary, within the Recreational Exception One
(RE-1) Zone, no building or structure, except for
flood, erosion and siltation control works or docks
and related mooring facilities which have receivers the ;`
prior written approval of the Ministry of Natural
Resources, shall be erected below the present high
water mark of Lake Scugog which for the purposes of
this : By-Law_ shall be defined as the 250 metre
Canadian Geodetic Datum level .
(c) Maximum .Lot Coverage of All Building: and Structures
30 percent °
(d) Minimum landscaped Open Space Requirement- 50 percent
(e) Maximum Height of Buildings or Structures - 8 metres
(f) Other Zone Provisions
In all other respects the provisions of the
Recreational (RE) Zone shall apply and be complied
with."
4. THAT Section 4 . 11, the Urban Residential Type Three (R3)
Zone, of Restricted Area By-Law No . 75-80, be and the same, ,:
is hereby amended by adding thereto a new subsection which
shall read as follows:
914. 11 . 5 SPECIAL ZONE CATEGORIES - URBAN RESIDENTIAL TYPE
THREE (R3) ZONE.
4. 11 . 5 .4 URBAN RESIDENTIAL TYPE THREE EXCEPTION FOUR (R3-4) -
ZONE .
Notwithstanding the provisions of the Urban Residential
Type Three (R3) Zone as set forth under Section 4. 11 here-
of to the contrary, within the Urban Residential Type
Three Exception Four (R3-4) Zone, as delineated on the
Zone Map attached hereto as Schedule E1Allt and forming
part of this By-Law, the following provisions shall apply
to regulate the development and use of the said lands,
namely:
(a) Minimum Lot Area Requirement - 5400 square metres
(b) Minimum Lot Frontage Requirement - 36 square metres
(c) Minimum Yard Dimensions
i. Front Yard 10 metres
ii. Exterior Side Yard 10 metres
iii. Interior Side Yard 3 metres
iv. Rear Yard 15 metres

(d) Special Yard Provisions
Notwithstanding the minimum yard requirements set
forth under' subsection (c) hereof to the contrary, -
where a permitted residential dwelling is to be
erected adjacent Regional Road No. 2 the minimum
required yard shall be IS metres .
