BACKGROUND: * Report P-4-81 , copy attached, outlines the rezoning application made by Sylvia and Robert Laycoe in September of 1980. That report, dated December of 1980, recommended that based on a review of the circumstances surrounding the rezoning, that a draft By-law be forwarded to Council for approval at such time as the Region of Durham advised the Town that a road widening, requested as a condition of approval , had been received. I i Report Flo: PD-172-82 . . ./2 At the Planning and Development Committee meeting of January 5th, 1981 , the recommendation contained in Report P-4-81 was amended to read as follows: "The attached By-law be forwarded to Council for approval at such time as the Town has been notified by the Region of Durham Works Department that their request for road widening has been satisfied and received." Rezoning application Z-A-1 -13-4 has, since January 1981 , been effectively in "limbo" as the Town awaited confirmation from the Region that they had received and are satisfied with the requested road widening. It is difficult at this stage for Town planning staff to explain the nature of the delay except that it appears that the applicants ' lawyers and the lawyers working on behalf of the Region have had difficulty finalizing the transfer of the requested road widening. Planning staff have, on a number of occasions, contacted the Regional Works Department in an effort to expedite the processing of the zoning application. However, staff have only recently been advised that the Region was satisfied. It is therefore now recommended that the draft ( By-law attached hereto be approved pursuant to Resolution PD-8-81 as amended by PD-9-81 (copies attached). Resp t y submitted, '4� T. T.
