That Report PD-166-82 be received; and 2. That By-law Number 51-82 of the Township of Scugog be received and filed. BACKGROUND AND COMMENT: By-law Number 51-82 of the Township of Scugog was forwarded to the Planning and Development Department on September 22, 1982. The subject By-law is an amendment to Zoning By-law Number 75-80 of the Township of Scugog in order to establish a minimum lot size of 4.5 ha for an intensive agricultural use, being a corn drying operation. The subject By-law amendment affects a property located in Part of Lot 13, Concession 14 within the Township of Scugog and therefore would not have an effect on the Town of Newcastle. i a� 888 No: 166 Report - - p PD 82 .../2 / In that regard, no further action on this 6y-law amendment would be required. THE CORPORATION OF THE TOWNSHIP OF SCUG* OG RESTRICTED AREA BY-UAW NUMBER 51-82 BEING A BY-LAW TO AMEND ZONING - BY-LAW NO. 7580, AS AMENDED WITH RESPECT TO LANDS ATYART OF LOT 13, CONCESSION . 14, WARD 1 . WHEREAS the Co-uncil of the Corporation of the Township of Scugog has received a request to amend Restricted Area By- Law No. 75-80 to allow the d6velopment -of an intense farming use on approximately 4 . 5 hectares of land at part of Lot 13, Concession, 14, Ward I . AND WHEREAS the Council of the Corporation of the Township of Scugog has given due consideration to this matter and considers it to be -desirable to. amend Restricted Area By-Law No ., 75-80 so as to allow for .the development of the aforementic-tirz-, proposal . NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF SCUGOG Enacts As Follows : 1 . That Schedule "All', the Zone Map attached to and forming. - part of Restricted Area By-Law No . 75-80, be and the same is hereby amended by rezoning those lands forming part of Lot 13, Concession 14, Ward I , as delineated on the zone map attached hereto as Schedule "All and forming part of this By-Law. from the Rural CRUIJ zone to the Rural Exception Nine (RU-9) zone . 2. That Section 4. 2. 5, the Rural (RU) Zone, specifically the Special Zone Categories , of Restricted Area -By-Law 75-80, as otherwise amended, is hereby further amended by adding there- to a new subsection which shall read as follows : 114. 2. 5 . 9 RURAL EXCEPTION NINE (RU-9) ZONE: Notwithstanding the provisions of the Rural (RU) Zone' as set out under Section 4. 2'. 3 hereof, within the Rural Exception Ni-ne (RU-9) Zone as delineated on zone map attached hereto as Schedule "A-111 and forming part of this By-Law, the minimum lot area requirement shall be 4 . 5 hectares . In all other respects the provisions of the Rural (RU) Zone shall apply and be complied with. " 3 . That this By-Law shall cone into force and effect on the date it is passed by the Council of the CoTporati6n of the ,Township Of Scugog, subject to the approval of the Ontario Municipal Board. 2 Read. a 'Rarst$ Second and Third time and finally passed this 13th day of September, 19 82.
