HomeMy WebLinkAboutPD-165-82 CORPORATION OF THE TOWN OF NEWCASTLE PLANNING AND DEVELOPMENT DEPARTMENT T.T.EDWARDS,M.C.I.P.,Director HAMPTON,ONTARIO LOB 1JO TEL.(416)263.2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF OCTOBER 12, 1982 REPORT NO. : PD-165-82 SUBJECT: THE OFFICIAL PLAN OF THE CAVAN TOWNSHIP PLANNING AREA RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-165-82 be received; and 2. That Council endorse staff's comment to the Municipality of Cavan on the Official Plan of the Cavan Township Planning Area; and 3. That the Municipality of Cavan be advised of Council 's endorsement. BACKGROUND: On August 23rd, 1982, the Town of Newcastle received from the Municipality of Cavan a copy of the Official Plan of the Cavan Township Planning Area, along with a request for comments. �� I Report No: PO-165-82 .. ./2 Since these comments were due by September 30th, 1982, Town staff did not have an opportunity to present the Official Plan to Council to obtain its position. As such, staff forwarded their comments to the Municipality of Cavan, with the caveat that they only represented the position of Planning Department staff, and that a Report on the Official Plan would be brought to Town Council at a later date. This Report seeks Council 's position on the Cavan Official Plan. The Township of Cavan is a rural municipality located in the south-west corner of Peterborough County. Its south-western boundary abuts the extreme north-eastern boundary of the Town of Newcastle for a distance of approximately two kilometres. The Township, which comprises 26,392 hectares (102 square miles) and has a population of 4,000 (1981 figures) , lies just beyond the direct urban influence of the City of Peterborough to the east and is served by the Village of Millbrook. The Cavan Township Planning Area was defined by the Minister of Municipal Affairs and Housing on September 8th, 1981 , and includes the whole of the Township of Cavan. The Official Plan for the Planning Area, consisting of a Land Use and Transportation Plan and explanatary text, was adopted by the Township Council on July 6th 1982, and has been forwarded to the Minister for approval . By means of the text and Land Use Plan, the Official Plan establishes a framework for formulating planning decisions and guiding the future growth and development of Cavan Township over approximately the next twenty years. i i i i Report No: PD-165-82 .. ./3 Two of the more important strategies set in place by the Plan will direct development to the completion of existing development patterns and will protect the resource base for agriculture, forestry and aggregate production. COMMENTS: In our comments to the Municipality of Cavan, we indicated that Town staff are generally supportive of the policy objectives of the Official Plan and noted that, in many respects such as discouraging the fragmentation of agricultural land for residential purposes , it is similar in its designations and provisions to the Region of Durham Official Plan. For our specific comments on the Plan, we concentrated on that portion of Cavan Township which abuts the Town of Newcastle, to determine if the designations for this area are compatible with the designations for the adjacent lands in Newcastle as given in the Durham Official Plan. The lands in Cavan Township immediately adjacent to Newcastle, are designated "Recreation-Conservation" , which corresponds closely to the "Major Open Space" designation in the Durham Official Plan. Further east, there is a significant portion of land designated "Environmental Protection" which is akin to Durham's "Hazard Lands" and "Environmentally Sensitive" designations. It therefore appears that the designations and provisions in both Official Plans for the lands adjacent to our common boundary are compatible. i Report No: PD-165-82 A copy of the staff letter to the Municipality of Cavan has * been attached to this Report for Council 's perusal . We would also note, at this point, that a copy of the Official Plan for the Cavan Township Planning Area is available for review at the Hampton Office. It is requested that Council endorse staff's comments to the Municipality of Cavan with respect to the Official Plan for the Cavan Township Planning Area, and that the Municipality of Cavan be so advised. Wisner, AMCT Clerk-Treasurer Dear Ms. Wisner: As requested, we have reviewed the Official Plan of the Cavan Township Planning Area, and have the following comments to offer. Please note, however, that we have not had an opportunity to present the Official Plan to our Town Council to obtain a formal Town submission by the September 30th, 1982 deadline. Therefore, the comments presented in this letter only represent the position of Planning Department staff. A Report seeking Council 's endorsement of these comments will be brought forward sometime in October and, at that time, you will be advised of Council 's decision. Generally, we support the policy objectives of the Official Plan and note that, in many respects, such as discouraging the fragmentation of agricultural land for residential purposes, it is similar in its designations and provisions to the Region of Durham Official Plan. Wisner, AMCT September 27, 1982 The north-eastern portion of the Town of Newcastle is occupied by the Oak Ridges Moraine. The Durham Official Plan recognizes the need to preserve and protect the physical and biological attributes of this unique feature by inlcuding the moraine in the "Major Open Space System" designation. The predominant use of lands designated as "Major Open Space" is agricultural and farm-related uses, conservation and other uses such as reforestation , golf courses and campgrounds. In addition, the Plan severely restricts non-farm residential uses. I We note that the lands in Cavan Township immediately adjacent to the boundary with the Town of Newcastle are designated "Recreation-Conservation", while to the east there is a significant portion of land designated "Environmental Protection". The land designated "Recreation-Conservation" is also intended primarily for recreational , conservation, forestry or agricultural purposes. While residential development is also limited on lands in this designation, this provision might be expressed in stronger terms in both the "Recreation-Conservation" Section (5.10) and the "Severance" Section (4.4). Nevertheless, this designation appears to correspond closely to our "Major Open Space" designation. The "Environmental Protection" designation appears akin to the "Hazard Land" designation in the Durham Official Plan, since lands in both designations possess inherent physical hazards such as flood susceptability, poor drainage, erosion prone soils and steep slopes. However, lands identified as being environmentally sensitive are given a separate designation, "Environmentally Sensitive Area", in the Durham Official Plan, while, in the Cavan Township Official Plan, such lands are incorporated into the "Environmental Protection" designation. From our reveiw, it appears that the designations and provisions in both Official Plans for the lands adjacent to our common boundary are compatible. I .../3 I i i - 3 - � Julia M.
