SUBJECT: APPLICATION FOR REZONING AND SITE PLAN
APPROVAL BY AUTOMOTIVE PLASTICS PAINT MFG.
LIMITED - OUR FILES: Z-A-1 -1 -8 & S-P-1 -22
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-164-82 be received; and
* 2. That the draft By-law amendment attached to
this Report be forwarded to Council for
approval ; and
* 3. That the attached By-law authorizing execution
of an Agreement between Automotive Plastics
Paint Mfg. Limited and the Town of the
Newcastle be approved; and
* 4. That the attached Development Agreement between
Automotive Plastics Paint Mfg. Limited and The
Corporation of the Town of Newcastle be
approved for execution.

BACKGROUND:
The applicant, Automotive Plastics Paint Mfg. Limited,
proposes to erect a warehouse and ancillary office building
on a one hectare parcel of land that is currently owned by
Ontario Hydro and subject to a severance application. The
lands are located in Part of Lot 5, Concession B.F. ,
Darlington. The site plan application relates only to this
one parcel of land, however rezoning is requested for
another parcel of approximately the same size, immediately
south along the west side of Bennett Road, also the subject
of a current severance application, and also owned by
Ontario Hydro.
The lands in question are designated "Industrial " by the
Durham Region Official Plan and the Official Plan of the
Bowmanville Urban Area. The proposed warehouse and
ancillary office conforms to the policies set out in this
designation insofar as it is a dry-type use. As municipal
water supply and sanitary sewers are not available in this
portion of the Town at this time, only industrial uses of a
dry nature may be permitted. As required by Section 8.4.3.2
of the Durham Official Plan, the applicant has submitted an
Engineering Report, which confirms the suitability of the
soils for a private waste disposal system.
In accordance with our Department 's standard procedures, the
applications were circulated to a number of affected
departments and agencies. The following is a summary of the
comments received.
Durham Planning Department
"Further to your request for comment, we note that the site
is designated "Industrial " in the Durham Regional Official
Plan. The proposed warehouse and ancillary office conforms
to this designation.

The proposal also appears to conform to the Official Plan of
the Bowmanville Urban Area as adopted by Regional Council on
July 7th, 1982.
With respect to services , municipal water supply and
sanitary sewer services are not available to this portion of
the Town and, in accordance with the provisions of Section
8.4.3.2 of the Durham Plan, only uses of a dry nature shall
be permitted on the site. In this regard, we have forwarded
a copy of the rezoning application, together with the draft
agreement and engineering report, to the Durham Regional
Health Unit for their review. We have also requested that a
copy of their comments be sent directly to you."

"This Health Unit has no objection to the above proposal ."
Newcastle Building Department
"no comment"
Newcastle Public Works Department
"Please be advised that we have no objection to the rezoning
proposed in this application. With respect to the site plan
and agreement, the following comments are offered:
1 . Clause 3, Parking and Loading - makes reference to
Schedule "C" and indicates parking areas to be concrete or
butuminous asphalt. Schedule "C" itself shows gravel
surfaces in these areas. In our opinion, there is no need
to have the driveway or entrance paved.
2. Clause 6, Grading and Drainage -
i ) The proposed entrance is to be constructed in accordance
to Town policy, i .e. the proponent must file for an
entrance permit and pay the necessary fees.
ii ) Ditches and boulevards on the road allowance must be
graded to the Town 's specification and thence be
sodded.
3. Clause 7, Floodlight - should be referred to as
"Illumination".

4. With respect to the Works Cost Estimate, it should
include:
i ) cost of the entrance; and
ii ) cost of the boulevard grading and sodding."

Newcastle Fire Department
"The proposed warehouse is located 6 km from Station #1 ,
Bowmanville with a response time of approximately 10
minutes.
Municipal water supply for fire protection is not available
within the area. In accordance with the Town of Newcastle
policy for fire protection in rural development ,
consideration should be given to installing a water
reservoir minimum of 50,000 L. designed by a Registered
Professional Engineer.
Above ground tank storage shall be in accordance with
Ontario Statutes."
Ministry of Transportation and Communications
"Your request for comments dated September 7th, 1982 has
been reviewed by this Ministry and the proposal is
acceptable.
The applicant should be advised that building and land use
permits may be obtained from our Port Hope District Office.
These should be obtained prior to actual construction being
undertaken.
As you may be aware, the Ministry's future road proposals
through this area will replace the existing Bennett Road
interchange with a new interchange at Cemetery Road. We
would suggest the applicant be made aware of the above."
COMMENTS:
As the comments outlined above suggest, the subject
application for rezoning on two parcels of land, which are
presently subject to active severance applications and site
plan approval on one of those parcels, appear relatively
straightforward and no major problems are perceived.

Planning staff have considered the suggestion made by the
Fire Chief relative to a fire reservoir and note that to
impose such a condition in this case, could unnecessarily
complicate the development of this site. These lands are
within an urban area and will , in the future, be serviced by
piped sewers and water. Should Council deem it appropriate
to make this a requirement of development, the development
agreement should be amended accordingly.
Staff have noted the comments submitted by the Ministry of
Transportation and Communications relative to the future
closing of Bennett Road and the applicants have been so
advised. From our point of view, the closure of the Bennett
Road interchange at sometime in the future would not unduly
limit access to this property.
As such, staff are recommending that the two parcels
fronting on Bennett Road, being approximately 900 square
metres, or two (2) acres each, be rezoned to permit a very
limited range of dry industrial type uses. Staff are also
recommending that the Site Plan Agreement which relates to
the northerly parcel be approved. This Agreement has been
reviewed by the applicant, and arrangements have been made
to have signed copies prepared for execution.
