SUBJECT: AMENDMENT TO THE DEVELOPMENT AGREEMENT
BETWEEN PORT DARLINGTON MARINA HOTEL AND
THE CORPORATION OF THE TOWN OF NEWCASTLE
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-163-82 be received; and

2. That the attached amendment to the Development
Agreement between Port Darlington Hotel Limited
and The Corporation of the Town of Newcastle
authorized by By-law 81 -69, as amended by an
Amending Agreement authorized by By-law 82-40
be approved for execution ; and
* 3. That the By-law authorizing execution of a
further Amending Agreement between the Port
Darlington Marina Hotel and The Corporation of
the Town of Newcastle be approved.
* 4. That the attached amendment to the Development
Agreement between Robert Irving Gill , Senior,
Robert Irving Gill , Junior and The Corporation
of the Town of Newcastle authorized by By-law
81 -173 be approved for execution; and

5. That the By-law authorizing execution of an
Amending Agreement between the parties noted in
4. above be approved.
BACKGROUND:
On the 3rd day of June, 1981 , the Town of Newcastle and Port
Darlington Marina Hotel Limited entered into a comprehensive
Development Agreement to control the development of the
Marina site and on the 29th day of October 1981 , an
agreement was executed to control development of the Port
Darlington Hotel Complex site. Thess Agreements were
authorized and approved , and both include a site plan
showing the location of all buildings, structures, parking,
loading, as well as docking and landscape areas. Since the
time the Agreements were executed, it has been necessary to
amend one of the Agreements to clarify the location of a
parking area.
On September 28th, 1982, staff received a request from the
Hotel 's owner for a further amendment to the site plans to
allow the construction of a small expansion and enclosure to
the Hotel building. Staff believe that this change is
minor and have no objection. However, because of the way the
original Agreements are worded, an amendment is required.
COMMENTS:
In order to facilitate this proposed expansion and other
minor modifications to the site plan, staff are recommending
that the original agreements be modified to allow the owner
to make minor changes without the necessity of requesting a
formal amendment to the Site Plan Agreements.

Staff are recommending, therefore, that the original
Agreements be amended to add a clause which would permit
minor additions and changes subject to the approval of the
Director of Planning and the Director of Public Works.
Staff feel that these proposed amendments will allow the
Hotel owner some flexibility in making minor changes and
improvements to buildings and structures on the property.
Staff do not feel that the amendments will undermine the
overall intent or reduce the effectiveness of the Agreements
in controlling the development of the site.
