BACKGROUND:
On June 30th, 1982, staff received the attached letter from
Mr. Wayne Jeffery in respect of the above-referenced
subdivision. Said letter is fairly self-explanatory and is
requesting that the Town reconsider its requirements in
respect of fire protection for this subdivision.
In March of 1981 , the then Planning and Development
Committee considered staff Report P-43-81 , revised, in
respect of a policy for fire protection standards in estate
lot and rural residential developments. This Report was a
direct result of discussions and negotiations relative to
this subdivision plan and resulted in Council adoption of a
policy for fire protection standards in rural areas. A copy
• of these standards is attached for the Committee's
• information, as is staff Report P-43-81 , revised.
COMMENTS:
The subject plan of subdivision includes fourty-four (44)
single family lots and a 6040 square metre park site on a
12.15 hectare parcel of land located in the south-east
quadrant of Enniskillen. The draft plan approval for this
plan expires on January 25th, 1983, and among the conditions
of draft plan approval was the requirement that the proposed
subdivision be served by a municipal water system. As
outlined in staff Report P-43-81 , extensive discussions had
been held between Town staff, the applicant 's consultants
and Regional Works staff relative to the merits of a
municipal water system, including a fire protection
capability, and a simpler water supply system providing
domestic flows only. As a result of the staff
consideration, it was felt that a Regionally designed and j
operated system, which included a fire protection
capability, would be superior for fire fighting purposes,

and that it would be more efficient with potentially fewer '
supply difficulties and fewer direct costs to the Town of
Newcastle. In that regard, the Region of Durham was
requested to design a water supply system for the subject
subdivision and the Hamlet of Enniskillen in accordance with
the Regional policy for the design of small water systems,
incorporating a fire protection capability. This request
was subsequently concurred with by Regional Council on May
13th, 1981 . Following therefrom, the applicant had
proceeded with the design of the water system, culminating
in his request of June 30th, 1982 for reconsideration of our
requirements.
In accordance with the policy for fire protection in rural
residential development, a development of this nature could
proceed by one of two methods, depending upon the servicing.
As presently required by the Town, the development would
proceed on the basis of septic tanks and a municipal water
system, having a minimum flow of 2273 litres per minute,
with a residual pressure of 137 kilopascals. However, were
the development to proceed on the basis of a municipal water
system, supplying domestic flows only, a static reservoir
with a minimum capacity of 100000 litres would be required
for up to 75 units. It is this latter alternative which Mr.
Jeffery wishes us to consider. Staff note that this would
be in accordance with the Town's adopted policy, however, as
pointed out by staff Report P-43-81 , it is a potentially
less efficient alternative, and will certainly involve

future municipal expenditures relative to the maintenance of
such reservoir. It was for this reason that staff
previously recommended the more extensive system in
accordance with the Region of Durham Design Criteria.
However, in view of the applicant 's request and his
suggestion that the Town's present requirements will add

approximately $4,000 to the ultimate price of lots within
this subdivision, Council may wish to consider the request
submitted by Mr. Wayne Jeffery.
We would note at this point that discussions with Durham
Works Department staff indicate that they are willing to
recommend acceptance of such a system if the Town so
chooses. Therefore, should Council deem it appropriate to
permit Mr. Jeffery to proceed on the basis of the lesser
requirements contained within the Town's Fire Protection
Policy, then the Region of Durham should be so advised and
an appropriate direction provided to staff.

We have met all requirements for this subdivision to
proceed. We have also established all cost in the
developing of the property, Part of that cost was a
fire protection system that run in the neighborhood
of one hundred and eighty thousand ($180t000. 00) . This
would add a direct cost of over four thousand dollars
($4000.00) per lot to the customer. This extra cost
per lot is Just enough to stop any proceedings with the
development of this property.
In view of the above, we are simply asking that the
fire protection part of the central water system be
dropped so that the development can immediately proceed.

In order to provide a set of fire protection standards
by which rural residential and estate lot residential developments
may be v;ilu.:, � d, the Planning and Developnwnt Department, in con-
junction with the Dire Department, has prepared the attached policy
statement . 1ho proposed policy contains generalized standards for j
v.ttious lorms of rural and estate lot subdivision plans (listed according
to services) and hopefully will serve as a flexible guideline that sub-
dividers wil ! recognize in future development proposals and that will
aid 'Town !La! : in their review of those proposals, It is recommended

the Re),- ional Works Departmentt has requested the Town to reconfirm its
fire protection requirements .
Town staff (have discussed the fire protection requirements
with Mr. D. Itiddle , P. l:ng. on behalf of t);hkl.;uhd DuvelopmenLs Lid. and
With Regional Works staff . The relative merits of a municipal water
System including a fire protection capability (i.e. ; pressure system
with hydrants) supply versus a simpler domestic only water system were
discussed. Initially , Planning Staff and the Fire Chief felt that the
simpler systcm might have some advantages ; the system could be less ex-
pensive for the developer to install, and might be less expensive for
the Region to tlwraty, 16-vvvr, it is now felt that the Regionally
designed and operated system would be advantageous as the system is
superior for fire fighting purposes (i.e. ; more efficient with potentially
fewer supply di-ifiCUILUS) , and would involve fewer direct costs to the
Town of Newcastle .
