REPORT NO. : PD-158-82 SUBJECT: REQUEST BY PIONEER PETROLEUMS(CENTRAL) LTD. FOR AN EXEMPTION FROM THE PROVISIONS OF THE SIGN BY-LAW AND A SPECIAL RESOLUTION OF COUNCIL TO PERMIT THE USE OF THE COLOUR RED WITHIN 150 FEET OF AN INTERSECTION - GRANT AUTO SERVICE 114 LIBERTY STREET, BOWMANVILLE RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1• That Report PD-158-82 be received; and 2. (a) that the attached amendment to By-law 76-25, as amended, be approved to permit Pioneer Petroleums (Central ) Ltd. to erect a ground sign having a maximum sign area of 3.7 square metres (40 sq.ft. ) , and (b) that an exemption be granted by Special Resolution of Council to permit the use of the colour red within 150 feet of an intersection. ��o Report No: PD-158-82 . . .12 BACKGROUND: A request has been received for an exemption from the provisions of the Sign By-law to permit the erection of a ground sign in front of Grants Auto Service at the intersection of Liberty Street South, Ontario Street and Park Street in Bowmanville. The proposed ground sign as requested by Mr. Jas. B. Lowrey of Pioneer Petroleums (Central ) Ltd. would have an area of 3.3 sq. metres (36 sq.ft. ) . The Sign By-law would permit a ground sign of 2.8 sq.metres (30 sq.ft. ) or 0. 1% of the lot area, which- ever is greater and provided that in no case shall any sign exceed 100 sq.ft. in area. The colours used in the proposed sign will be red, white and blue and the Sign By-law prohibits illuminated signs using the colours red, green or amber within 150 feet of an intersection except by Special Resolution of Council . COMMENTS: In the past, exemptions have been granted for a maximum size of 40.0 sq.ft. this exemption would be in keeping with those granted to Pronto, King Street,East, Bowmanville and Petro Canada on Liberty Street, South, Bowmanville. So as to treat each request in a fair and consistent manner it would seem appropriate to approve the amendment up to a maximum fo 40 sq.ft. The use of the colour red is unlikely to create any confusion with the red of any traffic lights that maybe erected in the future. WHEREAS the Council of the Corporation of the Town of Newcastle i enacts as follows: 1. Section 11 of By-law 76-25, as amended, of the Corporation of the Town of Newcastle is hereby further amended by adding thereto the following "SPECIAL CONDITION 10": "SPECIAL CONDITION 10 9.1 Defined Area The lands subject to this "Special Condition" comprises Lot 5, Block 23, Grants Plan of the former Town of Bowmanville, situated on the north-west corner of Park Street and Liberty Street. 9.2 Permitted Signs In addition to the signs permitted by Section 8 of this By-law and notwithstanding any other provisions of this By-law to the contrary, a ground identification sign having a maximum sign area of 40 square feet, shall be permitted with- in the "Defined Area". 2. This By-law shall come into effect on the final passage hereof.
