(416)263-2231 i REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF SEPTEMBER 27, 1982 REPORT NO: PO-154-82 SUBJECT: REZONING APPLICATION Z-A-1 -13-5 - R. DAVIS BLOCK 10, PLAN M-746: APPLICATION TO AMEND THE SOLINA HAMLET DEVELOPMENT PLAN RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-154-82 be received; and * 2. That the attached By-law and amendment to the Solina Hamlet Development Plan be forwarded to Council for approval at such time as the Council of the Regional Municipality of Durham has considered the attached amendment to the Solina Hamlet Plan; and 3. That a copy of this Report, and the I attachments thereto, be forwarded to the Region of Durham for their information and consideration as soon as possible. i i ' , I Report No: PD-154-82 .. ./2 BACKGROUND: On the 19th day of July, 1982, Ralph Bruce Davis submitted an application to the Planning Department to amend the zoning applied to Block 10 of Plan M-746. Block 10 was a Block intended for future development. As such, the present zoning is "D-Development". Mr. Davis has requested a Special Provision Residential Zone to allow the development of Block 10 as two (2) separate residential building lots. Application has been made through the Region of Durham Land Division Committee for severance of Block 10. The severance application was granted on August 30, subject to rezoning, and subject to the approval of an amendment to the Hamlet Development Plan. Mr. Davis had also submitted, on or about the same date, a request for an amendment to the Solina Hamlet Development Plan to increase the maximum number of lots permissable in the north-west quadrant of the Hamlet from fourteen (14) to sixteen (16) . In accordance with our standard Departmental procedures , the application for rezoning and for the amendment to the Solina Development Plan was circulated to a number of affected departments and agencies for comments. The following is a summary of the comments received. Durham Regional Health Unit "This Health Unit has no objections to the above proposal ." Central Lake Ontario Conservation Authority i "The Authority has no objections to the approval of the above application. The Authority also has no objections to amending the District Plan of the Hamlet of Solina to increase by one, the number of allowable dwelling units in the north-west quadrant of the Hamlet." Report No: PD-154-82 .../3 Newcastle Fire Chief "The Fire Department has no objection to the application for rezoning to allow two additional residential lots. Further development within the Hamlet of Solina should require the installation of a water reservior for fire protection." Newcastle Public Works Department "We have reviewed the subject application and submit the following comments: 1 . That the applicant pay all costs involved in removing the one-foot reserve. 2. That a lot grading plan be submitted for approval of the Director of Public Works. 3. That the applicant be responsible for obtaining access permits in accordance with the Town 's entranceway policy. 4. That the District Plan for the Hamlet of Solina be increased by the number of allowable dwelling units permitted within the north-west quadrant." Region of Durham Planning Department "Further to your request for comments, we note that Section 10.4.1 .4 of the Durham Regional Official Plan stipulates that residential development in the form of minor internal infilling and minor additions to existing development may be permitted in Hamlets. Accordingly, the proposed rezoning application and amendment to the Solina Hamlet Plan to permit two additional residential lots appears to conform. However, as you are aware, the Durham Plan stipulates that Regional Council shall be consulted prior to the adoption of the amendment to the Hamlet Plan by your Council ." COMMENTS: As outlined above, our standard circulation has produced no major objections to the proposed rezoning and the related amendment to the Solina Hamlet Development Plan. i Report No: PD-154-82 . . ./4 In that regard, staff have prepared an amendment to the Restricted Area (Zoning) By-law, as well as an amendment to the Solina Development Plan. We would note, at this point , that in addition to the Hamlet Plan Amendment requested by Mr. Davis , staff are including the necessary amendment to give effect to Council 's recent decision in respect of the acquisition of parkland within Solina. These two changes together form Amendment No. 1 to the Hamlet Development Plan for Solina, which should be forwarded to Council for approval , along with the amendment to the Restricted Area Zoning By-law, at such time as the Hamlet Plan Amendment has been considered by Regional Council . With regard to the comments submitted by Newcastle Works Department , Planning staff are satisfied that concerns relative to removal of the one-foot reserve, lot grading plans and the amendment to the District Plan have been addressed, either in this Report or in the subdivision agreement presently applied to the lands in question. We note that the comment relative to obtaining access permits in accordance with the Town 's entranceway policy is standard procedure, and does not require a specific condition relative to this rezoning or Hamlet Plan amendment. Purpose of the Amendment The purpose of Amendment No. 1 to the Hamlet Development Plan for the Hamlet of Solina is to increase from fourteen (14) to sixteen (16) the maximum number of residential units permitted in Residential Expansion Area "B" ; and to delete Residential Expansion Area "A", and replace same with the Community Facility designation; and further, to delete the Community Facility designation adjacent to Residential Expansion Area "C" within the south-west quadrant, replacing that with the appropriate designation to permit residential infilling. 2. Basis of Amendment This amendment is based upon the decision of Council of the Town of Newcastle to permit the development of one additional residential unit within Residential Expansion Area "B" pursuant to Section 1 .7 of the approved Solina Hamlet Development Plan and to implement the decision of Council of the Town of Newcastle with respect to the development of Community Facilities within the Hamlet of Solina. 3. Actual Amendment Schedule "A" to the Hamlet Development Plan for the Hamlet of Solina is hereby deleted in its entirety and replaced with the new Schedule "A" attached hereto as Schedule "X" , which shows a maximum of sixteen (16) residential units permitted within Residential Expansion Area "B" ; changes Residential Expansion Area "A" to Community Facility; and changes the Community Facility designation within the south-west quadrant adjacent to Residential Expansion Area "C" to the appropriate designation to permit residential infilling. i I I I SCHEDULE Y 'TO AMENDMENT Nol TO THE SOLINA HAMLET DEVELOPMENT PLAN i 101 26 LOT 25 LOT 24 , I_,� RD A.�LOW E3TW CONC.'
