HomeMy WebLinkAboutPD-141-82 a�> 4 CORPORATION OF THE TOWN OF NEWCASTLE PLANNING AND DEVELOPMENT DEPARTMENT T.T.EDWARDS,M.C.I.P.,Director HAMPTON,ONTARIO LOB 1JO TEL.(416)263.2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF SEPTEMBER 13, 1982 REPORT NO. : PO-141-82 SUBJECT: STAGING POLICIES - COURTICE URBAN AREA OFFICIAL PLAN AMENDMENT 80-35/N/D RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-141-82 be received; and 2. That Council adopt the proposed draft * amendment, as revised, attached to this Report; and 3. That the Regional Municipality of Durham be requested to approve the subject amendment and forward same to the Ministry of Municipal Affairs and Housing for approval . BACKGROUND: Recently, staff became aware that the staging concept originally conceived for the urban areas is no longer appropriate in that, given the current economic slow-down, it is impractical to restrict development in areas where water and sewer services are already in the ground. i Report No: PD-141-82 . . ./2 As such, staff drafted an amendment to the Courtice Urban Area Plan which would replace the policies currently governing -the staging of growth in Courtice with a less structured approach. This draft amendment was presented to the General Purpose and Administration Committee on June 28th, 1982 in Report PD-102-82, at which time the Committee authorized staff to advertise the proposed draft amendment and -to circulate it to the Region of Durham for comment. A summary of the comments received as a result of the advertisement and the circulation is presented below: Region of Durham Planning Department "You may wish to modify Section 6.8.2(iv) as follows: "The development or redevelopment of land within the Courtice Major Urban Area shall be in accordance with the policies of Council with respect to storm water management." This would provide Council with greater flexibility in dealing with changing circumstances." Courtice Heights Developments Mr. William D. Manson, acting on behalf of Courtice Heights Developments, suggested the following modifications to the Official Plan Amendment. In Section 6.8.2(iii ) (a) , the word "first" should be inserted before "priority", so that the phrase reads "a first priority". The following should be added to Section 6.8.2(iii ) as subsection (d): "Notwithstanding any provisions to the contrary, the policies of this subsection 6.8.2(iii ) shall not apply to lands covered by plans of subdivision which have received draft approval prior to Council adoption of these policies." I Report No: PD-141-82 . ../3 In Section 6.8.2(iv) , it is suggested that the following be added as a second paragraph: "Notwithstanding the above, storm drainage systems that service subdivision plans which were draft approved prior to the adoption of this Plan, and which have been approved by the Central Lake Ontario Conservation Authority, shall be considered to be in conformity with this Plan." In the first paragraph of Section 6.8.2(iv), the words "be in accordance with recommendations" should be deleted and replaced with the words "recognize the findings and recommendations". * A copy of the letter received from Mr. Manson is attached to this Report. COMMENTS: With respect to the suggested modifications of Section 6.8.20ii )(a), staff feel it is inadvisable to assign a first priority to the development of the Community Central Area and the adjacent residential neighbourhood in that this would preclude the prior development of other neighbourhoods in Courtice should circumstances so require. Although the amendment stresses that the Central Area and adjacent neighbourhoods should be developed first if possible, it is nevertheless important that the staging policies be sufficiently flexible to accommodate changing circumstances when dealing with development proposals. Staff note that the addition of a subsection (d) to Section 6.8.2(iii ) and the second paragraph to Section 6.8.2(iv) , as suggested by Courtice Heights Developments, is unnecessary. I i i i Report No: PD-141-82 . . ./4 Section 6.1 .3(vii ) of the Courtice Urban Area Plan states that "nothing in this Plan shall be construed as preventing the development of subdivision plans having received draft approval prior to the adoption of this Plan . ." Therefore, lands covered by plans of subdivision which were draft approved prior to the passing of the Courtice Urban Area Plan and the C.L.O.C.A. approved drainage systems which service them, are already exempted from the provisions of Sections 6.8.2(iii ) and (iv) . However, it must be emphasized that those proposed developments which received draft plan approval after the adoption of the Courtice Plan will be bound by the requirements of the revised staging policies. Both the Durham Planning Department and Courtice Heights Developments suggested ,aodi fyi ng Section 6.t3.2_( i v) to release future developments from strict compliance with the recommendations of the Courtice Storm Water Management Study. Tnasouco is Council has not yet adopted a position with respect to the Storm Water Management Study, it would be sufficient and appropriate to recognize its findings and recommendations and Municipal policies arising from said study. Therefore, staff recommend that Section 6.8.2(iv) be amended by deleting the words "be in accordance with the recommendations" and inserting the words "have regard for the findings and recommendations of the Courtice Storm Water Management Study and shall be in accordance with the policies of Council with respect to storm water management". In this way, the policy acknowledges the Storm Water Management concept recommended by the Study, without fully commiting Council to a position on Storm Water Management in Courtice. i i i 04) Report No: PD-141-82 . . ./5 A draft amendment outlining the proposed changes to the Courtice Urban Area Plan, and which incorporates the * modification recommended above, is attached to this Report. (Manson WDM Consultants 20 Clematis Road WILLOVIDALE, Ontario M2J 4X2 i I i i Attachment 1 to Report PD-141-82 AMENDMENT TO THE OFFICIAL PLAN OF THE FORMER TOWNSHIP OF DARLINGTON, NOW PART OF THE TOWN OF NEWCASTLE Purpose of Amendment: The purpose of this amendment is to introduce detailed policies for staging urban development within the Courtice Major Urban Area. Basis of Amendment: This amendment to the Official Plan for the former Planning Area of the Township of Darlington is based upon a review of development proposals within the Courtice Major Urban Area and the need to ensure the orderly progression of that development. Location of Amendment: The area subject to this amendment is defined as the Courtice Major Urban Area as delineated by Schedule 1 to the Official Plan of the former Township of Darlington. Actual Amendment: The Official Plan of the former Township of Darlington is hereby further amended by: 1 . Deleting in their entirety, Sections 6.8.2 iii ) and 6.8.2 iv); and 2. Inserting the following Sectons 6.8.2 iii ) and 6.8.2 iv) : 6.8.2 iii ) a) The Council of the Town of Newcastle shall consider the development of the Courtice Community Central Area and Residential Neighbourhoods adjacent to the Community Central Area as a priority in the development of the Courtice Major Urban Area. This shall be accomplished through such means as the approval of development proposals, the provision of public works and the provision of community facilities. i Page 2 of Attachment 1 to Report PD-141-82 b) Town Council may monitor the rate of residential development to ensure that such development is both in keeping with the financial and administrative capabilities of the Town and is within the Town's capability to provide and maintain the required services. c) The timing and phasing of development within the various neighbourhoods will be determined through the consideration of plans of subdivision and the negotiation of development agreements and will be based on the logical use and extension of services reinforcing the Community Central Area and other applicable policies of the Official Plan. 6.8.2 iv) Council shall require that the development or redevelopment of land within the Courtice Major Urban Area have regard for the findings and recommendations of the Courtice Storm Water Management Study and shall be in accordance with the policies of Council with respect -to storm water management. i i I i I I i i I
