That Report PD-136-82 be received; and 2. That the Newcastle Village Small Urban Area Official Plan be modified to remove from the Main Central Area designation those lands formerly occupied by the Roman Catholic Church and which are the subject of rezoning application Z-A-3-11-8 submitted by J. Rothenbush and which are identified on the * Schedules attached to this Report. 3. And that the Regional Muni,cipal.ity of Durham be so advised. ! BACKGROUND: i As outlined in Report PD-101-82, on May 11th, 1982, the Newcastle Planning Department received an application to rezone the lands formerly occupied by the Newcastle Village Roman Catholic Church. The General Purpose and Administration Committee had, on June 14th, endorsed the recommendations contained in Report PD-101-82, and on the 5th day of July the accompanying amending By-law was passed by Council as By-law 82-85. ° ttt s�4t I l Report No: PD-136-82 , , ,/2 COMMENT: i In accordance with the usual procedures which follow the passing of a By-law amendment, the Regional Planning Commissioner was requested to provide a schedule containing a Statement of Conformity with the Regional Plan. As * indicated in his letter of July 26th, 1982, a copy of which is attached, he is not in a position to issue the conformity schedule at this time. He has, however, suggested that Council may expedite the approval of the By-law by deleting the subject lands from the Main Central Area designation. Upon reviewing Dr. Michael 's letter of July 26th, Newcastle Planning staff believe that the simplest course of action would be to take Dr. Michael 's suggestion and to modify the Village Official Plan. In this regard, the appropriate * schedules to the Village Plan are attached to this Report. The proposed modification is indicated in red. Staff are recommending that this modification be approved and that the Region be advised of the Town's actions as soon as possible. Res ect submitted, T. T. Edwards, M.C.I.P. Town of Newcastle Commissioner of Planning j Further to your request for a statement of conformity, I regret to inform you that I am not in a position to issue .a Schedule 3 for By-law 82-85 at this time. The property to be rezoned is included within the Main Central Area designation in the Newcastle Village Small Urban Area Official Plan which was adopted by your Council on March 29, 1982. Since statements of conformity can only be issued with respect to Ministerially approved official plan, the disposition of the zoning amendment would have to await Regional Council and Ministerial approval of the Newcastle Village Official Plan. However, if your Council wishes to expedite the approval of the by-law, the Newcastle Village Official Plan could be amended to delete the subject property from the Main Central Area designation and the proposal would conform since a Central Area is the only designation in the Durham Plan which requires further detailing within a district Plan. If this course of action were followed, we would require a letter from you requesting an appropriate modification to the Newcastle Village Official Plan. As an alternative, you may wish to ,make application to the Ontario Municipal Board for approval of the by-law. In the event of approval of the Newcastle Village Official Plan by Regional Council , I would be prepared to recommend to the Board that the By-law be approved.
