(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF JULY 26, 1982 REPORT NO. : PD-132-82 SUBJECT: GENERAL AMENDMENT TO BY-LAW 76-25, OF THE CORPORATION OF THE TOWN OF NEWCASTLE - SIGN BY-LAW RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-132-82 be received; and 2. That the attached general amendment to By-law 76-25, as amended, be forwarded to Council for approval . BACKGROUND: A request has been made to the Town for an exemption from the provisions of the Sign By-law of the Town of Newcastle to permit the erection of a ground sign in front of the British Bulldog Restauarant and Tavern located on the north side of Highway Number 2, Darlington. The proposed ground identification sign would be permitted pursuant to the zoning for the subject lands. r- Report No: PD-132-82 .. ./2 However, at the present time, Section 4(6)(a) of the Sign By-law requires that a ground sign is to be located 10.0 feet from the front property line. The intended location of the sign for the British Bulldog would encroach within this restricted area, thereby causing a non-conforming situation within the provisions of the By-law. COMMENTS: Staff have reviewed the request from the British Bulldog Restaurant and would have no objection to the approval of an exemption from Section 4(6)(a) of the By-law. In addition, staff note that there have been several problems with Section 4(6) (a) of the By-law relating to the setback from street lines. Therefore, in order to avoid further conflicts, and, to eliminate the need for additional amendments to the By-law for this purpose, staff are suggesting the deletion of all references related to the 10.0 foot setback requirement of the By-law. The deletion of this By-law provision would allow the erection of a ground sign within any area of the front of a property provided the sign does not encroach upon abutting properties or any road allowance. Staff note that Section 4(6) (a) was originally intended to accommodate road widenings without necessitating sign relocation, however, with the amendment of Section 4(6)(b) by amending By-law 82-16, this provision became redundant. WHEREAS the Council of the Corporation of the Town of Newcastle deems i it advisable to amend By-law 76-25, as amended, of the Corporation of the Town of Newcastle. NOW, THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 4 of By-law 76-25, as amended, of the Corporation of the Town of Newcastle is hereby further amended by deleting subsection (6)(a) in its entirety, and by adding the following subsection (6)(a): I "(a) SETBACK FROM STREET LINE No sign, other than a wall sign or a window sign, shall be - located within a sight triangle or encroach upon any road - allowance or abutting lot." - I 2. Section 4 of By-law 76-25, as amended, of the Corporation of j the Town of Newcastle is hereby further amended by deleting from subection (6)(b) the following: then the said distance of 10 feet shall be measured from the new street line and". 3.
