THE CORPORATION OF THE CITY OF OSHAWA RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-129-82 be received; and 2. That By-law 80-82 of the City of Oshawa be I received and filed. I BACKGROUND: By-law Number 80-82 of the City of Oshawa was forwarded to the Planning Department on July 9, 1982. The subject By-law rezones a parcel of land located on the north-west corner of King Street East and Townline Road North. The proposed By-law amendment would change the zoning of this site from C-1 Special Condition "89" to C-1 Special Condition "120" in order to permit the expansion of the Kingsway Village Shopping Centre. r �� I r o Report No: PD-129-82 . . ./2 * We note that Report PD-89-82, a copy of which is attached, had recommended approval of Official Plan amendment 82-9/D/00 allowing the expansion of this shopping centre, and was further adopted by Council on June 7, 1982. In that regard, staff would have no objection to the approval of By-law 80-82 to allow the zone change for the proposed expansion, thus implementing the Official Plan amendment. (416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF MAY 31st, 1982 REPORT NO. : PD-89-82 SUBJECT: APPLICATION SUBMITTED BY 244987 MANAGEMENT LIMITED TO AMEND THE DURHAM REGION OFFICIAL PLAN - FILE NO. 82-9/D/00 - KINGSWAY VILLAGE , PHASE II, OSHAWA RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-89-82 be received; and 2. That the Region of Durham be advised that the Town of Newcastle has no objection to the proposed Official Plan Amendment 82-9/D/00 which would permit the construction of a junior department store as an extension to the existing Kingsway Village Shopping Plaza at Townline Road and Highway 2 in Oshawa. BACKGROUND: On March 12th, 1982, the Newcastle Planning Department received a copy of an application to amend the Durham Region Official Plan. The applicant is seeking this amendment in order to permit the expansion of the Kingsway Village Shopping Centre, located at Townline Road and Highway 2 in Oshawa. ftoport No: 1'1) 80 1 . . . ./2 The proposed expansion would consist of a department store with a gross floor area of 94,500 square feet. Because the area affected by this application is outside of the Town of Newcastle, the application has not been circulated to other Departments for comment. Planning staff have, however, reviewed the proposed amendment in light of a Market Demand and Impact Analysis Study prepared for the applicants and in light of the possible impact that this development could have on the designated community central area at Trull 's Road and Highway 2 in Courtice. COMMENTS: The Market Demand and Impact Analysis Study prepared by Larry Smith & Associates Ltd. for the applicant has concluded that a Junior department store of approximately 95,000 square feet of gross leasable area can be constructed without any critical impact on the existing department stores in the Oshawa area. In addition, their analysis of future department store needs within the East Oshawa trade area reveals that the development of a discount department store at this site would fulfill the short term needs of its residents, and would only capture a portion of the total additional demand in trade area over the period covered by their analysis. j The Consultants have also concluded that, based on the increase in additional department store potential in future years, the development of a Junior department store as part of the second phase of Kingsway Village Shopping Centre will not reduce the long-term potential of the already designated community central area at Trull 's Road in the Courtice Urban Area. I i I Report No: PD-89-82 . . . ./3 Staff are generally in agreement with the conclusions presented in the Market Study and believe that an amendment to the Regional Plan to recognize the immediate needs of residents in the east end of Oshawa and the residents of Newcastle bordering Oshawa, would not offend the intent of either the Durham Regional Official Plan or the Courtice Urban Area Plan. In addition, the expansion of an established commercial facility is preferable to waiting on the future development of a site which does not yet have sanitary sewers available and which will not likely proceed until such time as substantial housing has been developed and the necessary population base expanded. In fact, it is likely that the initial development Of COUrtice will be encouraged and enhanced by the additional commercial facilities proposed for the Kingsway Village Centre. Staff have, therefore, recommended that the Region of Durham be advised that the Town of Newcastle has no objection to the proposed Official Plan Amendment. Resp9ctf' ,4k submitted, T. T. Sheet Number 7 of Appendix "A" to By-law Number 3415, as I amended, is hereby further amended by changing the land use designation for a parcel of land, located at the northwest corner of King Street East and Townline Road North, having approximately I 303 metres frontage on King Street East and approximately 244 ; metres frontage on Townline Road North shown hatched and marked i with the figures "120" encircled from C-1 subject to Special Condition "89" to C-1 subject to Special Condition "120" so that Sheet Number 7 shall be amended as shown on the revised Sheet Number 7 attached hereto as Schedule "A" . j 3. The lands made subject to Special Condition 120 are hereby declared to be a site plan control area within the meaning _ of subsection ( 2) of Section 40 of The Planning Act, R.S.O. 1980, I c.379, aq amended. "Total Floor Area" means the total of the area Of all floor levels in the building, including any basement, cellar or mezzanine and area covered by interior walls and partitions, but excluding the roof area, exterior perimeter walls, areas occupied by stairwells or elevators, and covered mall areas not used as i retail sales floor area. 1 Permitted Uses: / j The land subject to Special Condition "120" shall not . I I be used for any purpose except one or more of the 4 following uses: (a) shopping centre 1.4 Permitted Buildings: i i 1.4.1 The following buildings shall be permitted on ! the land subject to Special Condition "120". Buildings having a maximum total floor area of not more than 17094 square metres made up partially of the following floor areas: r f (a) The maximum total floor area of the department store shall not exceed 10640 square metres of which not more than 8720 square metres shall be devoted to retail sales and personal service uses and the balance shall only be used for mezzanine, I ' storage and accessory uses. _ I (b) The maximum total floor area of the I ` supermarket shall not exceed 4050 square i metres of which not more than 3780 square I i metres shall be devoted to retail sales and i personal service uses and the balance shall only be used for mezzanine, storage and accessory uses. I i (c) The maximum total floor area of retail I stores and personal service shops exclusive of the department store and the supermarket i ` shall not exceed 2404 square metres of which not more than 2360 square metres shall be i I devoted to retail sales and personal service uses and the balance shall only be used for mezzanine, storage and accessory uses. 1 .5 Off-Street Parking: C I I A minimum of 782 parking spaces shall be provided on the land subject to Special Condition "120". € j I 1.6 Parking Space and Driving Aisle Dimensions: !! i • I The dimensions of all parking spaces and driveway aisles on the land subject to Special Condition "120" shall be i in accordance with the following tahle: i Minimum width of aisle 7.20 m i Minimum width of parking space • 2.70 m I Minimum length of parking space 5.75 m I i I i I i F i I EXPLANATORY NOTE 1 i EXPLANATION OF THE PURPOSE AND EFFECT OF BY-LAW NUMBER 80-82 I ! I I By-law Number 80-82 changes the land use designation for a parcel i of land, located at the northwest corner of King Street East and Townline Road North having approximately 303 metres of frontaqe on King Street East from C-1 subject to Special Condition 118911 to C-1 subject to Special Condition 11120" in order to permit the expansion of the existing shopping centre. I The expanded shopping centre shall have a maximum of 14,860 square metres (159,957 square feet) of gross retail and personal service floor area. f I 3 f i I I I
