(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF JULY 26, 1982 REPORT NO. : PD-128-82 SUBJECT: PROPOSED AMENDMENT NO. 77 TO THE OFFICIAL PLAN OF THE REGIONAL MUNICIPALITY OF DURHAM PLANNING AREA RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: i 1 . That Report PD-128-82 be received; and 2. That the Ministry of Municipal Affairs and Housing be advised that the Town of Newcastle has no objections to the amendment of the Region of Durham Official Plan incorporating a policy permitting hotels/commercial uses in industrial areas abutting Highway 401 , and subject to Official Plan Amendment application number 77. BACKGROUND: On September 24th, 1980, an application was submitted to amend both the Durham Regional Official Plan and the Town of Pickering District Plan (Town Centre Community Plan) to permit a hotel and associated commercial uses to be located on a 2.19 ha (5.4 acres) parcel of land at the north-east corner of the Brock Road/Highway 401 interchange in Pickering. s, Report No: PD-128-82 . . ./2 The subject site is presently designated as "Industrial " in the Regional Official Plan and "Restricted Light Industrial " in the Pickering District Plan (Town Centre Community Plan) . The applicant requested that the subject lands be designated "Special Purpose Commercial " in both plans, in i addition to the existing "Industrial" designations. The Council of the Town of the Town of Pickering, at its meeting of April 19th, 1982, passed a Resolution recommending to Regional Council that the subject site be redesignated from "Industrial" in the Regional Official Plan and "Restricted Light Industrial " in the Pickering District Plan (Town Centre Community Plan) to an appropriate land use designation that would permit hotels/commercial uses in addition to industrial uses on the lands. On June 9th, 1982, Regional Council adopted the following amendment: "The Durham Regional Official Plan is hereby amended by adding a new Section, 8.4.2.7 as follows: "8.4.2.7 Notwithstanding any other provision in this Plan to the contrary, hotels and associated commercial uses may be permitted within the respective Urban Areas in designated Industrial Areas which are abutting Highway No. 401 or abutting a service road provided such service road abuts Highway No. 401 subject to the inclusion of appropriate provisions in the respective District Plan and/or the respective restricted area (zoning) by-law, subject to the following: I i ) consideration has been given to the policies and intent of this Plan related to the Main Central Areas; i I I Report No: PD-128-82 . . ./3 ii ) development agreements have been entered into with the authorities having jurisdiction; iii ) the development is desirable and compatible with the surrounding, existing and proposed land uses in the area and does not unduly y restrict or conflict with the predominant permitted uses in Industrial Area designations; iv) the development will not create undue traffic problems."" This amendment was subsequently forwarded to the Ministry of Municipal Affairs and Housing for approval . On July 8th, 1982, the Town of Newcastle received a request from the Ministry for comment on the amendment. It is as a result of this request that Town staff is bringing this Report forward for Council 's consideration. COMMENTS: In the context of the Town of Newcastle, the location of a hotel and associated commercial uses in industrial areas abutting Highway No. 401 may draw business away from the Bowmanville Main Central Area. However, under the provisions of the proposed Official Plan amendment, such uses would not be permitted unless appropriate provisions are made by the Town in the respective District Plan (Urban Area Plan) . In the case of the Bowmanville Urban Area Plan, these provisions have not been included. However, sufficient lands have been designated Special Purpose Commercial in the vicinity of Highway 401 and adjacent Industrial Areas, to accommodate such uses should they be proposed. Similarly, the Newcastle Village Urban Area Plan would require amendment should such development be proposed j i I i i Report No: PD-128-82 . . ./4 for that area. In view of the foregoing staff, therefore, recommend that Council advise the Ministry of Municipal Affairs and Housing that they have no objection to the proposed amendment to the Durham Regional Official Plan respecting hotel and commercial uses in industrial areas along Highway No. 401 .
