COOMBES LICENSED PIT PART LOT 6, CONCESSION 4, FORMER TOWNSHIP OF DARLINGTON RECOMMENDATION: I It is respectfully recommended that the General Purpose and j Administration Committee recommend to Council the following: I 1 . That Report PD-120-82 be received for information; and I 2. That Mr. Coombes be advised that he should make formal application to the Ministry of Natural Resources for an increase in his annual tonnage limit; and 3. That Mr. Coombes be further advised that the Town will comment on his application at such time as it has been circulated by the Ministry of Natural Resources. I i i Report, No: PD-120-82 . . ./2 BACKGROUND AND COMMENTS: On June 21 , 1982, the Town of Newcastle received a letter from Mr. J. L. Coombes of Bowmanville, seeking the Town's consent for an increase in his licensed tonnage limit from 15,000 tonnes annually to 30,000 tonnes annually. The applicant's pit, indicated as License Number 93 in Schedule 1 to Section 4 of the Durham Regional Official Plan, occupies 10.4 ha (25.65 acres) and is located in Lot 6, Concession 4, in the former Township of Darlington. The subject site is zoned A-Agricultural by Restricted Area By-law 2111 , of the former Township of Darlington, gravel pits are a permitted use within that zone. The Pits and Quarries Control Act (R.S.O. 1980) requires that the site plan accompanying an application for a license for more than 15,000 tonnes annually be in long form. Section 4(3) of the Act, however, permits the site plan for an application respecting a pit or quarry producing less than that amount to be in short form. Mr. Coombes' present license is a short form license approved and issued pursuant to Section 4(3) . Therefore, in order to increase his licensed tonnage limit to above 15,000 tonnes, Mr. Coombes is required to make application and submit new site plans in long form. Once the site plans have been prepared and submitted to the Ministry of Natural Resources by Mr. Coombes, they are j circulated to the Town of Newcastle for review and comment. The Town responds directly to the applicant and advises the Ministry of Natural Resources by copy of the letter. The i applicant is then required to submit this letter to the Ministry. i ✓� l Report No: PD-120-82 . . ./3 In the event the Town has any objections to the application, the Ministry of Natural Resources will not approve it until the Town's concerns have been satisfied and the applicant can submit to the Ministry a letter from the Town to that effect. Section 5 of The Pits and Quarries Control Act permits written objections to a license application to be submitted. However, Section 5 does not apply in this case as the property is currently under a pit license. Since Mr. Coombes has not yet made formal application to the Ministry of Natural Resources for an increase in his annual tonnage limit, the Town has not yet had an opportunity to review the proper Plans. It is recommended that Mr. Coombes be advised that the Town will comment on his application when the proper plans have been circulated by the Ministry of Natural Resources. Resp fy submitted, . T.
