(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF JULY 12, 1982 REPORT NO. : PD-119-82 SUBJECT: APPLICATION FOR REZONING Z-A-3-2-6 PART OF LOT 16, CONCESSION 1 , FORMER TOWNSHIP OF CLARKE - TONY BONNANO RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-119-82 be received; and 2. That Application for Rezoning Z-A-3-2-6 affecting part of Lot 16, Concession 1 , be approved; and * 3. That the attached By-law Number 82- q be forwarded to Council for approval . i I BACKGROUND: The subject application requests an amendment to Restricted Area (Zoning) By-law 1592 of the former Township of Clarke to rezone a 3.20 hectare (7.9 acres) parcel of land located on the south-east corner of King' s Highway No. 2 and the road allowance between Lots 16 and 17. i Report No: PD-119-82 . . ./2 The applicant has requested that the subject lands be rezoned in order to permit the re-opening of an existing garden centre and to permit the sale of items accessory to a garden centre. The site is designated "Major Open Space" by the Region of Durham Official Plan. A nursery and garden centre is permitted under this landuse designation. The site is zoned "A-Agriculture" by Restricted Area (Zoning) By-law 1592 of the former Township of Clarke. The proposed By-law amendment will apply a "Special Provision" to the Agricultural zone classification in order to allow a garden centre with the sale of accessory items. In accordance with Departmental procedures, the subject application has been circulated to various departments and agencies for comment. The following comments were received:- Durham Planning Department "The subject site is designated "Major Open Space" in the Durham Regional Official Plan. We note that there is a garden centre presently on the site which we consider to be accessory to the nursery garden operation which is a permitted use. A proposal to sell products such as fertilizer, seed, house plants, garden accessories, and garden furniture associated with a garden centre, in addition to the items grown on site, is construed to be in conformity with the Durham Plan." Ministry of Agriculture and Food "This general area appears to be 6N on the Canada Land Inventory Map. In addition, it has been a garden centre and is a wet, poor area of soil ." I i Report No: PD-119-82 . . ./3 Newcastle Public Works Department "no objection" i Ministry of Transportation and Communications "no objection" Durham Regional Health Unit "no objection" COMMENT: In reviewing the comments received we note that there were no problems in respect of this proposal . Re-opening of this nursery and garden centre would be in conformity with the Official Plan. In terms of landuse computability, we note that the majority of land in this area is farmland or bushland. This business should not have a detrimental affect on abutting properties. Staff are therefore recommending approval of this application for rezoning. However, the applicant should be made aware that a site plan agreement with the Town of Newcastle will be required should a future expansion be necessary. Respectfulj submitted, F T. T. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area (Zoning) By-law 1592, as amended, of the former Township of Clarke. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: i 1. Schedule "A", Map 2 to By-law 1592, as amended, is hereby I further amended by changing to A-9 the zone designation of the lands indicated as "ZONE CHANGE TO A-9" on the attached Schedule 'T' i hereto. 2. Section 10.3 of By-law 1592, as amended, is hereby further amended by adding thereto the following subsection (h): "(h) A-9 Part Lot 16, Concession 1 Notwithstanding any provision of this By-law to the contrary, that part of Lot 16, Concession 1, which is i designated "A-9" on the attached Schedule "A" hereto shall f be used only in accordance with the provisions of this subsection, except that in the event that this subsection is silent on any matter, then the provisions applicable to an "A" Zone shall apply. 1) Permitted Uses (a) one single family dwelling and buildings and structures accessory thereto. (b) a commercial nursery and garden centre which shall include the growing and selling of plant stock and the sale of accessory garden supplies." 1 I I i i 1 - 2 - i f� I' j i I 3.
