SUBJECT: BY-LAW NUMBER 72-82:
THE CORPORATION OF THE CITY OF OSHAWA
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-110-82 be received; and
2. That By-law 72-82 of the City of Oshawa be
received and filed.
BACKGROUND AND COMMENTS:
By-law Number 72-82 of the City of Oshawa was forwarded to
the Planning Department on June 15, 1982. The subject
By-law rezones a parcel of land located on the south-east
corner of Ritson Road North and Ormond Drive. The proposed
By-law amendment would change the zoning of this site from
"R-16" and "BR" to "Special Condition 119" in order to
implement a draft plan of subdivision for the development of
non-profit co-operative housing in the form of group
dwellings (Townhouses) .

The subject lands are located within an area of Oshawa which
would not have an effect on the Town of Newcastle, and
therefore, no further action on this By-law amend-ment is
required. However, we note that the last date for filing
objections is July 2, 1982.

CORPORATION OF THE CITY OF OSHAWA FOR APPROVAL OF --
REGULATE LAND USE PASSED PURSUANT TO SECTION 39 OF THE PLANNING
ACT
TAKE NOTICE that the Council of The Corporation of the City of Oshawa intends to
apply to The Ontario Municipal Board pursuant to the provisions of Section 39 of
The Planning Act for approval of By-law Nunber 72-82 passed on the 7th day of
June 1982. A copy of the by-law is furnished herewith. A note qiving an
explanation of the purpose and effect of the by-law and stating the lands affected
thereby is also furnished herewith.
ANY PERSON INTERESTED MAY within twenty-one (21) days after the date of this
notice, send by registered mail or deliver to the Clerk of the City of Oshawa
notice of objection to approval of the said by-law or part thereof giving details
of all or the portion of the by-law to which you object and detailed reasons
therefor, and shall indicate that if a hearing is held the objector or an agent
will attend at the hearing to support the objection.

ANY PERSON wishing to support the aF � _ication for approval of the by-law may

within twenty-one (21) days after the e_ate of this notice send by registered mail
or deliver to the Clerk of the City of ::shawa notice of his support of approval of
the said by-law together with a request for notice of any hearing that may be held
giving the name and address to which such notice should be given.

THE CNTARIO MUNICIPAL BOARD may approve of the said by-law but before doing so it
may appoint a time and place when any objection to the by-law will be considered.
Notice of any hearing that may be held will be given only to persons who have
filed an objection or notice of support and who have left with or delivered to the
Clerk undersigned, the address to which notice of hearing is to be sent and
similarly, to any person who has filed a request for a change in the provisions of
the by-law.

THE CORPORATION OF 'THE CITY OF OSHAWA

being a by-law to further amend By-law Number 3415 of the City of
Oshawa.
BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law
of The Corporation of the City of Oshawa by the Council thereof as
follows:
1. By-law Number 3415 be and the same is hereby further
amended by amending Schedule "A" thereof by adding Special
Condition 119 as set out in Schedule "B" of this by-law.
2. Sheet Number 3 of Appendix "A" to By-law Number 3415, as
amended, is hereby further amended by changing the land use
designation for a parcel of land located on the southeast corner
of Ritson Road North and Ormond Drive, approximately 120 metres
north) of Taunton Road East, and having a frontage of approximately

270 metres on Ormond Drive shown hatched and marked with the
figures "119" encircled on Schedule "A" attached hereto from R-1B
and BR to make the lands subject only to the provisions of Special
Condition "119" so that Sheet Number 3 shall be amended as shown
on the revised Sheet Number 3 a -.-. -.ached hereto as Schedule "A" .
3. The lands made subjec;. to Special Condition Number "119"
are hereby declared to be a sita plan control area within the
meaning of subsection 2 of Section 40 of The Planning Act R.S.O.
1980 c. 379 , as amended .
4. The. Plan attached hereto as Schedule "C" shall form
Appendix "A" to Special Condition "119" .
5. Schedules "A" , "B" and "C" attached hereto form part of
this by-law.

6 . Paragraph 3 of this by-law shall take effect from the
date of passing of this by-law. No other part of this by-law
shall come into force without the approval of the Ontario
Municipal Board but subject thereto this by-law shall take effect
from the date of its passing.

SPECIAL CONDITION 119
, The parcel of land located at the southeast corner of Ritson
Road North and Ormond Drive, as shown on Schedule "A" to this
by-law hatched and marked with the figures "119" encircled
shall be subject only to the special provisions and
definitions hereinafter c(�ntained .

1 . Definitions
I '
For the purpose of interpreting the provisions set forth
in this by-law, the following definitions shall apply:
1.1 "Landscaped Open Space" means open unobstructed
space on a lot which is suitable for the growth
and maintenance of grass , flowers , shrubs and
other landscaping and notwithstanding the
foregoing includes any surfaced walk, patio,
tennis court or similar recreational area and any
pond , swimming or decorative pool , but does not
include any parking space, aisle, driveway or any
loading area.
1 . 2 The Definitions contained in Section 1 of By-law
55-73 and in Section 2 of By-law 3415 as amended
shall apply to the regulations hereinafter set
out.

2. Permitted Uses :
2. 1 One or more group dwellings and a recreational and
accessory building shall be * permitted on the lands
subject to this Special Condition.
I3. Residential Density:
3 .1 Not more than eighty ( 80) dwelling units shall be
permitted on the lands subject to this Special
Condition.
i4 . Lot Coverage:
4 .1 Not more ore than s0$ of the total area of the lands
subject to thi: Special Condition shall be covered
with buildings .
5. Building Area:
5. 1 No building sh<:11 be permitted on the lands
subject to this Special Condition except within
the area shown hatched and indicated as "Building
Area" on Appendix "A" to this Special Condition.
6 . Height:
6 .1 No building or structure erected on any part of
the lands subject to this Special Condition shall
exceed 10. 5 metres in heiqht .
7 . Landscaped Open Space:
7.1 Not less than 50% of the lands which are subject
to this Special . Condition shall be used for any
purpose except landscaped open space.

8. Off-Street Parking :
8 .1 A minimum of 107 parkinq spaces shall be provided
on the lands subject to this Special Condition of
which 27 spaces shall be used only for parking for
visitors.

EXPLANATION OF THE PURPOSE A40 EFFECT OF BY-LAW NUMBER 72-82
By-law Number 72-82 changes the land use designation for a parcel
of land located at the southeast corner of Ritson Road North and
Ormond Drive, from R-1B and BR to make those lands subject only to
the provisions of Special Condition 11119" to implement a draft
plan of subdivision for the development of a non-profit
co-operative housing development consisting of a maximum of eighty
(80 ), dwelling units in the form of group dwellings (Townhouses ) .
