(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF JUNE 28, 1982 REPORT NO. : PD-105-82 SUBJECT: PROPOSED AMENDMENTS TO BY-LAW 1587 OF THE FORMER TOWN OF BOWMANVILLE AND BY-LAW 1592 OF THE FORMER TOWNSHIP OF CLARKE RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-105-82 be received; and 2. That the attached By-laws 82- (t ( and 82- f be forwarded to Council for approval ; and 3. That upon approval of the attached By-law 82- Ei j and 82- U;.v the Clerk be directed to provide notice through publication. I BACKGROUND AND COMMENTS: Proposed Amendment to By-law 1587, former Town of Bowmanville By-law 1587 of the former Town of Bowmanville contains a general residential zone that applies to most of the built-up area of the former Town of Bowmanville. aryl Report No: PD-105-82 . . ./3 whereas the maps identify only Provincial Highways, County Roads and other roads. This inconsistency has made interpretation of the By-law difficult, again resulting in numerous applications for minor variances. Staff are therefore recommending that the reference to "all other roads" in the textual part of the By-law be deleted and that the set-back related to Township Roads be reduced to reflect what we believe is the intended set back requirement to be applied to Town or Township Roads. As with the recently approved amendments to the Darlington By-law, the amendments to the Bowmanville and Clarke By-laws * attached to this Report are an attempt to solve some of the more pressing interpretive problems with our Zoning By-laws. Staff again wish to point out that we do not intend to make significant changes at this point. We will be presenting a comprehensive By-law for the Town later this year which is intended to address the much broader range of problems associated with administering four different restricted area by-laws. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area By-law Number 1592, as amended, of the former Township of Clarke. E f NOW, THEREFORE, the Council of the Corporation of the Town of Newcastle ENACTS as follows: 1. Appendix 1 of By-law 1592, as amended, is hereby amended by changing subsection 1(g) entitled "Setback: in A and RR Zones" the minimum distance from the centre line of a Township Road to 25.3 metres, and by deleting from this subsection the words "all other roads", and, "83 feet". 2. Appendix 1 of By-law 1592, as amended, is hereby further amended by changing subsection 1(g) entitled "Setback: in Rl and other zones", the minimum distance from the centre line of a Township Road to 16.2 metres, and by deleting from this subsection the words all other roads", and, "53 feet". i 4 i f 3. Appendix 2 of By-law 1592, as amended, is hereby amended by deleting from subsection (g) entitled "Setback:", the words "all other roads", and, "58 feet", in the first paragraph, and, delete the words "all other roads", and, "83 feet", in the second paragraph. 4. Map 1 and 2 of Schedule "A" to By-law 1592, as amended, is hereby amended by deleting from the legend the words "other roads", and by replacing them with the words "Township Roads". j 4 � i i - 2 - 5. OAKES, CLERK It I II i I I � I f !I i {I f I i I ' I I THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 82- 92 j I being a By-law to amend Restricted Area By-law Number 1587, as amended, of the former Town of Bowmanville. 4 M WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area By-law Number 1587, as amended, of the former Town of Bowmanville. II NOW, THEREFORE, the Council of the Corporation of the Town of Newcastle ENACTS as follows: i 1. Section 9 of By-law 1587, as amended, is hereby further amended by deleting Subsection 9(f)(2) and 9(f)(3) in their entirety and replacing them with the following: III "9(f)(2) Side Yard requirement for one family detached dwellings Minimum Side Yard 1.25 metres except as provided in paragraphs (i) and (ii) of this j clause:- (i) On an interior lot where no attached garage or attached carport is provided, the minimum side yard on one side shall be 4.5 metres. (ii) On a corner lot, the minimum side yard abutting a public street shall be 6 metres. Side Yard requirements for two family dwellings Minimum Side Yard 1.8 metres except as provided in I paragraphs (i),(ii) and (iii) of this clause. (i) An attached garage or attached carport with no rooms above may be erected at a distance of not less than 1 .25 metres from a side lot line which does not abut a public street. (ii) On an interior lot where no attached garage or ! attached carport is provided, the minimum side yard on one side shall be 3.5 metres. (iii) On a corner lot the minimum side yard abutting a i public street shall be 7.6 metres. 9(f)(3) Rear Yard Requirement 10.5 metres" f I 2. Section 9 of By-law 1587, as amended, is hereby further amended by adding a new subsection, 9(1), as follows: Regulations for Accessory Buildings (a) Minimum Yard Requirements:- (i) Except as provided in paragraph (ii) of this clause, no accessory building shall be located within 1.25 metres of any side or rear lot line. (ii ) Notwithstanding the provision of paragraph (i) i hereof, the minimum yard abutting a public street shall be 6.0 metres. (b) Maximum Lot Coverage - 5% provided that lot coverage of all buildings on the lot does not exceed the maximum lot coverage set out in subsection (e) above." I i i I _7 2 3.
