(416)263-2231 i I� REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF JUNE 28, 1982 i REPORT NO. : PD-102-82 SUBJECT: STAGING POLICIES - COURTICE URBAN AREA OFFICIAL PLAN AMENDMENT FILE NO: 80-35/N/D RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-94-82 be received; and 2. That staff be authorized to advertise the proposed draft amendment attached to this Report; and 3. That the Regional Municipality of Durham be i requested to provide any comments they may have on the proposed draft amendment. I i BACKGROUND: * Report P-128-80, a copy of which is attached to this Report, outlined the development of draft staging policies for the Courtice Urban Area. Report No: PD-102-82 . . ./2 The draft amendment which was attached to Report P-128-80, was forwarded to the Region of Durham for their approval at that time. However, processing of the Town's request was delayed pending revisions to certain related sections of the Durham Regional Official Plan. On January 18th, 1982, the Town Planning Department received a letter from Regional Planning Commissioner, Dr. M. Michael , suggesting that the slow growth economy which we are experiencing makes it impractical to restrict development in areas where water and sewer services are already in the ground. He indicated, in this regard, that he had reviewed the proposed amendment to the Darlington Official Plan with respect to the staging of development within the Courtice Major Urban Area and he concluded that it could, potentially, lead to a more confusing situation with respect to the implementation of development. He was, therefore, requesting the Town to consider this matter further with a view to deleting the proposed staging policies. Staff have been aware, through the preparation of the recently modified Bowmanville Urban Area Official Plan, that the staging concept originally conceived for the Urban Areas is, perhaps, outdated in today's economic situation. As such, the staging policies which were incorporated into the Bowmanville Urban Area Official Plan represent a less structured approach to staging growth within the Urban Area. Staff therefore, have drafted an amendment which would incorporate policies very similar to those contained in the Bowmanville Urban Area Official Plan. Report No: PD-102-82 . . ./3 The policies contained within the Qowmanville Urban Area Official Plan have been reviewed by Regional Planning staff and are considered to be in conformity with the intent of the Regional Plan. A draft amendment outlining the proposed changes to the * Courtice Urban Area Plan is attached to this Report. Staff are requesting authorization to place advertisements relative to this draft amendment, pursuant to established procedures for processing Official Plan amendments. Respectfully' submitted, T. T. Director of Planning FA*TTE*mjc May 17,-,' 1982 Attachment 1 to Report PD-102-82 AMENDMENT TO THE OFFICIAL PLAN OF THE FORMER TOWNSHIP OF DARLINGTON, NOW PART OF THE TOWN OF NEWCASTLE Purpose of Amendment: The purpose of this amendment is to introduce detailed policies for staging urban development within the Courtice Major Urban Area. Basis of Amendment: This amendment to the Official Plan for the former Planning Area of the Township of Darlington is based upon a review of development proposals within the Courtice Major Urban Area and the need to ensure the orderly progression of that development. Location of Amendment: The area subject to this amendment is defined as the Courtice Major Urban Area as delineated by Schedule 1 to the Official Plan of the former Township of Darlington. Actual Amendment: The Official Plan of the former Township of Darlington is hereby further amended by: 1 . Deleting in their entirety, Sections 6.8.2 iii ) and 6.8.2. iv); and 2. Inserting the following Sections 6.8.2 iii ) and 6.8.2 iv): 6.8.2 iii ) a) The Council of the Town of Newcastle shall consider the development of the Courtice Community Central Area and Residential Neighbourhoods adjacent to the Community Central Area as a priority in the development of the Courtice Major Urban Area. This shall be accomplished through such means as the approval of development proposals, the provision of public works and the provision of community facilities. b) Town Council may monitor the rate of residential development to ensure that such development is both in keeping with the financial and administrative capabilities of the Town and is within the Town's capability to provide and maintain the required services. 1 2 c) The timing and phasing of development within the various neighbourhoods will be determined through the consideration of plans of subdivision and the negotiation of development agreements and will be based on the logical use and extension of services reinforcing the Community Central Area and other applicable policies of the Official Plan. 6.8.2 iv) Council shall require that the development or redevelopment of land within the Courtice Major Urban Area be in accordance with the recommendations contained in the Courtice Storm Water Management Study. ianikyr� tall Eod CORPORATION OF THE TOWN OF NEWCASTLE PLANNING AND DEVELOPMENT DEPARTMENT D.N. REPORT NO. : P-128--80 SUBJECT: Staging Policies - Courtice Urban Area BACKGROUND: On May 1.2, 1980 staff forwarded Report P-89-80 to the Planning and Development Committee requesting "authorization to convene a meeting with major property owners from the Courtice Urban Area, in order to dis- cuss the proposed staging policies as contained in attachment 2 to staff report P-89--80" . Planning and Development Committee and Council concurred with the recommendation within staff report P-89-80 (June 5 , 1980) . Staff convened a meeting on July 14 , 1980 having invited repres- entatives from those development interests with active subdivision pro- . posals in Courtice Neighbourhoods la , lb, 2b, and 3a. Representatives of Coldfan Holdings Ltd. , Remlark holdings Ltd. and Durcourt Investments Ltd. attended the meeting. Representatives from Courtice Heights Ltd. did not attend. I COP55 NT: Staff presented a further draft of the "staging policies" to those attending the ,above mentioned meeting. Staff note. the policies attached , will form a further amendment to the Darling Lon Official Plan in accordance with Section 6 .8. 2 (iii) of that document. The policies will require Council to annually review the Municipality 's conunitments in the Courtice Urban Area and to review the rate of residential and non-residential development. Council would i then set an "annual limit" to the amount of development that could be "finally approved'.' within that particular calendar year. Staff envisage a system whereby staff would reconunend an "annual limit" in Courtice during the annual budget preparations. Me "annual limit" would then be allocated over neighbourhoods la, lb, 2a, 2b, and 3a in Courtice as a first priority. Development in the remaining neighbourhoods would be considered a second priority except in situations where development would further the development of the Community Central At-ea . Staff believe that the revised policies are reasonable in that they provide the Town witlj the flexibility to review development proposals in Courtice wi t.11 regard to Lite Towtl's financial capability to accommodate further growth. The policies also provide the Town with the ability to;- limit development in areas of Courtice that may not be of prune si};niCicance to the development of the Courtice Community Central Area. Staff: feel, therefore , that Lhe attached policies should be adopted by the Town and forwarded to Lite Region of Durham for incorporation into the Darlington Township Official flan as an official Plan Amendment. RECOMMI.NDATION: It 1.9 reconuuended that thu Planning and Development Committee recommend to Council that: 1. The attached staging policies for development in Courtice subject of this report (P-128-80) be adopted as Town Policy and that the Clerk prepare the necessary by-law for that purpose, and 2. That the attached staging policies for development in Courtice subject of this report P-128-80 be forwarded to the Regional Municipality of Durham, and 3. That the Regional Municipality of Durham be requested to amend the Official Plan for the former Township of Darlington to in- corporate the said policies In accordance with Section 6. 8.2 (iii) of the Darlington Township Official Plan as amended. Town Council shall annually review the rate of residential and non-residential development in the Courtice Major Urban Area with specific regard to its commitments and the potential fin- ancial implications of further development. a) Town Council may consider the approval of draft plans of subOvision in the Courtice Major Urban Area at any time , subject to the policies of the municipality , Amendment 12 to the Darlington Township Ufffria [ Plan and the other policies of this amendment, and may set an "annual limit" on' the amount of development that may proceed to final approval . b) 'Town Council shall promote the development oW neighbourhoods la, lb, 2a, 2b, and 3a as a firs-Cc priority , and shall, if an "annual limit" is i set as described in a) above, allocate a portion Of the "annual limit" to each neighbourhood men- tioned. The portion of the "annual limit" to be allocated to each Wghhourhood shall be determined on the � basis of the proportion of the neighbourhood pop- ulatLon to the total population of the neighbourhoods i ax,,utiunk-d above , less the population of any draft approved plans within those neighbour- hoods . Iii those instances where more than one plan of subdivision has received draft approval within a neighbourhood, then the maximum allow- able number of units for that neighbourhood shall be allocated to those plans on the basis of the proportion of the population generated by a sib- division to the overall neighbourhood population. c) Town Council shall consider development within neighbourhoods 2c, 3b and 3c as a second priority, except where development will further the develop- ment of the Community Central Area. Town Council shall have regard for such matters as the following in considering development proposals in neighbourhoods 2c, 3b and 3c: . i) The type of development proposal, e .g. I commercial, residential, institutional , etc. ii) The relationship of the proposal to the CON munl.ty Central Area. iii) The cost to chejown and the Region of Durham of providing municipal services , i .e . , roads, piped services and community facilities. i I
