(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF JUNE 14, 1982 REPORT NO. : PD-100-82 SUBJECT: BY-LAW NUMBER 63-82: THE CORPORATION OF THE CITY OF OSHAWA RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-99-82 be received; and 2. That By-law Number 63-82 of the City of Oshawa be received and filed. BACKGROUND AND COMMENTS: By-law Number 63-82 of the City of Oshawa was forwarded to the Planning Department on May 28, 1982. The subject By-law rezones a parcel of land located on the north-west corner of Harmony Road North and Rossland Road East. The proposed By-law amendment would change the zoning of the northerly portion of this site from "R3-Special Condition 83" to "BR" , thereby restricting the uses in this area to those uses of a rural nature. The southern portion of the subject lands would be rezoned from "R3-Special Condition 83" to "Special Condition 117" in order to implement a draft plan of subdivision, and, the development of non-profit co-operative housing in the form of group dwellings. p :u Report No: PD-100-82 . . ./2 The subject lands are located within an area of Oshawa which would not have an effect on the Town of Newcastle, therefore, no further action on this By-law amendment is required. THE ONTARIO MUNICIPA Y THE CORPORATION OF THE CITY OF OSHAWA FOR APPROVAL OF A BY-LAW TO REGULATE LAND USE PASSED PURSUANT TO SECTION 39 OF THE PLANNING ACT , TAKE NOTICE that the Council of The Corporation of the City of Oshawa intends to apply to The Ontario Municipal Board pursuant to the provisions of Section 39 of The Planning Act for approval of By-law Number 63-82 passed. on the 25th day of May 1982. A copy of the by-law is furnished herewith. A note giving an explanation of the purpose and effect of the by-law and stating the lands affected thereby is also furnished herewith. _ ANY PERSON INTERESTED MAY- within twenty-one (21) days after the date of this notice, send by registered mail or deliver to the Clerk of the City of Oshawa notice of objection to approval of the said by-law or part thereof giving details of all or the portion of the by-law to which you object and detailed reasons therefor, and shall indicate that if a hearing is held the objector or an agent will attend at the hearing to support the objection. ANY PERSON wishing to support the application for approval of the by-law may within twenty-one (21) days after the date of this notice send by registered mail or deliver to the Clerk of the City of Oshawa notice of his support of approval of the said by-law together with a request for notice of any hearing that may be held giving the name and address to which such notice should be given. THE CNTARIO MUNICIPAL BOARD may approve of the said by-law but before doing so it may appoint a time and place when any objection to the by-law will be considered. Notice of any hearing that may be held will be given only to persons who have filed an objection or notice of support and who have left with or delivered to-the Clerk undersigned, the address to which notice of hearing is to be sent and _ similarly, to any person who has filed a request for a change in the provisions of the by-law. BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law. of The Corporation of the City of Oshawa by the Council thereof as follows: 1. By-law Number 3415 be and the same is hereby further amended by adding to Schedule "A" thereof Special Condition 117 as set out in Schedule "B" to this by-law. 2. Sheet Number 3 of Appendix "A" to By-law Number 3415, as amended, is hereby further amended by changing the land use designation for a parcel of land, located at the northwest corner of Harmony Road North and Rossland Road East, having approximately 191 metres frontage on Rossland Road East and a depth of approximately 372 metres on Harmony Road North , from R-3 subject to Special Condition "83" to make part of the lands subject only to the provisions of Special Condition "117" and chanqing the land use designation of the remainder of the lands from R-3 subject to Special Condition "83" to BR so that Sheet Number 3 shall be amended as shown on the revised Sheet Number 3 attached hereto as Schedule "A" . 3. The land described in paragraph 2 above and made subject to Special Condition 117 is hereby declared to be a site plan control area within the meaning of subsection--2 of Section 40 of the Planning Act R.S.O. 1980 C.379, as amended. 4. The Plan attached hereto as Schedule "C" shall form Appendix "A" to Special Condition 117. 5. Schedules "A" "B" and "C" attached hereto shall form part of this by-law. Definitions For the purpose of interpreting the provisions set forth in this by-law,. the followinq definition shall apply: 1.1 "Landscaped Open Space" means open unobstructed space on a lot which is suitable for the growth and maintenance of grass, flowers, shrubs and other landscaping and notwithstanding the foregoing includes any surfaced walk, patio, tennis court or similar recreational area and any pond , swimming or decorative pool, but does not include .any parking space, aisle, driveway or any loading area. i 1.2 The Definitions contained in Section 1 of By-law 55-73 and in Section 2 of By-law 3415 as amended shall apply to the regulations hereinafter set out. PAGE TWO OF SCHEDULE "B" �`q/ 2• 2. Permitted Uses i 2.1 One or more group dwellings shall be permitted on i the lands subject to this Special Condition. I - I 3. Density. 3.1 Not more than 80 dwelling units shall be permitted on the lands subject to this Special Condition. 4. Lot Coverage. I 4.1 Not more than 30% of the total area of the lands subject to this Special Condition shall be covered with buildings. 5. Building Area. 5 .1 No building shall be permitted on the lands subject to this Special Condition except within the area shown hatched and indicated as "Building Area" on Appendix "A" to this Special Condition. 6. Height. 6.1 No building or structure erected on any part of the lands subject to this Special Condition shall exceed 10.5 metres in height. 7. Landscaped Open Space. 7.1 Not less than 50% of the lands which are subject to this Special Condition shall be used for any purpose except- landscaped open space. - i PAGE THREE OF SCHEDULE "B" 8. NOTE ALL DIMENSION ARE IN METRES ;I )H .t . i EXPLANATORY NOTE EXPLANATION OF THE PURPOSE AND EFFECT OF BY-LAW NUMBER 63-82 By-law Number 63-82 changes the land use designation for a parcel of land at the northwest corner of Harmony Road North and Rossland Road East to change the designation for the north part of the lands from R-3 subject to Special Condition 83 to BR which restricts uses to essentially rural uses as the form of development to take place on these lands in the future is uncertain, and which further changes the land use designation for the south part of the lands from R-3 subject to Special Condition 83 to make those lands subject only to the provisions of Special Condition 11117" to implement a draft plan of subdivision for the development of a non-profit co-operative housing development consisting of a maximum of eighty (80) dwelling units in the form of group dwellings.
