SUBJECT: AMENDMENT NO. 2 TO THE HAYDON HAMLET
DEVELOPMENT PLAN - MR. C. SKERRATT

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-99-83 be received; and
2. That Amendment No. 2 to the Haydon Hamlet
* Development Plan attached to this Report , be
approved in accordance with Resolution #
GPA-393-83.
BACKGROUND:
On February 8th, 1983, the Town of Newcastle Planning
Department received an application from Mr. C. Skerratt to
amend the Haydon Hamlet Development Plan to permit the
creation of additional building lots on Mr. Skerratt's
property on the west side of Maple Street.

Mr. Skerratt owns 9.1 hectares (22.5 acres) of land, most of
which lies outside the boundaries of Haydon, including that
portion which fronts on Maple Street. Maple Street is only
maintained by the Town of Newcastle for a distance of
approximately 120 metres (395 feet) past the Hamlet limits
on the west side of Maple Street. Therefore, staff
determined that the boundaries of the Hamlet would need to
be extended in order to create additional building lots , but
could only be extended to the end of the maintained portion
of Maple Street.
The Haydon Hamlet Development Plan currently establishes a

minimum lot area of 0.5 hectares (1 .23 acres) for new lots.
This lot area was established because of the presence of a
seasonally high water table in portions of the Hamlet and
soils with poor to fair permeability and percolative
capacity. However, the area subject to the amendment
application is much higher than the rest of the Hamlet, and
therefore may possess better drainage characteristics.
Staff determined it may be possible for new lots on this
high land to be smaller than the minimum size currently
prescribed by the Hamlet Development Plan. Accordingly,
staff drafted an amendment to the Haydon Hamlet Development
Plan which would permit a reduction in the minimum lot area
requirement, where warranted, and would expand the limits of
the Hamlet area to permit minor residential expansion on the
subject property. A copy of the proposed amendment is
attached to this Report for Council 's consideration.
The standard circulation of the proposed amendment produced
no major objections.

On May 2nd, 1983, the General Purpose and Administration
Committee considered Staff Report PD-70-83. The Report
recommended that the proposed amendment to the Hamlet Plan
be forwarded to Council for approval at such time as the
Council of the Regional Municipality of Durham has
considered the amendment, and that Mr. Skerratt be required
to immediately erect an information sign advising of the
amendment application on the subject property. The
Committee endorsed the Report 's recommendation with
Resolution # GPA-393-83.
COMMENTS:
In a letter dated May 3rd, 1983, the Town of Newcastle was
advised that Regional Council considered the amendment to
the Haydon Hamlet Development Plan on April 27th, 1983, and
had no comment.
Therefore, staff are now recommending that Amendment No. 2
to the Haydon Hamlet Development Plan be now forwarded to
Council for approval in accordance with the prior
Resolution.
Staff note that the subject property is currently zoned
"A-Agricultural " by By-law 2111 of the former Township of
Darlington. Therefore, the property will require a rezoning
prior to any severance applications being considered.

AMENDMENT NO. 2 TO THE HAMLET DEVELOPMENT PLAN FOR THE
HAMLET OF HAYDON
1 . Purpose of Amendment
The purpose of Amendment No. 2 to the Hamlet Development
Plan for the Hamlet of Haydon is to expand the limits of
the Hamlet area to permit minor residential expansion
and to reduce the minimum lot area requirement where
warranted.
2. Basis of Amendment

This amendment is based upon a proposal for the
creation of additional building lots on an existing
street frontage currently outside the limits of the
Hamlet of Haydon as defined by the Hamlet Development
Plan.
3. Actual Amendment
Schedule "1 " to the Hamlet Development Plan for the
Hamlet of Haydon is hereby amended by extending the
limits of the Hamlet Development Plan as indicated on
the attached Schedule "X" hereto, and by designating the
lands affected by said expansion as "Residential
Infilling, Three (3) Lots" as also indicated on the
attached Schedule "X" hereto.
The Hamlet Development Plan for the Hamlet of Haydon is
hereby amended by:
1 . Deleting in its entirety, Section 4.2; and
2. Inserting the following Section 4.2:
"4.2 Notwithstanding any provision of this plan to
the contrary, an application for development by
registered plan of subdivsion or by consent shall be
accompanied by a detailed engineering report based
on test drilling which confirms:
(i ) Soil conditions satisfactory for the effective
operation of a private waste disposal system;
and
(ii ) No adverse effects upon existing water supplies
and an adequate supply of potable water to
service the proposed development ; and
(iii )An adequate separation between water table and
septic tile fields.

If, after conducting the above investigation , evidence
satisfactory to the Town of Newcastle and the Durham
Reek on Health knit has been produced which indicates
that a reduction in the minimum lot area requirement is
warranted, Council may approve such a reduction only so
far as the minimum lot size is not reduced to below 0.3
hectares. Upon receiving such approval , the applicant
may submit a proposal based upon this reduction to the
maximum number of lots which would be permitted by this
reduction, but not to exceed the number of lots
permitted within a designated area. An amendment to the
Hamlet Development Plan shall be required in order to
adjust the maximum number of lots permitted."
