REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF JUNE 6, 1983

SUBJECT: APPLICATION FOR REZONING - PART OF LOT 32,
CONCESSION 7, FORMER TOWNSHIP OF CLARKE
DENIS AND VELLA PRUE, FILE: DEV 81 -21
(Formerly Z-A-3-6-9)
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-87-83 be received; and
* 2. That the attached by-law amending By-law 1592,
as amended, of the former Township of Clarke,
be approved.
BACKGROUND:
On December 7th, 1981 , the General Purpose and
Administration Committee considered Staff Report PD-184-81
in respect of an application for rezoning submitted by Denis
and Vella Prue. Upon considering said Staff Report, the
General Purpose and Administration Committee passed
Resolution GPA 199-81 , as follows :

"That the recommendation in Report PD-184-81 be
endorsed, and
1 . That Report PD-184-81 be received; and
2. Application for rezoning Z-A-3-6-9, Part of Lot 32,
Concession 7, former Township of Clarke, Denis and
Vella Prue, be approved; and
3. That the attached by-law be forwarded to Council
for approval at such time as the applicants have
fulfilled the following requirements :
i ) submission of an Engineering Report from a
Certified Engineer, indicating that the
existing dwelling is in conformity with the
Ontario Building Code and approved structurally
as a residence.
ii ) if the existing dwelling is not in conformity
with the Ontario Building Code, then the
applicants must ensure that alterations are
undertaken to bring the structure into
conformity with the Code.
iii ) the existing driveway culvert and minor
ditching be brought into conformity with the
present Town of Newcastle standards design
criteria and approved by the Director of Public
Works.
iv) approval of a permit by the Durham Regional
Health Unit, indicating that the existing well
and septic system is satisfactory and in
compliance with Health Unit standards."
COMMENTS:
On May 25th, 1983 Mr. Denis Prue submitted the attached
letter, signed and stamped by Mr. A. J. Kamicheril , a
Professional Engineer in the Province of Ontario. This
letter indicated that he had inspected the subject house,
and recommended and reviewed changes and reinforcing.

He is satisfied that the house now conforms with the
requirements of Ontario Regulation 925/75 under the Building
Code Act. Receipt of this letter therefore satisfies
requirements 3 i ) and 3 ii ) of Resolution GPA 199/81.
Similarly on February 10th, 1983, staff received the
* attached letter from Mr. A. C. Wong, Public Health
Inspector, Durham Regional Health Unit. This letter
indicates that they are unable to certify compliance with
the Health Regulations , but that there is sufficient land
area available for some type of replacement sewage disposal
system and that a permit for such a system would be issued
if required in the future. This letter also indicated that
water samples obtained in February of this year indicated a
potable water supply.
Staff also note that on May 17th, 1983, Mr. Prue applied for
a property access in accordance with the Town 's standards,
thus satisfying Condition 3 iii ) .
In view of the fact that the applicant has now satisfied
Council 's conditions for rezoning, it would now be
appropriate to approve the attached by-law.

Dear Mr. Edwards:
In response to your letter, of February 7, 1983, please be advised
that a Certificate of Approval to install a septic system was issued in 1974
and due to the lack of the owner's responsibility to notify us for a final
inspection, this department was never in a position to certify it's compliance.
However, to comply with your request, this department has conducted
an inspection of the premise and is able to confirm the following conditions :
1 . There is sufficient land area available for some type of replacement
private sewage disposal system.
2. A permit for some type of tile or filter bed sewage system would
possibly be issued if required in future.
3. A water sample obtained on February 2, 1983, resulted in a potable
water count (<2/0) .

BY-LAW NUMBER 63-85
f being a By-law to amend Restricted Area ]ly-law 1592, as amended, of
the former Township of Clarke, now in the Town of Newcastle.
I
WHEREAS the Council of the Corporation of the Town of Newcastle deems
i it advisable to amend Restricted Area (Zoning) By-law 1592, as
amended, of the former Township of Clarke.
i
NOW, THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:

1 , Section 5.3 of By-law 1592, as amended, is hereby further
amended by adding thereto the following subsection (e):
"(e) Leskard Road - RR-5

Notwithstanding any provisions of this by-law to the contrary, that
parcel of land designated RR-5 on the attached Schedule "A" hereto
shall be used only in accordance with the following provisions.
i) Permitted Uses
one (1 ) single family detached dwelling and buildings and
1 structures accessory thereto
ii) Zone Provisions
! a) lot area (minimum) 0.4 hectares
b) lot frontage (minimum) 45.0 metres
c) front yard (minimum) 55.0 metres
d) side yard (minimum) 7.5 metres
a e) rear yard (minimum) 10.5 metres
f) gross floor area (minmum) 111 .5 square metres

g building height (maximum) 10.5 metres
2. Schedule "A" to By-law No. 1592, as amended, is hereby further
„I amended by changing to RR-5 the zone designation of the lands
designated "Zone Change to RR-5" on the attached Schedule "X"
hereto.

3. This by-law shall come into effect on the date hereof, subject
to the provisions of Section 35(10) of the Planning Act.
