KLOSE, PART LOT 25, CONCESSION 5, CLARKE FILE: 83-4/D RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-86-83 be received; and 2. That the Region of Durham be advised that the Town of Newcastle has no objection to Official Plan amendment application 83-4/D, submitted by Mr. W. Klose, to redesignate a 4 hectare parcel of land in Part Lot 25, Concession 5, former Township of Clarke, from "Permanent Agricultural Reserve" to "Major Open Space" to permit the operation of an exotic cat sanctuary; and 3. That a copy of Staff Report PD-86-83 and Council 's Resolution be forwarded to the Region of Durham and the applicant. �q6r ' L, 6V �1N` Report No: PD-86-83 .../2 BACKGROUND: On February 15th, 1983, the Region of Durham advised the Town of Newcastle that it had received an application to amend the Durham Region Official Plan. The application, submitted by Mr. W. Klose, requested the redesignation of a 4 hectare (10 acre) parcel of land in Part Lot 25, Concession 5, Clarke, from Permanent Agricultural Reserve to Major Open Space to permit the operation of an exotic cat sanctuary. The subject parcel is currently occupied by the Havelberg Dog Academy, which includes commercial kennels and commercial dog training arena, an exercise run and a pet cemetery, as well as a single family dwelling. The proposed sanctuary would be operated in addition to the present uses. The cat sanctuary is not considered a permitted use in the Permanent Agricultural Reserve. The Durham Region Official Plan permits an area municipality to rezone a parcel to permit the expansion of an existing use that does not conform to the designations and provisions of the Official Plan. However, the Region of Durham does not consider the establishment of the exotic cat sanctuary as an expansion to the existing use. Therefore, an Official Plan Amendment is required to permit the establishment of the cat sanctuary. In accordance with Departmental procedures, the application was circulated to the appropriate Town Departments for comments. As well , the Region of Durham provided copies of comments they received as a result of their circulation of the proposed amendment. The following is a summary of the comments received. i Report No: PO-86-83 .. ./3 Town of Newcastle Public Works Department "No objection" Town of Newcastle Fire Department "No objection" Durham Regional Health Unit "No objection" Ministry of Natural Resources "No comment" Ministry of Agriculture and Food "No comment" COMMENTS: Staff note that the proposed exotic cat sanctuary would be operated as a commercial operation. Although the sanctuary cannot be considered as an expansion to the existing commercial kennel operation, the establishment of a commercial cat sanctuary would be compatible with the existing uses, as well as with the other commercial uses along Highway 35/115. Staff also note that there were no concerns raised as a result of the circulation of the Official Plan Amendment application. It is therefore recommended that the Region be advised that the Town of Newcastle has no objections to this amendment. The subject parcel is zoned "A-Agricultural " in By-law 1592 I of the former Township of Clarke.
