SUBJECT: APPLICATION TO AMEND DURHAM REGION OFFICIAL
PLAN - G. HARTEMINK,
PART LOT 34, CONCESSION 1 , CLARKE -

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-85-83 be received ; and
2. That the Region of Durham be advised that the
Town of Newcastle has no objection to Official
Plan Amendment Application 83-7/D, submitted by
G. Hartemink, to redesignate a 0.4 hectare
parcel of land in Part Lot 34, Concession 1 ,
former Township of Clarke, from "Permanent
Agricultural Reserve" to "General Agricultural
Area" ; and
3. That the Region of Durham be further advised
that the Town of Newcastle recommends that the
parcel of land in Part Lots 34 and 35,
Concession 1 , former Township of Clarke ,
bounded by Highway 2, Highway 35/115, and the
Townline Road between the former Townships of
Darlington and Clarke, be redesignated from
"Permanent Agricultural Reserve" to "General
Agricultural Area" ; and

4. That the Region of Durham be further advised
that the Town of Newcastle will specify the
extent of a "Residential Cluster" in By-law
1592, as amended, of the Former Township of
Clarke at such time as the applicant has
submitted an application to rezone the subject
property; and
5. That a copy of Staff Report PD-85-83 and
Council 's Resolution be forwarded to the Region
of Durham and the applicant .
BACKGROUND: j
On March 21st , 1983, the Region of Durham notified the Town
of Newcastle that it had received an application to amend
the Durham Region Official Plan. The application , submitted
by Mr. G. Hartemink, proposed the redesignation of a 0.4
hectare (1 acre) portion of a 1 .54 hectare (3.81 acre)
* parcel of land in Part Lot 34, Concession 1 , Clarke (see key
map) from "Permanent Agricultural Reserve" to "General
Agricultural Area" .
The Durham Region Official Plan states that the "use of land
within a designated Permanent Agricultural Reserve Area for
any purpose other than agriculture and farm-related uses
shall not be permitted. " However, agriculture and
farm-related uses are given as the predominant use of land
in the General Agricultural Area. Because the applicant
wishes to sever the 0.4 hectare parcel in order to create a
new residential lot, he has requested the General
Agricultural designation for the parcel to permit the
Regional Land Division Committee to consider a severance
application.

In accordance with Departmental policy, the subject
application was circulated to the appropriate Town
Departments for comment. As well , the Region provided
copies of the comments they received through their
circulation of the application . The following is a summary
of the comments received:
Town of Newcastle Public Works Department
"No objection"
Durham Regional Health Unit
"Due to the location of the existing dug well and pond on
the retained portion , there is sufficient land available on
the subject property to accommodate a Class VI (aerobic
sewage) System. The Class VI System must be registered on
the Deed."
Ministry of Agriculture and Food
"No comment"
COMMENTS:
Staff note that no significant concerns were raised as a
result of the circulation of the Official Plan Amendment
application. Staff also note that the applicant ' s property
is bounded on the north, west and south by existing roads ,
and that the proposed lot would be located between the
applicant 's existing residence and another non-farm related
residence to the east. Staff therefore have no objection to
the redesignation of the subject parcel to General
Agricultural Area to permit the consideration of the
severance application, and recommend that the Region of
Durham be so advised.
However, the Durham Region Official Plan states that,
although non-farm related residential dwellings are
permitted in the General Agricultural Area, they are only
allowed in the form of infilling within a distinct node or
cluster of non-farm residential dwellings. As well , such a
node or cluster is required to be identified in the
respective zoning by-law. Therefore, the redesignation of
the 0.4 hectare parcel cannot be considered in isolation .

Staff note that there are a number of existing non-farm
related residences directly to the north of the applicant' s
property. It is therefore recommended that the triangle of
land bounded by Highway 2, Highway 35/115 and the Townline
Road between the former Townships of Darlington and Clarke
be redesignated from Permanent Agricultural Reserve to
General Agricultural Area (see key map) .
The applicant 's property is zoned "A-Agricultural " by By-law
1592 of the former Township of Clarke. The minimum lot area
for new residential lots in this zone is forty (40) acres ;
the minimum lot area for new lots in the "RR-Rural
Residential " zone is one (1 ) acre. Therefore, the applicant
will also require a rezoning to Rural Residential before a
severance can be granted. However, staff recommend that the
Town not specify the extent of the residential cluster in
By-law 1592 until a rezoning application has been submitted.
