REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF JUNE 6, 1983

SUBJECT: APPLICATION TO AMEND THE HAMLET DEVELOPMENT
PLAN FOR THE HAMLET OF ENNISKILLEN
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-81-83 be received; and
* 2. That the attached amendment to the Hamlet
Development Plan for the Hamlet of Enniskillen
be forwarded to Council for approval at such
time as the Council of the Region of Durham has
considered the amendment to the Enniskillen
Hamlet Development Plan; and
3. That a copy of this Report and the attachments
thereto be fowarded to the Region of Durham for
their information and consideration as soon as
possible; and
4. That the applicants, 1927 Investments Ltd. and
Oakland Developments Ltd. , be requested to
immediately post public information signs on
their respective properties in accordance with
Town policy for local Official Plan amendments,
and that said policy be revised to include
amendments to Hamlet Development Plans.

BACKGROUND:
On February 14, 1983, Council considered Report Number
PD-17-83 pertaining to the proposed Plan of Subdivision
(18T-81013) by 1927 Investments Ltd. affecting Part of Lot
19, Concession 8, Darlington (Hamlet of Enniskillen). The
subject Report had been referred back to staff for further
consideration. The recommendation which was contained
within the Report was denial of the subdivision application
due to the lack of a municipal water system being available
for the Hamlet of Enniskillen. The provision of a municipal
water system is a requirement which is included within the
Hamlet Development Plan for Enniskillen, and further, is
stipulated as a pre-requisite for residential development.
As Council is aware, there have been several discussions
regarding the installation of such a service, by both the
Region of Durham and the developer involved with the planned
residential development within the Hamlet (1927 Investments
Ltd. and Oakland Developments Ltd) . However, due to the
high cost involved in providing such a water system, it
would appear that no one party is willing to absorb such a
cost at this time, and as a result, residential development
has been delayed. Therefore, 1927 Investments and Oakland
Developments have requested the Town to consider an
amendment to the Hamlet Development Plan for the Hamlet of
Enniskillen, whereby the requirement of a municipal water
system is deleted from the Plan , to allow residential

development to proceed on the basis of private wells and
septic systems.

COMMENTS:

Staff have reviewed the request to amend the Hamlet
Development Plan for the Hamlet of Enniskillen and note that
in order to accommodate such a request there will be several
policy changes required in order to avoid future problems
with existing and proposed development within this Hamlet.
With the deletion of the policies relating to the provision
of a municipal water system for residential development ,
staff note that increases in the lot area requirement would
be required in some areas in order to reduce the maximum
number of lots permitted.
The area of most concern within the Hamlet of Enniskillen at
this time is the area in which Oakland Developments (Jeffrey
Subdivision) has a proposed forty-four (44) lot plan of
subdivision, which is designated as the first area for
development within Enniskillen. The revised minimum lot
area for this subdivision has been increased to 0.4 hectares
(1 .0 acre) with a maximum of twenty-two (22) residential
lots allowed for this quadrant. This minimum lot area of
0.4 hectares (1 .0 acre) will be the same throughout the
development plan in areas specified as "Areas Proposed for
Expansion" and where such developments are to be served by
individual wells. (The section dealing with servicing of
development has been revised. These changes are necessary
to ensure sufficient supply of potable groundwater is
available to existing and future residents since large
amounts of residential development which would proceed on
the basis of private wells have the potential to draw down
existing supplies for this Hamlet.) In that regard, staff
feel that the change in lot size and the addition of a
requirement for servicing studies prior to final approval

would allow the municipality to monitor the groundwater
supply available for development and to prevent problems

from occuring with existing development. In addition , staff
note that should the subject amendments be approved, the
existing subdivision within the residential expansion area
which has received draft approvals will require the
necessary redesign in order to bring the proposed
development into conformity with -the Hamlet Plan. This
aspect has been discussed with Jefferys Construction and
they have agreed to it.
Planning staff would therefore have no objection to the
approval of the subject amendment to the Hamlet Development
Plan for the Hamlet of Enniskillen which would ultimately
allow residential development to proceed within this area on
the basis of private services.
Staff note, that in order to obtain public input in respect
of this amendment prior to Council consideration , that the
applicants should be required to post public information
signs in accordance with present Town policy for Local
Official Plan amendments. Furthermore comments must be
obtained from Regional Council prior to Council adoption and
staff's recommendations have been structured accordingly.

AMENDMENT NO. 1 TO THE HAMLET DEVELOPMENT PLAN FOR THE HAMLET OF
ENNISKILLEN
I
1 . PURPOSE OF AMENDMENT
i
The purpose of Amendment No. 1 to the Hamlet Development Plan for
the Hamlet of Eniskillen is to delete all references within the
Development Plan that require the installation of a municipal
water system prior to residential development proceeding within
areas designated as "Areas Proposed for Expansion", and to
replace same with provisions allowing such development to proceed
on the basis of individual wells on residential lots having a
minimum lot area of 0.4 hectares; and to revise the total number
of lots to 22 within the area indicated as "A" on Schedule "1 " of
the Hamlet Development Plan.
2. BASIS OF AMENDMENT
This amendment to the Eniskillen Hamlet Development Plan is based
upon an amendment application submitted to the Town of Newcastle
to permit all new residential development to proceed on the basis
of individual wells. In order to implement such a request, the
Development Plan would require an amendment relating to the
minimum lot areas for residential lots and servicing of such
development in order to ensure an adequate supply of water for
existing and new residential development.
3. ACTUAL AMENDMENT
(i ) Schedule "1 " to the Hamlet Development Plan for the Hamlet of
Enniskillen is hereby amended by changing the maximum number
of residential lots within the area indicated as "A" to 22.
(ii ) Section 2 of the Hamlet Develoment Plan for the Hamlet of
Enniskillen is hereby amended by deleting subsection
2.2.2(ii ) entitled "Proposed Municipal Water System" in its
entirety.
(iii ) Section 2 of the Hamlet Development Plan for the Hamlet of
Enniskillen is hereby amended by deleting subsection
2.2.4(ii ) entitled "Proposed Municipal Water System" in its
entirety.
(iv) Section 3 of the Hamlet Development Plan for the Hamlet of
Enniskillen is hereby amended by deleting paragraph 2 of
subsection 3.2 and replacing said paragraph with the
following:
"The new residential lots should be rectangular and, have a
minimum area of 0.4 hectares in size, unless otherwise
specified within this plan, and shall be serviced by
individual wells."

(v) Section 3 of the Hamlet Development Plan for the Hamlet of
Enniskillen is hereby further amended by deleting from
subsection 3.21(vii ) (b) the words "; and shall ".
(vi ) Section 3 of the Hamlet Development Plan for the Hamlet of
Enniskillen is hereby further amended by deleting
subsection 3.21(vii )(c) in its entirety.
(vii ) Section 3 of the Hamlet Development Plan for the Hamlet of
Enniskillen is hereby further amended by deleting
subsection 3.2.1 (viii ) in its entirety and by renumbering
subsequent sections .
(viii ) Section 3 of the Hamlet Development Plan for the Hamlet of
Enniskillen is hereby further amended by deleting from
subsection 3.2.1 (ix)(c) the words "where the lot is served
by a municipal water system and 0.5 hectares".
(x) Section 3 of the Hamlet Development Plan for the Hamlet of
Enniskillen is hereby further amended by deleting from
subsection 3.9.1 (ii ) the words "extension of the municipal
water system" and replaced with the words "availability of
ground water supplies".
(xi ) Section 4 of the Hamlet Development Plan for the Hamlet of
Enniskillen is hereby amended by deleting subsection 4.2.1
in its entirety, and, replacing with the following
subsection 4.2.1 :
"4.2.1
Notwithstanding any provision of this plan to the contrary,
applications for development within the Area Proposed for
Expansion shall only be permitted by Registered Plans of
Subdivision and shall be serviced in all cases by
individual wells and private septic systems. Applications
for development shall be accompanied by a detailed
engineering report based on test drilling which confirms :
(i ) Soil conditions satisfactory for the effective
operation of a private waste disposal system;
(ii ) No adverse effects upon existing water supplies and
an adequate supply of potable water to service the
proposed development; and
(iii ) An adequate separation between water table and
septic tile fields.
If, after conducting the above investigation , evidence
satisfactory to the Town of Newcastle and the Durham Health
Unit has been produced which indicates that a reduction in
the minimum lot area requirement is warranted, Council may
approve such a reduction only so far as the minimum lot
size is not reduced to below 0.3 hectares and the average

lot size for a given proposal is not reduced to below 0.4
hectares. Upon receiving such approval , the applicant may
submit a proposal based upon this reduction to the maximum
number of lots which would be permitted by such a
reduction , but not to exceed the number of lots permitted
within a designated area. An amendment to the Hamlet
Development Plan shall be required in order to adjust the
maximum number of lots permitted."
