That Report PD-78-83 be received; and 2. That By-law 48-83 of the Citv of Oshawa be received and filed. BACKGROUND AND COMMENTS: j By-law 48-83 of the City of Oshawa was forwarded to the Planning and Development Department on May 9th. , 1983. The subject by-law would rezone a parcel of land situated on the north west corner of Townline Road South and Bloor Street East. By-law 48-83 which changes the land use designation for the above-noted property was passed for clarification of the permitted uses so as to explicitly confirm the use of the property as a treat- ment centre for handicapped children. In addition to the above, the lands subject to "Special Condition 124" were de- clared to be a site plan control area within the meaning of subsection 2 of Section 40 of the Planninq Act RSO. 1980r �� c. 379. �'� ,,` Report No. : PD-78-83 In liqht of the above, staff would have no objections to the proposed by-law. REGULATE LAND USE PASSED PURSUANT TO SECTION 39 OF THE PLANNING I ACT I TAKE NOTICE that the Council of The Corporation of the City of Oshawa intends to apply to The Ontario Municipal Board pursuant to the provisions of Section 39 of The Planning Act for approval of By-law Number 48-83 passed on the 18th day of April, 1983. A oopy of the by-law is furnished herewith. A note giving an explanation of the purpose and effect of the by-law and stating the lands affected thereby is also furnished herewith. ANY PERSON INTERESTED MAY within twenty-one (21) days after the date of this ?• notice, send by registered mail or deliver to the Clerk of the City of oshaaa notice of objection to approval of the said by-law or part thereof giving details O of all or the portion of the by-law to which you object and detailed reasons therefor, and shall indicate that if a hearing is held the objector or an agent will attend at the hearing to support the objection. BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law ;S 8 of The Corporation of the City of Oshawa by the Council thereof as follows: d { 1. By-law Number 3415 be and the same is hereby further amended by amending Schedule "A" thereof by adding Special Condition "124" as set out in Schedule "B" to this by-law. ;r. ' 2. Sheet Number 11 of Appendix "A" to By-law Number 3415, 1, as amended, is hereby further amended by changing the land use f designation for a parcel of land situated on the northwest corner I of Townline Road South and Bloor Street East, having approximately 115 metres of frontage on Townline Road South as shown on the .'4 revised Sheet Number 11 attached hereto as Schedule "A" from R-18 to R-1B subject to the provisions of Special Condition "129" so that .Sheet Number 11 shall be amended as shown on the revised Sheet Number 11 attached hereto as Schedule "A". 3. Schedules "A" and "B" attached hereto form part of this by-law. 4. The lands made subject to Special Condition Number "129" are hereby declared to be a site plan control area within the + meaning of subsection 2 of Section 40 of The Planning Act R.S.O. 1980 C. 379. t I �I -2- 1 5. Paragraph 4 of this by-law shall take effect from the + ! date of passing of this by-law. No other part of this by-law shall come into force without the approval of the Ontario Municipal Board but subject thereto this by-law shall take effect from the date of its passing. r.i. Defined Area: r, The area subject to this Special Condition is shown on j Schedule "A" hereto, outlined with a heavy line and hatched with the figures "124" encircled. 2, Permitted Uses: The land subject to this special condition shall not be used for any purpose except a handicapped children's ' .,,`•`,,"' treatment centre which includes any accessory uses i thereto, -2- 3. Building Area: I The total floor area of all buildings on the property shall not exceed a maximum of 2850.00 square metres. I 4.
