SUBJECT: PROVINCIAL GOVERNMENT FLOODPLAIN CRITERIA -
SPECIAL POLICY AREAS
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-77-83 be received; and
2. That the Central Lake Ontario Conservation
Authority be advised that, in the opinion of
the Town of Newcastle, there are no areas
within the Town of Newcastle that would qualify
as Special Policy Areas under Policy Number 3
of the Provincial Government's Floodplain
Criteria; and
3. That a copy of Staff Report PD-77-83 and
Council 's Resolution be forwarded to the
Central Lake Ontario Conservation Authority.

BACKGROUND AND COMMENTS:
On February 28th, 1983, the Planning Department received
from the Central Lake Ontario Conservation Authority, a copy
of the Provincial Government 's Floodplain Criteria. The
Criteria are a Policy Statement from the Provincial
Government on Planning for floodplain lands.
Policy Number 1 in the Policy Statement defines the greater
of the Regional Storm Flood or the One Hundred Year Storm
Flood as the Regulatory Flood. The Regulatory Flood is the
flood against which protection is to be provided and upon
which floodplain delineations are to be based. Within its
watershed, C.L.O.C.A. generally uses the Regional Storm
Flood as the Regulatory Flood, and enforces its Fill and
Construction Regulations within Regional Storm Floodlines.
Policy Number 3 in the Policy Statement notes that in
certain circumstances, however, the strict application of
Floodplain Regulations may not be feasible. Such a
situation would occur where a substantial proportion of the
commercial , retail , industrial or residential development in
a community is located in the floodplain , and the
rehabilitation, redevelopment or replacement of structures
within the floodplain is considered essential to the
continued viability of the community. In exceptional
circumstances such as this, a Municipality may request the
designation of the built-up area in the floodplain as a
Special Policy Area. Within a Special Policy Area, a higher
than normal degree of flood risk is accepted, and the
Conservation Authority uses a lower standard of protection
when considering applications for construction or the
placing of fill .

To date, C.L.O.C.A. has recognized three locations , all
within the Oshawa-Whitby area, as Special Policy Areas.
However, the Authority has requested the Town of Newcastle
to define any areas within the Town which we consider to
warrant special recognition under Policy Number 3.
Staff have reviewed the flood lain mapping for all of the

urban areas and hamlets within the Town, including those
within the Ganaraska Region Watershed. Generally, there is
very little urban-type development within floodplain lands,
and none which warrants special attention.
Therefore, staff recommend that Council advise C.L.O.C.A.
that no areas within the Town of Newcastle would, in the
Town's opinion, qualify for Special Policy Area status.
