SUBJECT: ZONING BY-LAW AMENDMENT - LOTS 32, 33,
CONC. III - FORMER TOWNSHIP OF DARLINGTON,
OUR FILES: DEV 82-27, S7A-1 -10-5

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-75-83 be received ; and
* 2. That the attached By-law to amend Restricted
Area By-law 2111, of the former Township of
Darlington, in respect of Part Lot 32 and 33,
Concession III , Township of Darlington, be
approved and forwarded to Council for
approval .
BACKGROUND:
The recommendations as contained within Report PD-28-83
(Plan of Subdivision and By-law amendment) were adopted by
Council on February 14th, 1983. The proposed by-law
amendment as attached to Report PD-28-83 was subsequently
passed by Council at the same meeting.

In consideration of the requirements pursuant to Section
39(28) of the Planning Act R.S.O. , 1980, the appropriate
Certificate of the Clerk was issued on March 28, 1983
approving the by-law amendment.
COMMENTS:
Within the context of By-law 83-2.7, the zoning
provisions with respect to minimum lot area - 0.5 hectares ;
and minimum lot frontage - 42 metres ; were representative of
the draft plan of subdivision as proposed and approved. One
of the conditions of draft approval (#11 ) , required that the
Owner dedicate the appropriate property to the satisfaction
of the Town of Newcastle for road widening purposes , free
and clear of all encumbrances, along the southerly limits of
Lot 26 and Block 27.
This condition was included in consideration of the comments
received from the Region of Durham, Transportation Branch.
The provisions contained within Section 13 - Transportation
Network - of the Region of Durham Official Plan illustrate
the location of a Type ' B' arterial road immediately
abutting the southerly limits of Lot 26 and Block 27.
Section 13.2.9 indicates that a Type ' B' arterial road shall
have a right-of-way width ranging from 86 feet to 120 feet.
As such, an appropriate road widening of 7.01 metres (23
feet) along the southerly limits of Lot 26 and Block 27 was
requested.

In consideration of the By-law minimums re: lot frontage and
lot area, as noted previously, the implementing of a 7.01
metre widening abutting Lot 26 would, however, result in the
creation, through draft approval , of a lot in contravention
of the by-law requirements - 36.72 metre frontage and .460
hectares in area. Staff acknowledges the requirements for
road widenings and accordingly, would have no objection to
the amending of By-law 2111 , as amended through By-law
83-27, thereby altering the frontage and area requirements
as pertaining to the draft plan 18T-62030 and permit the
implementation of said road widenings through draft
approval .

BY-LAW NUMBER 83-
being a By-law to amend Restricted Area By-law Number 2111 , as
amended, of the former Township of Darlington, now in the Town of
Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend Restricted Area By-law 2111, as amended, of the
former Township of Darlington;
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows :
1 . Section 13(aa) of By-law 2111, as amended, is hereby further
amended as follows :
I) By deleting from Section 13(aa) (3)(i ) , reference to "0.5
hectares" and substituting thereto "0.48 hectares".
1I) By deleting from Section 13(aa) (3)(ii ) , reference to "42
metres" and substituting thereto "38 metres) .
2. This By-law shall come into effect on the date hereof,
subject to the
� provisions of Section 39(11 ) of the Planning Act . i
