SUBJECT: SUMMARY OF LAND DIVISION COMMITTEE
APPLICATIONS FOR THE MONTH OF MARCH, 1983
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-71-83 be received for
information.
BACKGROUND AND COMMENTS:
For the information of the General Purpose and
Administration Committee, staff- have prepared the attached
list of applications to the Land Division Committee for the
month of March, 1983. This list includes the file number,
applicant's name, site location, type of severance
requested, Official Plan conformity, By-law conformity,
staff's comments on the applications and the Land Division
Committee 's decision. In addition, further to a request
from the Committee, an attachment explaining a conflict
between staff's recommendation and the Land Division
Committee has been included for applications LD 65/83 and LD
72/83.

1 ) LAND DIVISION COMMITTEE APPLICATION LD 65/83
S. ZUBCZYK - PART OF LOT 31 AND 32, CONCESSION 6,

The subject application requested permission to separate a
10.0 acre parcel of land from the total acreage of 20.0
acres. In reviewing this application, staff noted that the
area was designated as "Permanent Agricultural Reserve"
within the Region of Durham Official Plan. Under this land
use designation, limited non-farm related residential uses
would only be permitted for retirement lots for bona fide
farmers; the severance of a farmhouse as a result of farm
consolidation ; or for a lot for one member of the farmer's
family who is significantly involved in the operation of the
farm. With regards to the above policies, staff considered
the request not to be in conformity with the Region of
Durham Official Plan and therefore recommended denial of the
application. However, we had advised the Land Division
Committee that should a conflict arise regarding our
interpretation of the Regional Plan and the Regional
Planning staff's interpretation of the Plan, then the
Regional staff's interpretation of the Regional Plan shall
prevail .
In the minutes of the meeting, Mr. Zubczyk expalined that
the two 10.0 acre parcels had been separate holdings
previously, and that the lands were purchased as two 10.0
acre parcels, and have since become consolidated. In
addition, it was noted that there were over twenty 10.0 acre
parcels abutting the subject lot with the majority
containing single family dwellings. Therefore, it would
appear that the proposal conforms with the provisions of the
Plan as this is considered a technical severance, in which
case the Regional Planning staff has concurred with the
approval .

appealed to the Ontario Municipal Board by the Town of
