SUBJECT: APPLICATION TO AMEND HAYDON HAMLET DEVELOPMENT
PLAN - MR. AND MRS. C. SKERRATT
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-70-83 be received; and
2. That the proposed amendment to the Haydon
Hamlet Development Plan be forwarded to Council
for approval at such time as the Council of the
Regional Municipality of Durham has considered
the amendment to the Haydon Hamlet Development
Plan ; and
3. That a copy of this Report, and the
attachments thereto, be forwarded to the Region
of Durham for their information and
consideration; and
4. That Mr. and Mrs. Skerratt be required to
immediately erect an information sign on the
subject property with the wording to be
approved by Planning Department staff.

BACKGROUND:
On February 8th, 1983, the Town of Newcastle Planning
Department received an application from Mr. and Mrs. P.
Skerratt to amend the Haydon Hamlet Development Plan to
permit the creation of additional building lots on the
Skerratt's property on the west side of Maple Street.
Mr. and Mrs. Skerratt own 9.1 hectares (22.5 acres) of land,
most of which lies outside the boundaries of Haydon,
including that portion which fronts on Maple Street. Staff
note that Maple Street is only maintained by the Town of
Newcastle for a distance of approximately 120 metres (395
feet) past the Hamlet limits on the west side of Maple
Street. Therefore, the boundaries of the Hamlet will need
to be extended in order to create additional building lots,
but can only be extended to the end of the maintained
portion of Maple Street.
The Haydon Hamlet Development Plan states that Haydon is
located on a flat to gently rolling plain of silty clay
till , which has poor to fair permeability and percolative
capacity. As well , portions of the valley bottoms of the
two Bowmanville Creek tributaries which drain the area are
subject to a seasonally high water table. Because of these
two factors, the Hamlet Development Plan establishes a
minimum lot area of 0.5 hectares (1 .23 acres) for new lots.
Staff note, however, that the area subject to the amendment
application is much higher than the rest of the Hamlet and
therefore may possess better drainage characteristics. It
may be possible for new lots on this high land to be smaller
than the minimum size prescribed by the Hamlet Development
Plan.

Based on the application submitted by Mr. and Mrs. Skerratt
and the factors discussed above, staff have drafted an
amendment to the Haydon Hamlet Development Plan. A copy of
* the proposed amendment is attached to this Report for
Council 's consideration.
In accordance with Departmental procedures, the draft
amendment was circulated to various departments and agencies
for comment. The following is a list of comments received:
Town of Newcastle Public Works Department
"no objection"
Town of Newcastle Fire Department
"The Fire Department has no objection to the proposed
amendment.
Haydon area receives fire emergency service from Station No.
1 , Bowmanville, with an approximate travel distance of 12
miles, which indicates the need for an additional fire
station located in the northern section of the Town. Access
for Fire Department equipment shall be provided by means of
public thoroughfare or street. Static water supply for fire
protection would be from the tributary of Bowmanville Creek,
running through the centre of Haydon. This is a fast
running stream with water supply through freezing weather
conditions."
Region of Durham Planning
"No comment"
Region of Durham Health Unit
"Please be advised that this department has no objections to
the creation of residential lots having a minimum lot size
of 0.3 hectares."

COMMENTS:
Staff have reviewed the comments received and note that
there are no major concerns with the amendment as proposed.
Staff therefore recommend that Amendment No. 2 to the Haydon
Hamlet Development Plan be forwarded to Council for approval
at such time as the amendment to the Hamlet Plan has been
considered by Regional Council .
Staff note that there is no standard procedure for
soliciting public input on an amendment to a Hamlet
Development Plan, but feel that it is important to obtain
the public's views prior to final approval of the amendment
by Council . Staff therefore respectfully recommend that Mr.
and Mrs. Skerratt be required to immediately erect an
information sign on the Maple Street frontage of the parcel
subject to the amendment, with the wording of the sign to be
approved by Planning Department staff.

AMENDMENT NO. 2 TO THE HAMLET DEVELOPMENT PLAN FOR THE
HAMLET OF HAYDON
1 . Purpose of Amendment
The purpose of Amendment No. 2 to the Hamlet Development
Plan for the Hamlet of Haydon is to expand the limits of
the Hamlet area to permit minor residential expansion
and to reduce the minimum lot area requirement where
warranted.
2. Basis of Amendment
This amendment is based upon a proposal for the
creation of additional building lots on an existing
street frontage currently outside the limits of the
Hamlet of Haydon as defined by the Hamlet Development
Plan.
3. Actual Amendment
Schedule "1 " to the Hamlet Development Plan for the
Hamlet of Haydon is hereby amended by extending the
limits of the Hamlet Development Plan as indicated on
the attached Schedule "X" hereto, and by designating the
lands affected by said expansion as "Residential
Infilling, Three (3) Lots" as also indicated on the
attached Schedule "X" hereto.
The Hamlet Development Plan for the Hamlet of Haydon is
hereby amended by:
1 . Deleting in its entirety, Section 4.2; and
2. Inserting the following Section 4.2:
"4.2 Notwithstanding any provision of this plan to
the contrary, an application for development by
registered plan of subdivsion or by consent shall be
accompanied by a detailed engineering report based
on test drilling which confirms:
(i ) Soil conditions satisfactory for the effective
operation of a private waste disposal system;
and
(ii ) No adverse effects upon existing water supplies
and an adequate supply of potable water to
service the proposed development; and
(iii )An adequate separation between water table and
septic tile fields.

If, after conducting the above investigation, evidence
satisfactory to the Town of Newcastle and the Durham
Region Health Unit has been produced which indicates
that a reduction in the minimum lot area requirement is
warranted, Council may approve such a reduction only so
far as the minimum lot size is not reduced to below 0.3
hectares. Upon receiving such approval , the applicant
may submit a proposal based upon this reduction to the
maximum number of lots which would be permitted by this
reduction, but not to exceed the number of lots
permitted within a designated area. An amendment to the
Hamlet Development Plan shall be required in order to
adjust the maximum number of lots permitted."
