HomeMy WebLinkAboutPD-58-83 CORPORATION OF THE TOWN OF NEWCASTLE PLANNING AND DEVELOPMENT DEPARTMENT T.T.EDWARDS,M.C.I.P.,Director HAMPTON,ONTARIO LOB UO TEL.(416)263.2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF APRIL 5th , 1983 REPORT NO. : PD-58-83 SUBJECT: PROPOSED AMENDMENT 91 TO THE DURHAM REGION OFFICIAL PLAN; APPLICATION BY SCUGOG TOWNSHIP TO PERMIT A MINERAL AGGREGATE RESOURCE EXTRACTION AREA RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-58-83 be received; and 2. That the Ministry of Municipal Affairs and Housing be advised that the Town of Newcastle has no objection to proposed Amendment 91 to the Durham Region Official Plan to permit a Mineral Aggregate Resource Extraction Area in Part of Lot 12, Concession 1 , former Township of Cartwright, Township of Scugog, subject to the following considerations being addressed: a) for safety reasons, and to mitigate any possible negative effects of heavy vehicular traffic on the draft approved plan of subdivision (18T-75362) immediately to the south of this site, it is suggested that access from the Scugog/Newcastle Boundary Road be located at the east limits of the site, and that truck traffic be required to travel east from that point directly to Regional Road 57; and i 1.) Report No: PD-58-83 . . ./2 b) that the Boundary Road Agreement between the Town of Newcastle and the Township of Scugog be amended, as necessary, to ensure implementation of a) above, and to ensure that all necessary road improvements and related maintenance shall remain/become the responsibility of the Township of Scugog; and c) that the sequence of excavation be altered to permit immediate excavation of Phases I , VI and VII in order to minimize the long term effects of operation upon the draft approved plan of subdivision (18T-75362) to the south; and 3. That a copy of the Staff Report PD-58-83 and Council 's Resolution be forwarded to the Ministry of Municipal Affairs and Housing. BACKGROUND: On March 18th, 1983, the Town of Newcastle received a letter from the Ministry of Municipal Affairs and Housing requesting the Town's comments on proposed Amendment 91 to the Durham Region Official Plan. This proposed Amendment relates to the application made by the Township of Scugog to amend the Regional Official Plan to permit the establishment of a Mineral Aggregate Resource Extraction Area on a site abutting the Boundary Road with the Town of Newcastle. The Town of Newcastle was originally notified of the Official Plan Amendment application on May 6th, 1982. In Report PD-113-82, which the General Purpose and Administration Committee considered at its meeting of June 28th, 1982, staff noted that the proposed extraction area is located opposite the lands covered by draft approved plan of subdivision 18T-75362 (Burketon Hills Estates) in the Hamlet of Burketon ke see attached ( y map) . Staff recommended that the Region be advised that the Town of Newcastle has no objection to the application subject to two considerations dealing with truck traffic and the phasing of excavation being considered. i i Report No: PD-58-83 . . ./3 However, Committee resolved (Resolution # GPA-809-82) that the Report be tabled until the Region had convened a public meeting in the Burketon vicinity. Subsequently, at its meeting of July 5th, 1982, Council resolved (Resolution # C-550-82) to advise the Region that the Town would forward its formal position on the amendment application at such time as the Region has convened a public meeting in the Burketon area; however, Council identified a number of concerns relating to truck traffic, the Boundary Road Agreement and the sequence of excavation to be forwarded to the Region for information. A copy of * Resolution # C-550-82 is attached to this Report for Council 's convenience. Scugog Township responded to the Town 's position in a letter to the Region dated July 16th, 1982. The Township indicated its willingness to require truck traffic to travel east from the pit directly to Regional Road 57, and to amend the Boundary Road Agreement to ensure that all necessary road improvements and/or related maintenance shall become the responsibility of -the Township of Scugog for that section of road from the entrance of the pit to Regional Road 57. However, the Township did not mention relocating the access to the pit to the east limit of the site, and requested further time to consider the sequencing of excavation. The Township noted that it intended to implement a revegetation and rehabilitation program as portions of the pit become excavated. i Report No: PD-58-83 . . ./4 The public meeting regarding the Official Plan Amendment application was held during the regular meeting of the Regional Planning Committee on February 22nd, 1983. Regional Planning staff placed posters in the Hamlet of Burketon and in local papers to notify the residents of the time and location of the public meeting. In the Commissioner's Report to the Planning Committee, it was noted that an existing sand and gravel extraction operation operated by Scugog Township and in the final stages of rehabilitation, is located immediately to the east of the subject site. It was also observed that the subject site is presently zoned "M4-Extractive Industrial Zone" in the Township 's Zoning By-law. The Report identified the compatibility of the proposed pit and the draft approved subdivision in Burketon as a major issue. However, it was noted that the most northerly portion of the subdivision would probably not develop for several years and that , given a considerable visual buffer which exists between the two uses, and the fact that the Township's operations will be limited to winter sanding purposes, the subdivision and the pit could co-exist. The Report recommended approval of the Official Plan Amendment application. Two delegations on this matter were received as part of the public meeting. Mr. John Kennedy, a Consultant representing the owners of Burketon Hills Estates, stated his objection to the proposed pit, noting that the truck traffic, noise and dust associated with the excavation would have a negative impact on the lots. He indicated that he expected to execute Agreements with the Town and Region in the near future, and put lots up for sale this spring. Report No: PD-58-83 . . ./5 A real estate agent accompanying Mr. Kennedy indicated that the value of the lots abutting the boundary road could drop considerably if the pit proceeded. The second delegation consisted of the owner of the land to be excavated and a representative from the Township of Scugog. Both indicated that the proposed pit is a logical extension to the Town 's rehabilitated pit directly to the east, and that trucks leaving the pit would use Regional Road 57, since the screening plant is located to the north on that road. The Planning Committee resolved to recommend approval of the amendment application to Regional Council . Regional Council adopted the Committee recommendation at its meeting of March 2nd, 1983. On March 18th, 1983, the Town of Newcastle was notified by the Ministry of Municipal Affairs and Housing that the owners of Burketon Hills Estates had requested that proposed Amendment 91 to the Durham Region Official Plan be referred to the Ontario Municipal Board. The Ministry advised the owners that the amendment has been circulated for comment, and the referral request will be considered when the review is completed. COMMENTS: Staff have reviewed the Official Plan Amendment application and note that the impact of the proposed pit on the Burketon Hills Estate Subdivision will be mitigated somewhat by the following factors - i Report No: PD-58-83 . . ./6 the pit operations will be limited to a few days in the spring and fall , the presence of a vegetative buffer between the two uses , and the intention of Scugog Township to implement a revegetation and rehabilitation program on the excavated portions of the pit. Staff also note that Scugog Township have indicated their willingness to assume responsibility for that portion of the boundary road between the pit entrance and Regional Road 57, thereby eliminating any financial impact on the Town of Newcastle. Despite these factors however, staff feel that additional efforts are necessary if the impact of the pit on the subdivision is to be reduced sufficiently to allow the two uses to co-exist. This is especially important since the licence issued by the Ministry of Natural Resources for the pit permits Scugog Township to substantially increase the tonnage of aggregate it removes to well above the level the Township presently proposes. Staff feel the concerns outlined by Council in Resolution # C-550-82 and forwarded to the Region for information should be brought to the attention of the Ministry of Municipal Affairs and Housing. Staff therefore recommend that Council advise the Ministry that it has no objection to proposed Amendment 91 , subject to the concerns expressed earlier by Council being given consideration by the Ministry.
