SUBJECT: APPLICATION FOR REZONING - SOUTHWOOD
INDUSTRIES LIMITED - PART OF LOT 8,
B.F.C., FORMER TOWN OF BOWMANVILLE

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-57-83 be received; and
* 2. That the attached By-law amending By-law 1587,
as amended, be approved.
BACKGROUND:
On February 25th, 1983, staff received the subject
application for rezoning from Southwood Industries Limited.
The subject application was submitted following a number of
discussions between staff and the applicant in respect of
the relocation of an existing industrial use and factory
outlet to the subject lands.

The lands in question are shown as Part 6 on registered
reference plan 1OR-379, are designated "Industrial " by the
Durham Regional and Bowmanville Urban Area Official Plans
and presently zoned "M-1 Light Industrial ". The "M-1
Industrial " Zone permits the proposed industrial use, which
is a furniture manufacturing establishment, but does not
specifically permit a factory outlet for the retail or
wholesale sale of the manufactured goods. The lands
immediately to the north and west of the subject lands are
zoned "Special Condition 7" by By-law 1567, and among the
various uses permitted by Special Condition 7 is a retail
store accessory or incidental to the industrial use.
The proposed amendment to the zoning by-law would make the
zoning of the site consistent with that of surrounding lands
and facilitate the operation of the industry in question
from these lands. Due to the nature of the proposed by-law
amendment, and the fact that there will be no physical
change to the site and the fact that we are dealing with an
existing building, a very limited circulation was
undertaken. In response to our circulation, there were no
objections received.

COMMENTS:
The subject application for rezoning was originally
suggested by staff and has been encouraged insofar as it
will facilitate retention of an industry within the Town of
Newcastle. The subject industrial use was previously
located elsewhere within the Municipality, but was located
on lands that were not designated for industrial uses, nor
were they appropriately zoned. The proposed amendment would
enable the applicant to use a portion of the industrial
building as a factory outlet for his product, and this is a
use which is consistent with the zoning of the balance of
the lands located on Caristrap Street.

Staff are therefore recommending that the attached by-law be
approved by Council .

THE CORPORATION OF THE TOWN OF NEWCASTLE
BV-LAW NUMBER 83- 59
being a By-law to amend Restricted Area By-law Number 1587, as
amended, of the former Town of Bowmanville, now in the Town of
Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to amend Restricted Area By-law 1587, as amended,
of the former Town of Bowmanville.
NOW THEREFORE, the Council of the Town of Newcastle ENACTS as
follows:
1. Schedule "A" to By-law 1587, as amended, is hereby further
amended by adding the designation "SPECIAL CONDITION 30" to the
zoning designation of the lands indicated as "ZONE CHANGE TO SPECIAL
CONDITION 30" on the attached Schedule 'X' hereto, and by adding to
the lands so indicated cross-hatching and the figure 30 encircled.
2. Schedule "B" to By-law 1587. as amended, is hereby further
amended by adding hereto the following SPECIAL CONDITION 30:

Those lands as shown on Schedule "A" cross-hatched and marked
"SPECIAL CONDITION 30" shall be subject to the special regulations
hereinafter contained and where there is any conflict between the
regulations hereinafter set out and any provision of By-law 1587,
then the provisions of this SPECIAL CONDITION shall apply, but in all
other respects the provisions of By-law 1587, as amended, shall
apply.
1.1 DEFINED AREA
The area subject to this SPECIAL CONDITION are shown cross-hatched
with the figure 30 encircled on the attached Schedule "A" hereto.
1.2 DEFINITIONS

manufactured by the industry are kept for wholesale or retail
sale, and shall not exceed fifteen percent (15%) of the gross
floor area of the building or porton of the building within
which the permitted industrial use is located.

1.3 PERMITTED USES
(i) a Factory Outlet shall be permitted in addition to
the uses permitted within the M-1 Industrial Zone.
1.4 ZONE PROVISIONS
The zone provisions of the M-1 Industrial Zone shall apply to
the lands shown as "SPECIAL CONDITION 30" on Schedule "A"
hereto.
3. This By-law shall come into effect on the date hereof. subject
to the provisions of Section 39(11) of the Planning Act.
