HomeMy WebLinkAboutPD-39-83 10- ) CORPORATION OF THE TOWN OF NEWCASTLE BUILDING DEPARTMENT TELEPHONE 263-2231 - HAMPTON, ONTARIO, LOB UO 7 i REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF MARCH 7, 1983 REPORT NO. : PD-39-83 SUBJECT: PROPERTY STANDARDS REPORT RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: I 1 . That Report PD-39-83 be received for information. BACKGROUND: The Maintenance and Occupancy By-law was passed in May of 1982, and a written complaint must be submitted before any action is taken. The By-law did not become effective until July 1 , 1982, which was coincidental with the appointment of a Property Standards Officer and a Property Standards Committee. I i COMMENTS: During 1982 there were 26 written complaints, 23 of which related to maintenance of yards, and 4 maintenance of buildings, health and safety. A number of complaints have been received by phone from people, who by lack of a follow-up written complaint would seem to fear reprisal from their landlord. Report No: PD-39-83 . . ./?_ When a written complaint is received the following procedure is followed: 1 ) Assessment rolls are checked for lot and plan numbers, name and address of owner(s), tenants; 2) An inspection of the property is made to determine if the property complies with the By-law; 3) If not in conformity, the problem is discussed with the owner/tenant and a time for re-inspection determined; 4) If on re-inspection the property is still not in conformity with the By-law, an informal notice setting out violations and re-inspection date is mailed; 5) On re-inspection, if the violation still exists a title search is initiated to determine the owner; 6) When information from title search is received, a formal Notice of Non-Conformity specifying the time and place of a hearing with the Property Standards Officer; I 7) During the hearing the matter is discussed and the Property Standards Officer specifies a period within which the property must be made to conform; 8) On expiration of the specified time, an inspection is made of the property to determine conformity with the By-law. If not in conformity an "Order" is issued to the owner specifying the nature of the repair required to make the property conform, and the final date of appeal to the Property Standards Committee. The Order is registered against the title of the property; i Report No: PQ-39-83 . . ./3 9) If there is an appeal , all parties concerned appear before the Property Standards Committee; 10) Should the decision of the Committee not be acceptable to anyone affected by the decision, the matter can then be appealed to the Courts; 11 ) If there is no appeal to the "Order" , property must be monitored to ensure conformance with the By-law and "Order" . i The Property Standards Officer must review the matter with the owners and recommend the action to be taken to obtain compliance which could result in : (a) charges laid against the owners in Provincial Court ; (b) demolition of the property; (c) extension of time in which to comply; or (d) that the Town repair or demolish the property by By-law. The attached chart indicates the number of complaints to date since the By-law was passed in 1982. The active column is the number that are still in various stages of the process up to formal notice issued. Closed files are those that have been closed because the property was brought into conformity or on investigation, the complaint was unfounded. There is no activity showing in the last three columns because of the short time the By-law has been in effect .
